29 January 2018 – Helpful and just interesting Immigration News from the Immigration Lawyers who can really help - www.legalcentre.org – Mob/Viber/WhatsApp : +44(0)7791145923 >>> Unlawful retention of passport by Entry Clearance Officers (ECOs) : <noindex>http://www.bailii.org/ew/cases/EWHC/Admin/2011/1388.html</noindex> The case of R (on the Application of Atapattu) v The Secretary of State for the Home Department [2011] EWHC 1388 (Admin) (27 May 2011) is an important case that I was just too busy to write up at the time but to which a return is worthwhile. It concerns the unlawful retention of a passport by an Entry Clearance Officer and a claim for damages for conversion. Conversion is a tort under Section 1 of the Torts (Interference with Goods) Act 1977 and is basically akin to theft. In this case the claimant had written to the ECO demanding return of the passport, which belonged to him, the claimant. The ECO had simply ignored all such correspondence and only returned the passport after the commencement of legal proceedings. The claim for conversion was therefore made out. >>> How to request to set aside the Determination of First Tier Tribunal in fast track asylum appeals ? If an asylum seeker’s case has been determined by the First Tier Tribunal under the fast track scheme, and the one comes across the overriding case-law (new) etc, then the one can write a letter to the concerned Tribunal and the Tribunal will pass the request to the duty judge to be looked at. >>> Are you an overstayer with a joint British child who lives with the other parent ? You can may be able to regularize your immigration status without leaving the UK If you are an overstayer with a joint British child who lives with the other parent, you may still be able to regularize your immigration status in the UK and remain in the UK lawfully on the so-called 10 Year Route to Settlement. In terms to the parental responsibility by an overstayer, it may be sufficient to provide a written confirmation of mutual consent, without any contact order. The “no order” principle under the Children Act 1989 may apply and the family court may not issue a contact order or rather a Family Arrangements Order as they are now called. This is usually the case where two parents with parental responsibility for a child have mutual agreement / arrangements for the child(ren)’s welfare. So the one can go for the signed written agreement and inform the UK BA of this “no order principle” and it may be fine in line with the FLR(FP) applications. >>> Joining your British/Settled sponsor for Settlement with children one of which is over the age of 18 It may still be possible to bring your over the 18 years old child for Settlement with you. The UK VAC is likely to refuse the initial application yet it may be possible to challenge the refusal and succeed following the Art 8 (Human Rights) ECHR appeal. The over 18 years old child then may be granted leave outside the Immigration Rules on the Art 8 ECHT grounds.

Приветствую, Письмо действительно дают общее и так не уточняется, что это ILR. Шангенские визы нужны, т.к. UK не в Шенгенской зоне. Если муж UK - можете подаваться на гражданство сразу, при условии выполения стандартных правил натурализации.

Приятный и ожидаемый сюрприз от курьера DX на вызодных, с кем мы договорились, что если он делате доставку в выходные (или когда я в UK BA) и в офисе никого нет несколько часов, он оставляет карточку клиента в специальном почтовом ящике, чтобы потом ему не приходилось еще раз приездать к нам в повторной доставкой. Очередная форумчанка получила Permanent Residence. Дело было интересно тем, что клиентке пришлось 2 раза сдавать отпечатки пальцев из-за того, что ее местное почтовое отделение, принимающее биометрику, по какой-то причине не передавала биометрические данные в UK BA. С нами даже связывался специальный отдел UK BA и просил помочь в расследовании (по-видимому, эта проблема коснулась и других). В связи с этой ситуацией клиентка получила свой Certificate of Application (CoA) только через 4 месяца, а решение о Permanent Residence и, соответственно, Permanent Residence BRP - через пару недель после получения Certificate of Application (CoA). Вот так бывает.

Да, меняют, регулярно. Но для того, чтобы потом получить паспорт UK, нужно изменить имия и в национальном паспорте. До середины 2015 года это не нужно было делать. Теперь - нужно.

The case of C-240/17 E 16 January 2018 This is a very interesting, if rather complex case. Three things are worth noting from it. First, as the Court has done in the case of the Dublin III Regulation, it has found that administrative provisions of regulations which govern what states are supposed to do with people produce legal effects on which the affected people may rely. The individual can rely on EU law even where it is written in terms of inter-state procedures. The requirement is the same as that for direct effect – the provision must be clear, precise and unconditional. Secondly, the Court gives priority to the residence permit which has not been withdrawn over the expulsion decision and re-entry ban. So long as a Member State does nothing to withdrawn a residence permit, another Member State cannot expel outside the Union the third country national (but possibly can oblige him or her to go to the Member State which issued the residence permit). It does not matter that the Member State which issued the residence permit has failed to comply with the rules. Thirdly, the complex intersection of CISA, an agreement among Member States originally outside the scope of EU law and only integrated in an incomplete manner by the Amsterdam Treaty in 1999, and EU law proper – the regulations and directives – moves in the direction that the EU adopted measures are gradually replacing the provisions of CISA. There is no ‘backward’ movement whereby Member States can ‘recover’ flexibility under CISA which has been ruled out by subsequent EU law provisions.

На прошлой неделе работал в двух разных отделениях UK BA: - 41 Station Road, Solihull. Я называю его "хорошим" отделеним UK BA, где я уже лет 15 получаю визы своим клиентам в личном визите за 2-3 часа : - 41 Homer Road, Solihull. Здесь иммигранты ходят отмечаться или приходят на те или иные интревью, когда возникают проблемы: Находятся эти два отделения UK BA через метров 200-300, на параллельных улицах пригорода Solihull г. Бирмингем. Даже номера улиц совпадают, но одно отделение UK BA дает визы/ПМЖ, а другое - старается выслать на родину. Вот такие "совпадения".

Guidance довольно точен (UK/EU cit.) : " biometric data page of the passport containing the photograph and personal details of the employee" - этого обычно достаточно и мы подаем этот документ по заявлениям клиентов по категории T1E. Опять же, я не знаю все Вашей ситуации.

Да. Или как сбережения (6+ месяцев), или доход из которого видно, что остается достаточно средств, чтобы Вы могли позволить себе потрать £2000.

Добрый день, Итак : Добрый вечер, подскажите пожалуйста, муж румын, работает 2.5 года, я приехала с дочкой ,вместе с ним, без визы из украины - Это не очень хорошо, но решаемо Хочу подать на резидент кард. - OK Была раньше в англии нелегально до 2007года - Бывает. и есть нюанс за который мне до сих пор стыдно говорить, с подружкой украли духи в магазине, нас поймали, были в полиции, потом отпустили, заплатила штраф. Это было больше 12-14 лет назад,точно , не помню. Дайте совет, указывать это, или уже срок давности прошел. Буду благодарна за любую информацию - Указывать нужно. Какие наши шансы - Я подал несколько сотен таких заявлений киентов за последние пару десятков лет. Шансы хорощие, если все правильно сделать. Ребенок уже здесь ходит в школу почти 4 месяца - Ок. "Консула" ничего не интересует, т.к. консульство работате с гражданами британии, а не с иммигрантами. Вы имели в виду, Визового Офицера, скорее всего ? Для гостевой визы, например, если это контекст Вашего вопроса, нужно показать, что у стороны, которая показывает выписку из банка, на которую Вы ссылаетесь (если я Вас правильно понял), есть регулярное поступление денег и что после расходов денег хватает. Из этого и исходите.
