В Европе на четверть сократилось число ходатайств об убежище Число новых ходатайств о предоставлении убежища в ЕС, Норвегии и Швейцарии за девять месяцев 2026 года сократилось на 24%. Германия впервые за многие годы уступила лидерство Франции и Италии. Число ходатайств о предоставлении убежища в Европе за первые девять месяцев 2026 года снизилось на четверть. Об этом в воскресенье, 4 октября, сообщает Welt am Sonntag со ссылкой на имеющиеся у него данные базирующегося на Мальте Агентства ЕС по вопросам убежища (EUAA). В странах ЕС, а также в Норвегии и Швейцарии с января по сентябрь было зарегистрировано 452 969 новых ходатайств о защите - это на 24,3% меньше в сравнении с аналогичным периодом прошлого года. Лидеры по числу заявок - Франция, Италия и Германия Больше всего прошений было подано во Франции (98 822) и Италии (78 496). Германия, которая до конца 2024 года неизменно оставалась главной страной назначения для просителей убежища в Европе, в этом году занимает лишь третье место по числу ходатайств: с января в ней было подано 70 257 заявлений. Во всем ЕС, Норвегии и Швейцарии за защитой чаще всего обращались граждане Афганистана (52 361), Венесуэлы (37 294) и Бангладеш (26 497). Кроме того, ходатайства подали 6420 граждан России. Причины сокращения числа заявок об убежище Среди причин значительного сокращения числа ходатайств об убежище называются заключенные соглашения о партнерстве со странами Северной Африки. Ливия, Египет и другие страны в рамках этих соглашений получают кредиты и инвестиции ЕС для улучшения национальных систем здравоохранения и образования, а также для укрепления органов безопасности и пограничной охраны. Целью является укрепление их экономики и снижение уровня миграции. Кроме того, на сокращение числа ходатайств о предоставлении убежища могла повлиять новая система предоставления убежища в Евросоюзе, предполагающая ускоренные процедуры рассмотрения заявок на внешних границах ЕС и более жесткие меры в отношении нарушений правил со стороны соискателей убежища. Про запуск програми громадянства за інвестиції 2 жовтня оголосив міністр економіки Аргентини Луїс Капуто під час заходу для інвесторів у Парижі. Приймати заявки планують у четвертому кварталі 2026 року. Для заявників передбачили два варіанти. Перший — безповоротний внесок у державну скарбницю в розмірі 350 тисяч доларів. Другий — придбання спеціальних державних облігацій на 800 тисяч доларів. За даними AP, такі облігації необхідно буде утримувати протягом семи років. Japan's Sanae Takaichi announces new tightened measures for foreigners seeking permanent residency The measures come as the country’s conservative leader Sanae Takaichi looks to deliver on election promises, which were spearheaded by vast immigration reforms, in her historic supermajority election victory in February. Japan toughened requirements for foreigners wanting to obtain permanent residency on Thursday, as part of Prime Minister Sanae Takaichi's push to tighten immigration controls. Under new rules that will come into effect in stages, foreign residents wishing to stay in Japan permanently will have to prove their annual income is above average and they can carry casual conversations in Japanese. Application fees will also rise 20-fold from Thursday. At one immigration office in central Tokyo, hundreds of people queued, hoping to wrap up procedures before the price spike. "I understand that over-accepting foreigners might dilute Japan's unique culture. But at the same time, given its low birth rate and aging population, Japan has to accept foreigners," said US-born university student Yujie Chono, who was among those waiting. The 22-year-old told the AFP news agency, in fluent Japanese, that he had been waiting for five hours to file his paperwork. Previous guidelines did not lay out specific thresholds for income, pension or language skills. Even though Japan has a rapidly ageing population and is suffering labour shortages in many sectors, opposition to immigration is growing, prompting a push by Takaichi for tighter regulations on foreign nationals. "As the number of foreign residents in Japan increases, the government is facing the fact that some citizens feel anxiety and a sense of unfairness," Takaichi said in an extended post on X on Sunday, adding that she was pushing for "orderly coexistence" with foreign nationals. Programmes to attract international workers have fuelled public worry, anti-immigration sentiment has spread across social media and false claims have circulated widely, including that a significant portion of welfare payments in Japan goes to foreigners, and that they are making Japanese streets less safe. Experts and many business leaders warn however that Japan must welcome more foreign workers to sustain itself. "Japan should stop viewing foreigners merely as a temporary labour force and instead promote their long-term settlement by expanding Japanese-language education and improving their treatment," the Nikkei business daily said in a recent editorial. Foreigners were a major issue in last year's upper house election which saw the sharp rise of the "Japanese-first" Sanseito party, which describes immigration as a "silent invasion". The new rules for permanent residency come after the ruling Liberal Democratic Party last year pushed to tighten regulations for business manager