  1. Очень интересная подача заявлений клиентов в нашем местном PEO сегодня - подавали на продление, получили ПМЖ за 40 минут : http://forum.chemodan.ua/index.php?s=&...t&p=1178293

Из заявлений форумчан на этой неделе, одобренных в личном визите со мной в нашем местном PEO Birmingham : Один из талончиков из PEO уникален - подавали на продление по категории PBS Dependent (очень нестандартная ситуация), но я также подготовил заявление на ILR. Перед подачей я поговорил с нашим case-worker и попросил его рассмотреть заявление на ILR, а не на продление. Отправил клиентов пить кофе. Через 40 (!) минут на мой мобильный номер позвонил наш case-worker и сказал, что клиенту дали ILR и уточнил, когда я приду за документами. Делюсь опытом и, да что тут скрывать - радостью, т.к. съкономил клиенту время и несколько тысяч фунтов (по "стандартным" правилам выходило + 1 проделние в будущем еще).

  7. Привет, Игорь, Согласен с тобой. У нас получается быстрее обычно, т.к. у нас есть британская лицензия на предоставление иммиграционных услуг в Великобритании и за рубежем (заявления на въезд в Великобританию) высшей категории, т.е. мы номер свой пишем в сопроводительных письмах и т.к, да и логотип соответствующий у нас везде стоит. Хотя один раз заявление клиента рассматривали дольше, чем у тебя, дней на 5, т.к. были праздники. Главное - положительный рузультат, если одной фразой. Спасибо за своевременную реакцию (см. ниже). Целый день был в UK BA с клиентами, продлял рабочую визу семье с Украины <noindex>в личном визите за 1 день в нашем местном отделении UK BA</noindex>.
  8. Кому интересны сроки - последние несколько заявлений клиентов на натурализацию, поданных в начале января 2018 года, UK BA рассмотрел за 5 недель.
  9. Привет, Игорь, Я исхожу из практики на территории UK и из тех заявлений, которые подаются за рубежем, в частности - в Украине. Тем более у меня есть очень высокий уровень и профессиональная регистрация в британском MCIL для заверения переводов клиентов. За пределами UK надежнее всего делать переводы в агенствах - тогда обычно не нужно заверение нотариуса. Лучший вариант - у провессионала человека в Великобритании, у которого есть регистрация в MCIL :-)

  13. Из сегоднешней почты. Подавали в лично визите с клиентом на ILR на основании Tier 2 (General). До этого клиент подавал сам и получил отказ. В UK BA PEO (личный визит) небрежно отнеслись к заявлению клиента и перепутали т.н. Codes of Practice. Как пример, из врача сделали инженера. Заявление было не простое, т.к. клиент шел по т.н. переходному периоду, и ему не нужно было зарабатывать мин. £35 000 в год. Я подал на Административный Пересмотр, и ровно через 28 дней я получил уведомление из UK BA о том, что отказ отменили и что клиенту дали ILR. Вот как выглядит такое решение : Так же помогал одной форумчанке с ее заявление по гражданству. Заявление моей киентки как всегда рассмотрели быстро за несколько недель и я получил положительно решение но, увы, в самом сертификате была допущена ошибка в имени. Я помог клиентке и подал запрос на изменение имени в Сертификате о Натурализации. Через 7 недель я получл новый Сертификат о Натурализации с правильным именем.   15. Решение суда высшей инстанции - совету UK BA доверять нельзя ! Я публиковал это новость раньше, тем не менее, регулярно встречаю "наступающих на грабли" раз за разом". За последнюю неделю проверл около десятка консультаций по поводу отказов, полученных заявителями, кто доверил свою судьбу совету UK BA. Я много, много раз повторял, что совету UK BA доверять нельзя, т.к. те, кто отвечают на звонки иммигрантов зачастую дают неправильную информацию. В это трудно поверить обывателю, но я регулярно сталкиваюсь с завителями, кто вместо того, чтобу детально разобраться самому или, еще лучше, получить квалифицированный совет адвоката, ищет легкие пути. Другими словами - бесплатный сыр может быть только в мышеловке (с). Для тех, кто сомневается, до сих пор - см решение суда высшей инстранции, подтвердивший, что совету UK BA доверять нельзя. This meant that the application could not succeed under the Immigration Rules. The problem is not uncommon: civil servants at the Home Office have invented a number of requirements with which some banks are simply unwilling to comply. The applicants telephoned the Home Office several times to ask what to do. The calls must have been recorded as transcripts were presented to the tribunal. Conflicting advice had been given by different operators on different occasions. Anyone with experience of calling the Home Office helpline will be familiar with this problem. On the facts of the case the tribunal held that no legitimate expectation was created: the promise was either non existent or was ambiguous and the applicants had not disclosed earlier advice to the telephone operator who gave the “promise”. Upper Tribunal Judge Southern seems to go on, unnecessarily in the circumstances, to hold that legitimate expectation cannot override the requirements of the Immigration Rules. He finds that the telephone operator concerned, Wayne, did not have the authority to give any promise and continues: “Finally, there is a strong public interest in the outcome of such applications being decided in a consistent and predictable way, in line with the clear statement of policy as set out in the Immigration Rule applicable.” The suggestion that legitimate expectation basically does not exist in immigration cases is a controversial finding and should not necessarily be considered a bar in other cases. The facts of this case were very difficult for the applicants and legitimate expectation has been accepted in other cases.

After the release of the government’s technical note in November 2017, and the joint report from the EU and UK negotiating teams the following month, it now seems that “residence” means residence in accordance with the conditions in Directive 2004/38/EC.   19. На прошлой неделе подавал 2 заявления форумчанок на ILR в личном визите - жены британцев. Анкеты SETM, £2297 + £590, подтверждаю. Одной заявительнице хотели отказать - caseworker не понимал особенности director of a specified company. Если бы не мое вмешательство (или заявление было бы подано по почте) - был бы отказ. Все получили ILR за 2.5 и 4 часа соответственно. Я на связи, подаю такие завлениея несколько раз в месяц. Есть вопросы - задавайте.
  20. Приветствую. Сроки потихоньку (!) сокращаются, и то не всегда ! Нормальный Priority - это до 15 дней ! 40 дней - это не нормальный Priority...
