  1. 28 March 2024 Important UK Immigration News and Updates from the Legal Centre www.legalcentre.org +44 77 911 45 923 (WhatsApp, Viber, Telegram, Skype) >>> Irish High Court finds decision to list the UK as a safe country for asylum seekers unlawful: See A & anor v The Minister for Justice, Ireland and the Attorney General & anor [2024] IEHC 164 Namely, the Irish High Court has held that the decision to put the UK on the list of safe third countries to return people seeking asylum to has been held unlawful. UK is no longer a safe country for the asylum seekers, it seems. This case is a useful reminder that what the UK is doing in relation to asylum policy does have an impact on its relationship with other countries. Presumably if EU countries are unable to return people seeking asylum to the UK, they will be reluctant to accept any the UK wishes to return.

  4. 26 March 2024 Important UK Immigration News and Updates from the Legal Centre www.legalcentre.org +44 77 911 45 923 (WhatsApp, Viber, Telegram, Skype) >>> Withdrawal Agreement cannot help woman who made wrong type of family permit application says Court of Appeal: Siddiqa v Entry Clearance Officer [2024] EWCA Civ 248 (14 March 2024) (bailii.org) The Court of Appeal has upheld the Upper Tribunal’s decision that those who applied for the wrong type of family permit before the end of the Brexit transition period cannot benefit from the EU Settlement Scheme or the EU Withdrawal Agreement. The decision is Siddiqa v Entry Clearance Officer [2024] EWCA Civ 248. The leading judgment is provided by Lord Justice Dingemans.

  11. Мало данных. Какой точно статус у каждого из заявителей ? Например, женщина из EU с EU Settled Status (ILR), а мужчина - с Украины по программе Homes for Ukraine.

  13. 21 March 2024 Important UK Immigration News and Updates from the Legal Centre www.legalcentre.org +44 77 911 45 923 (WhatsApp, Viber, Telegram, Skype) >>> The new vs the old financial requirement under the Appendix FM (aka UK Spouse Visa) Note that if you applied for (and were approved) before the 11th April 2024, then in the future you may rely upon the Rules in place before the 11th April 2024. That is, for extension etc you may be able to show the “old” financial threshold, and not the new one. >>> How much income and savings do I need from the 11th April 2024 and from April 2025 ? The Home Office is increasing the so-called financial threshold for the UK spouse visa from the 11th April 2024 and from April (assumed) 2025. From the 11th April 2024 the salary threshold will be £29 000 while the savings threshold will ne 29 000 x 2.5 + 16 000 = £88 500. From (April) 2025 the salary threshold will be £38 700 while the savings threshold will be 38 700 x 2.5 + 16 000 = £112 750. Note that there is NO additional financial requirement for dependents under the new Rules in place from the 11th April 2024.
  14. Home Office начал массово выдавать отказы по т.н. заявлениям на основании Private Life гражданам Украины кто находился в Великобритании нелегально. Сценарий прост. Заявитель когда-то приехал в Великобританию и просрочил визу ИЛИ приехал в Великобританию с поддельным письмом-одобрением по той или иной Украинской схемы, путешествуя через Республику Ирландию. Затем заявитель мог попытаться подать заявление по Украинской схеме и получил отказ. Затем заявитель мог попытаться подать заявление на основании т.н. Частной жизни. До 2024 года такие заявления обычно одобрялись Home Office. Но с 2024 году это изменилось. Теперь Home Office рутинно звонит таким заявителям, приглашая их подать иск на убежище. Если заявитель отказался / упустил возможность принять предложение Home Office о заявлении на убежище, Home Office, вероятно, откажет в заявлении на основании т.н. Частной жизни. В таком случае может быть права апелляции. Вот цитата из стандартного письмо из Home Office с отказом. Еще раз предупреждаю о текущей тенденции.
  15. 20 March 2024 Important UK Immigration News and Updates from the Legal Centre www.legalcentre.org +44 77 911 45 923 (WhatsApp, Viber, Telegram, Skype) >>> Home Office Policy Lead, David Ramsbotham, on the future of the Ukrainian Schemes This has been picked up by me during today’s online conference where David was one of the panellists. Someone asked if there would be a similar scheme for the people from Gaza like the Ukrainian Schemes ? David said the following: “The Ukrainian Scheme is a temporary scheme created with the help of the Ukrainian government who REASSURED us that they would accept Ukrainians back upon the end of the Schemes…therefore these Schemes were introduced”. As the Ukrainian Schemes currently will only allow the applicants to remain in the UK for up to 4.5 years (original grant of 3 years and the 1.5 year extension = 4.5 years), that is, just 6 months short from the “standard” route length for Settlement (Skilled Worker, Family Migration (Appendix FM aka UK Spouse visa etc), the above statement is very worrying, to say at least, as it sends a clear message, at least for now, that the UK Government may not offer the Ukrainians on the Ukrainian Schemes the option to settle in the UK at all. With that in mind, the Ukrainians residing in the UK under the Ukrainian Schemes, may need to start thinking about possibly switching into other immigration categories in order to remain in the UK beyond the end of their Ukrainian Scheme visas.
  16. 20 March 2024 Important UK Immigration News and Updates from the Legal Centre www.legalcentre.org +44 77 911 45 923 (WhatsApp, Viber, Telegram, Skype) >>> Roehrig upheld by Court of Appeal: no changes for certain children of EU citizens not entitled to British citizenship: Roehrig, R (On the Application Of) v Secretary of State for the Home Department (Rev1) [2024] EWCA Civ 240 (12 March 2024) (bailii.org) In the context of British nationality law, EEA citizens residing in the UK from 2 October 2000 continue to not meet the definition of “settled”, unless they held indefinite leave to remain or had acquired permanent residence. This was confirmed last week by the Court of Appeal in R (on the application of Roehrig) v Secretary of State for the Home Department (Rev1) [2024] EWCA Civ 240.