visas, meaning entrepreneurs will be forced to leave Japan if they don't meet the new conditions. Thursday's changes may prevent some people from applying for permanent residency but should not immediately push anyone out of the country. Under the regulations, the application fee for permanent residency will soar to 200,000 yen (€1,116) from the current 10,000 yen (€56). UK ends 'one in, one out' migrant returns deal with France Only about 4% of small-boat arrivals were sent back under the year-long pilot, which cost an average of €65,500 per return, as Paris pushes for an EU-wide replacement. The UK's Home Office said on Wednesday that its year-old deal with France to return migrants crossing the Channel on small boats had ended. "The government's pilot with France to remove asylum seekers in exchange for an equal number of legal migrants is no longer processing new cases," the Home Office said, confirming the end of the so-called "one in, one out" deal, which was launched in August last year and was due to expire on Thursday. The scheme, known as Operation Hillmore, was part of efforts by London and Paris to tackle illegal migration across the English Channel. Under the arrangement, Britain could return to France some migrants who arrived illegally by small boat and were judged to have no right to remain in the UK. In exchange, Britain accepted an equal number of asylum seekers from France considered likely to qualify for protection, with priority given to vulnerable nationalities and people with family or other links to the UK. The two countries agreed in June to extend the pilot until 1 October. The most recent Home Office figures show that 1,087 people were returned to France between 4 August 2025 and 30 June 2026, while 1,117 were transferred to the UK under the scheme. Over the same period, 27,920 migrants arrived in the UK on small boats, meaning only about 4% of arrivals were sent back. That was one of the clearest signs of the programme's limited impact, despite government claims that it would deter people-smuggling gangs. Home Secretary Shabana Mahmood told MPs on 15 September that it cost the UK taxpayer an average of about £56,000 (€65,500) per migrant to return them. Prime Minister Andy Burnham, who succeeded Keir Starmer in July, said that Brexit had made stopping small boats harder because the UK no longer had the same level of cooperation with the EU. He declined to set a date for ending the crossings, but told the BBC he and Mahmood would not stop until they had cracked down on "every element of this criminal, illegal activity". Burnham has said his government is "changing the whole approach" to small boats, pairing tougher enforcement with safe legal routes for asylum seekers, which he argues would take away the smuggling gangs' main selling point. France's interior minister Laurent Nuñez told lawmakers in June that France wanted a more European approach to illegal migration. He also argued that France should not have to bear sole responsibility for policing an EU external border, blaming weak controls in countries of first entry and onward movement within the Schengen area. Migrants trying to reach Britain pay smugglers thousands of euros for places on overcrowded inflatable boats to cross one of the world's busiest shipping lanes. Which countries rank best for expat tax, and why is Germany last? Two European countries made the top 10 in a new global ranking of tax systems for people moving abroad, while Germany came last. But the report also shows why low taxes alone do not always make a country an attractive place to live. A new ranking by Global Citizen Solutions (GCS) compares 48 jurisdictions on these factors. Malta and Cyprus lead in Europe, though neither has the lowest headline income tax rate. The report uses 11 indicators grouped into three categories: tax burden, tax structure and investment migration, which covers routes to residence or citizenship. Together, these produce an overall score. A higher score means more favourable conditions for internationally mobile people. Tax optimisation means legally arranging one’s finances to reduce the amount of tax owed. Malta and Cyprus in the top 10 The two European countries that made the top 10 globally, Malta and Cyprus, scored highly because they offer favourable tax treatment to some people moving there, particularly on income earned abroad, rather than simply charging low tax rates. Malta and Cyprus both scored 82 out of 100 for tax burden and 63 for tax structure. Malta scored 83 for investment migration, slightly ahead of Cyprus on 78. Those scores put Malta sixth overall and Cyprus 10th. GCS says both achieved their positions “through preferential regimes rather than low headline rates”. Monaco (68.6), Georgia (68.3) and Bulgaria (62.8) complete the top five in Europe. After these top-scoring jurisdictions, all European scores fall below 60, with global rankings outside the top 20. Germany ranks lowest globally Germany came in last among all 48 jurisdictions. The country scored just 17 out of 100 for tax structure, the measure covering the treatment of foreign income and people leaving the country. The report points to Germany's taxation of residents’ worldwide income, inheritance tax and an exit tax as factors behind its low ranking. Denmark (30.4), Spain (36.9), France (37.7) and