З 2000 року я неодноразово роз'яснював механізми набуття статусу біженця та аналізував імміграційні програми різних країн. Ми оцінювали їх за критеріями зручності, швидкості виїзду, вартості, ризиків та можливостей для інтеграції всієї родини на новому місці.
Вся справа в принципах, на яких базується будь-яка імміграція. Проте за останні роки правила гри на світовій арені кардинально змінилися. Життя мільйонів людей, навіть тих, хто проживає далеко за межами України, чітко розділилося на три етапи: до 2014 року, період після початку окупації та сувора реальність після 24 лютого 2022 року.
Хронологія закручування гайок: від 2014 до 2022
Для багатьох іноземних громадян (передусім мешканців країн колишнього соцтабору та снд) перші тривожні дзвіночки пролунали в березні 2014 року. Саме тоді, з початком гібридної агресії та окупації українських територій, у їхніх власних державах увімкнувся режим прискореного придушення свобод. Стало очевидним, що правові механізми всередині цих країн починають стрімко деградувати, а тиск на бізнес та цивільне суспільство посилюється.
Проте справжня катастрофа правових систем відбулася 24 лютого 2022 року. Повномасштабне віроломне вторгнення остаточно зняло всі маски. Життя суттєво погіршилося: репресивні апарати як держави-агресора так в ряде інших країнах, які підтримують війну в Україні - отримали карт-бланш. Те, що раніше здавалося відносно мирним (хоч і складним) існуванням, перетворилося на зону тотального ризику.
Сьогодні чимало громадян, які опинилися під ударом системи, розраховують на стандартні імміграційні програми. Проте навіть за наявності підстав вони вимагають тривалого очікування. Коли часу немає і рахунок іде на дні, єдиним легальним інструментом швидкого переїзду та захисту стає набуття статусу біженця.
Ця програма заснована на Женевській конвенції 1951 року та Протоколі 1967 року. Вони дають законне право на захист в іншій країні, якщо на батьківщині (у державі громадянської належності) особі загрожують органи влади. Якщо погрози несуть реальну небезпеку тривалого ув'язнення або фізичної розправи над людиною чи її родиною, часу на збір документів немає — потрібно просто негайно шукати шляхи відходу.
Ілюзія «безпечного закордону» та пастка другого паспорта
До війни мені регулярно телефонували з питаннями про статус біженця в ЄС, США, Канаді, Австралії навіть Японії. Зараз ця тема знову у тренді. Розмова зазвичай починається класично: «Хочемо емігрувати з родиною — швидко, безпечно й недорого». На запитання про вибір країни люди найчастіше називають місця, де колись були туристами, або держави, які у всіх на слуху.
Проте під час детальної розмови з'ясовується, що у людини виникли серйозні проблеми зі специфічними структурами на батьківщині. Використовуючи владні повноваження, ці органи банально «віджимають» бізнес або змушують людину мовчати. Людині штучно «шиють» кримінальну справу, і ось вона вже під загрозою арешту. Впевнений, кожен, хто читає цю статтю, згадає не один десяток таких прикладів зі свого життя чи досвіду знайомих.
Природно, що людина шукає «запасний аеродром». У хід ідуть інтернет-поради, знайомі та «авторитетні» юристи. Проте про реальну небезпеку багато хто згадує лише тоді, коли за кордоном їх затримують місцеві правоохоронці для подальшої екстрадиції.
Важливо пам'ятати: Поняття екстрадиція, депортація, видворення та висилка — це абсолютно різні правові процедури з різними юридичними наслідками.
Якщо у біженця відоме прізвище (на кшталт, Каспаров, Ходорковський чи Чичваркін), процес екстрадиції буде публічним та ускладненим. Але якщо ви звичайна людина, наявність лише одного паспорта чи навіть дозвілу на проживання/постійне місце проживання в іншій країні, не врятує вас від видачі у «теплі та липкі руки» силовиків із вашої батьківщини.