  19. 18 March 2024 Important UK Immigration News and Updates from the Legal Centre www.legalcentre.org +44 77 911 45 923 (WhatsApp, Viber, Telegram, Skype) >>> Sponsors no longer need to report changes to hybrid and remote working: Workers and Temporary Workers: guidance for sponsors part 3: sponsor duties and compliance (accessible) - GOV.UK (www.gov.uk) The updated Sponsor Guidance explains UKVI’s reasoning: “We recognise that many organisations have adopted a “hybrid working” model, where their workers work remotely (from either their home or another remote site, such as a work hub space) on a regular basis, as well as regularly attending a ‘traditional’ work location (such as one or more of your offices or branches, or a client site)…” Some reports are still needed UKVI has confirmed that sponsors “no longer need to tell us if a sponsored worker is moving to a hybrid working pattern but you must continue to report any changes to their main office work location, or of any new client sites, if applicable, and maintain suitable records of your sponsored workers’ working patterns”. In such cases, it is important that employers are aware that UKVI can ask for an explanation as to why the sponsored worker needs to live in the UK at all. Compliance UKVI’s officers carry out on-site in person audits as well as remote ones to check compliance. It is therefore important that sponsors retain records, including relating to sponsored worker’s work patterns, to demonstrate that they understand and comply with the Sponsor Guidance.

  21. 16 March 2024 Important UK Immigration News and Updates from the Legal Centre www.legalcentre.org +44 77 911 45 923 (WhatsApp, Viber, Telegram, Skype) >>> Statement of changes HC 590: salary thresholds increased, shortage occupation list removed The changes relate to the skilled worker, Appendix FM partner, EU settlement scheme, the new immigration salary list and administrative review for EU settlement scheme applications. Skilled worker salary threshold References to the Shortage Occupation List are being replaced with Appendix Immigration Salary List which will be introduced into the rules on 4 April 2024. Applications that have been made using a certificate of sponsorship issued by the sponsor to an applicant before 4 April 2024 will be decided under the rules in force on 3 April 2024. Employers must from 4 April 2024 pay those entering the skilled worker route a general salary threshold of £38,700 or the going rate for the role (also being raised, from the 25th percentile to the median), whichever is higher. Increase to minimum income requirement for partners Applications made in the five year route to settlement as a partner under Appendix FM of the rules will need to meet a minimum income requirement of £29,000 for applications made on or after 11 April 2024. ****** There will be no additional income requirement for children ****** Appendix EUSS On 4 April 2024 Appendix Administrative Review (EU) will be amended to remove the ability to make an out of time application for administrative review of an eligible EUSS decision made before 5 October 2023. The explanatory memorandum says that people will have had more than five months to apply out-of-time for administrative review and the First-tier Tribunal will still have discretion to admit late appeals, where it is an appealable decision. Permission to work for people seeking asylum Changes have been made to paragraphs 360A and 360D of the immigration rules on permission to work for people waiting for asylum decisions. This changes references to the shortage occupation list to the new Appendix Immigration Salary List, meaning they will be able to work in far fewer roles than was previously the case. Appendix Victim of Domestic Abuse Appendix Victim of Domestic Abuse is being amended to include all partners with pre-settled status under the EU settlement scheme. Exceptional assurance (Covid-19 concession) Exceptional assurance has made it into the immigration rules. On 4 April 2024 paragraph 39E on exceptions for overstaying is being amended to include a period of overstaying between 1 September 2020 and 28 February 2023 where the person has been given a written notice by the Home Office saying they would not be considered an overstayer during this period. Change to definition of a parent A more restrictive definition of parent is being introduced than is currently in the rules. The new definition at INTRO7 of the statement of changes includes biological parent, legal parent and adoptive parent. Step-parents have been removed, the explanatory memorandum says this is because being a step-parent “does not automatically mean the person has parental responsibility for a child”. The explanatory memorandum says that there are other immigration routes that will allow a child to enter or stay in the UK where the step-parent has parental responsibility. This comes into force on 6 June 2024 with transitional provisions for applications made before then. Appendix Long Residence A new Appendix Long Residence is being introduced, replacing the existing rules. In order to qualify for settlement, people must have held leave in their route for one year or have been exempt from immigration control within the 12 months immediately before their application. Hong Kong BN(O) route The concession allowing people with an asylum claim who are on immigration bail to apply to the scheme will be put into the rules on 4 April 2024. Other changes coming in include allowing grants of extensions of leave to be made with recourse to public funds where the person has previously been permitted this and continues to be eligible. Up to 28 days of additional leave can be added to a person’s grant of further leave to assist them in reaching the five year period after which they are eligible for settlement. Adult dependent relatives will be able to apply after the main applicant is in the UK, where their circumstances have changed. Other changes Also included in this statement of changes is the introduction of a new Appendix Adoption, the application of Appendix English language to additional routes, an update to Appendix Visitor: Permit Free Festival List, changes to Appendix Electronic Travel Authorisation, Appendix Armed Forces, and other minor changes.

Дети будут обучаться в частной британской школе а их отец будет жить и заботиться о них в Великобритании. Это было очень сложное заявление т.к. Home Office запросил детальные дополнительные документы. Тем не менее, заявления было ободрены всего за 3 недели. Делюсь статистикой ежедневных одобрений заявлений клиентов.