Навіть наявність другого громадянства (іншого паспорта) в ряде випадків не гарантує безпеки. Міжнародний розшук часто використовують як інструмент жорсткого тиску. Під час затримання правоохоронці іноземної держави ідентифікуватимуть вас насамперед як громадянина тієї країни, яка оголосила вас у розшук. Другий паспорт чиновники можуть просто проігнорувати, а процедура перебування в депортаційному центрі в очікуванні суду, не додає оптимізму.
Нова реальність: анулювання куплених паспортів у ЄС
Слід враховувати, що після подій 2022 року імміграційні служби країн світу почали вкрай жорстко перевіряти підстави набуття громадянства. Цей процес лише прискорюється.
Ми вже маємо підтверджену інформацію, що такі країни, як Румунія, Угорщина, Болгарія та Польща, самостійно позбавляють громадянства осіб, чиї первинні документи (наприклад, архіви про коріння) викликають сумніви або не підтверджуються повторно.

Повторні перевірки та «дозапити» стали звичайним явищем. Жоден європейський чиновник не хоче мати особистих проблем у ЄС, з Інтерполом чи Європолом.
Які наслідки? Людину поміщають до депортаційного центру або в'язниці, звідки вона буде відправлена на батьківщину. Опинившись у такій пастці, заявити про себе як про біженця на підставі Женевської конвенції стає майже неможливо. А якщо між країнами підписано двосторонню угоду про правову допомогу, процес екстрадиції відбувається миттєво.
Багато хто вважає, що можна захищатися дистанційно, перебуваючи за кордоном. Але вони забувають, що для системи на батьківщині вони є «злочинцями-утікачами» у міжнародному розшуку. Заочний захист малоефективний, адже слідчі дії просто заморожуються до моменту вашого затримання. Тому дорогоцінний час після вимушеного та термінового від'їзду потрібно використовувати з розумом, а не чекати на арешт.
Що робити та як захиститися?
У світі є багато країн, де можна попросити притулок. Проте перш ніж запускати процедуру, необхідно чітко розуміти:
· Де існує найвища ймовірність отримати бажаний статус?
· Яка країна дає максимальні гарантії невідворення (невидачі) заявника?
· Де Ви та ваша родина зможете найшвидше адаптуватися та інтегруватися з найменшими втратами?
Саме на вирішенні цих завдань будується наша робота. Спираючись на те, що заявляє сам шукач притулку, за умови правильного підходу до формування історії переслідування та збору доказової бази, можна законно уникнути екстрадиції. How Refugee Status Actually Works: The Myth of ‘Second Passports’, Extradition Risks, and the Reality Post-2014 and 2022
Since 2000, I have frequently analysed the mechanics of acquiring refugee status and evaluated immigration programmes across various jurisdictions. Over the years, our focus has remained on assessing these options based on practical convenience, relocation speed, financial costs, potential risks, and long-term integration prospects for the entire family in a new country.
Immigration processes are invariably governed by strict foundational principles. However, over the past few years, the global landscape has undergone a fundamental shift. The lives of millions of people—including those residing far beyond the borders of Ukraine—have been starkly divided into three distinct eras: life before 2014, the period following the initial occupation, and the harsh reality after 24 February 2022.
The Timeline of State Repression: From 2014 to 2022
For many foreign nationals, particularly residents of former Soviet republics and the CIS, the first warning signs appeared in March 2014. With the onset of hybrid aggression and the occupation of Ukrainian territories, their home states accelerated a systematic crackdown on civil liberties. It became clear that domestic legal frameworks were rapidly deteriorating, while pressure on private businesses and civil society began to mount.
The definitive collapse of these legal systems occurred on 24 February 2022. The full-scale, unprovoked invasion stripped away any remaining illusions. The situation deteriorated severely as the repressive apparatuses of both the aggressor state and a number of other countries supporting the war in Ukraine were granted unprecedented powers. What had previously seemed a relatively stable, if complicated, existence abruptly transformed into a high-risk environment.
Today, many individuals targeted by these systems mistakenly rely on standard immigration channels. Yet, even when valid grounds exist, these pathways involve prolonged waiting periods. When time is short and every day counts, the only legitimate instrument for rapid relocation and immediate protection is acquiring refugee status.
This avenue is governed by the 1951 Geneva Convention and the 1967 Protocol. They grant a lawful right to protection in a foreign country if an individual faces genuine threats from the authorities in the state of their nationality. When these threats pose a real danger of lengthy imprisonment or physical violence against the individual or their family, there is simply no time to gather standard documentation—one must find an immediate escape route.
The Illusion of a ‘Safe Haven’ and the Second Passport Trap
Before the war, I regularly received enquiries regarding refugee status in the EU, the UK, the US, Canada, Australia, and even Japan. Today, this topic is highly relevant once again. Conversations usually begin in a predictable manner: “We want to emigrate with the family—quickly, safely, and affordably.” When asked about their preferred destination, people usually name countries they have previously visited as tourists or nations that are constantly in the headlines.
However, a closer look at these cases reveals that the individual faces severe trouble with highly specific governmental structures back home. Abuse of power is widespread; these entities routinely seize private businesses or force individuals into silence by fabricating criminal cases. Anyone reading this can likely recall dozens of such examples from their own experience or from acquaintances.
Naturally, the individual searches for a ‘back-up plan’. They turn to internet forums, personal contacts, and seemingly influential lawyers. However, many only realise the true scale of the danger when they are detained by local law enforcement abroad for subsequent extradition.
Crucial to Remember: The terms extradition, deportation, removal, and expulsion represent completely distinct legal procedures with vastly different judicial consequences.
If the refugee bears a high-profile surname (such as Kasparov, Khodorkovsky, or Chichvarkin), the extradition process becomes highly publicised and legally complex. But if you are an ordinary citizen, holding a single passport or a standard temporary or permanent residence permit in a foreign country will not shield you from being handed straight over to the harsh custody of law enforcement from your homeland.
Even holding dual citizenship (a second passport) offers no guarantee of safety in a number of cases. International arrest warrants are frequently weaponised as tools of severe pressure. Upon detention, foreign law enforcement agencies will identify you primarily as a citizen of the state that issued the warrant. Foreign officials may simply ignore your second passport, and spending months in a detention centre awaiting a court ruling is hardly a cause for optimism.
The New Reality: Revocation of Purchased EU Passports
It is vital to recognise that following the events of 2022, immigration authorities worldwide have drastically tightened their scrutiny over the grounds on which citizenship was acquired. This trend is only accelerating.
We now have verified reports that countries such as Romania, Hungary, Bulgaria, and Poland are independently revoking the citizenship of individuals whose original supporting documents (such as archival records regarding ancestry) raise doubts or fail subsequent verification.

European investigations and law enforcement reports clearly illustrate the dismantling of large-scale corruption networks that falsified lineage data to legalise third-country nationals. Re-investigations, the annulment of illegally issued passports, and additional formal audits have become standard practice, as no European civil servant is willing to face personal liability within the EU, or trouble with Interpol and Europol.
What are the consequences? Individuals are being stripped of their residency rights on a mass scale and placed in deportation centres or prisons. Recent precedents demonstrate that even staying in leading EU nations offers no protection from arrest; organizers and participants of such fraudulent schemes are being successfully extradited from Germany without the right to bail.
Once caught in this trap, claiming asylum under the Geneva Convention becomes virtually impossible. Furthermore, if the two nations share a bilateral legal assistance treaty, the extradition process is executed swiftly.
Many believe they can mount a legal defence remotely from abroad. They overlook the fact that within their home jurisdiction, they remain fugitives from justice on international wanted lists. A remote defence is largely ineffective, as domestic investigative proceedings are simply frozen until the moment of arrest. Therefore, the precious time following a forced and urgent departure must be utilised wisely, rather than waiting around for an arrest.
How to Proceed and Secure Protection
There are numerous countries worldwide where one can seek asylum. However, before initiating the procedure, you must clearly understand:
· Where is the probability of securing the desired status highest?
· Which country offers the strongest guarantees against refoulement (forced return or extradition)?
· Where can you and your family adapt and integrate most rapidly with minimal disruption?