Norway (38.4) are also near the bottom of the European ranking. The next-lowest European score is the United Kingdom’s 50.9, with higher scores indicating more favourable tax conditions for people moving abroad. Among Europe’s five largest economies, Italy scores highest at 56.9. It ranks ninth in Europe, counting EU candidates Turkey and Georgia, and 26th globally. Scores for several other European jurisdictions are close, ranging from 58.2 in Switzerland to 51.2 in the Netherlands. Turkey (56.9), Hungary (54.9), Sweden (54.1) and Ireland (53.1) fall within this range. Monaco, Bulgaria and Andorra rank best for tax burden The picture changes when the three parts of the ranking are considered separately. The tax burden score covers personal income tax, capital gains tax on listed securities, net wealth tax and inheritance tax. Monaco (93), Bulgaria (92) and Andorra (89) have the highest scores for tax burden. Malta (82) and Cyprus (82) follow them. Spain (25), France (26) and Denmark (30) have the lowest European scores on this measure. Germany, despite ranking last overall, scores 40. How countries tax foreign income Tax structure looks at how a country taxes income earned abroad and people who leave. Malta and Cyprus share the highest European score, at 63. Germany has the lowest score at 17, followed by Hungary (25), Andorra (26), Estonia (27) and Bulgaria (29). Turkey also scores 29, but is classified separately in the report. A country can therefore score well on one measure and poorly overall. As GCS puts it: “The central finding is that a jurisdiction's tax rate and the structure of its tax system are largely independent of one another.” Tax burden and tax structure together account for 85% of the index, with each weighted equally. How does Europe compare with the rest of the world? The United Arab Emirates (UAE) ranks first overall, with a score of 82.7. It has no personal income tax a 5% consumption tax and no exit tax. Antigua and Barbuda (82.2) comes second, followed by Paraguay (77.2), Hong Kong (76.9) and the Bahamas (76.2). At the other end of the ranking, the United States scores 33.5 and places 46th. Only Denmark and Germany score lower. Japan ranks 45th, with 36.4. Does a favourable tax score mean a better place to live? The report also compares its findings with quality-of-life rankings from the Global Passport Index 2026. Countries that score well for quality of life often fare less well on tax. Sweden ranks second globally for quality of life but 32nd for tax optimisation. Germany ranks third and 48th respectively, Denmark fourth and 47th, and Norway fifth and 40th. But the report identifies seven exceptions that rank in the upper half for tax optimisation and the top 50 for quality of life: Malta, Cyprus, Portugal, Switzerland, Uruguay, Costa Rica and Mauritius. Portugal ranks 23rd for tax and 11th for quality of life, while Malta ranks sixth and 28th respectively. None of the seven has a zero income tax rate. Instead, the report says they offer favourable treatment of foreign income through exemptions, special tax regimes or rules that tax it only when it is brought into the country. That allows them to attract people moving abroad while still raising tax revenue to fund public services. Набуття статусу біженця для громадян держав, де є реальна загроза життю та здоров'ю з боку державних органів влади та управління За останні роки всі громадяни низки держав (росії, білорусі, Туркменістану, Таджикистану, Азербайджану, Казахстану, Киргизстану, Узбекистану), де органи влади та управління відкрито переслідують за політичні погляди, розглядають можливість переїзду в іншу країну не лише заради роботи, освіти чи комфортнішого життя. Для частини людей питання стоїть інакше: наскільки безпечно їм залишатися на батьківщині чи повертатися туди? Кримінальне чи адміністративне переслідування, політична та громадська діяльність, публічна позиція, робота у ЗМІ, правозахисна діяльність, конфлікт із державними структурами, релігійні переконання, певні обставини, пов'язані з військовою службою, – все це може змусити людину задуматися про міжнародний захист. Але тут важливо одразу сказати головне: притулок - це не звичайна імміграційна програма і не універсальний спосіб швидко отримати посвідку на проживання або другий паспорт. Це механізм міжнародного захисту для людей, які мають реальні підстави побоюватися переслідування у державі своєї громадянської власності. Хто може претендувати на міжнародний захист? Основою сучасної системи захисту залишається Женевська конвенція про статус біженців 1951 року та Протокол 1967 року. У загальному вигляді мова йдеться про людину, яка знаходиться за межами країни своєї громадянської приналежності та має обґрунтовані побоювання переслідування через расу, релігію, національність, належність до певної соціальної групи чи політичні переконання. Тому одного бажання залишити батьківщину – явно замало. Недостатньо і загальної незгоди з тим, що відбувається в країні. Необхідно встановити, чи існує індивідуальний ризик саме для конкретної людини, наскільки цей ризик є серйозним, з чим він пов'язаний і чи можна його підтвердити. Сучасна ситуація у цих державах робить таку оцінку особливо актуальною. Наприклад, у грудні 2025 року Агентство Європейського союзу з питань притулку (European Union Agency for Asylum, EE.UU.) опублікувало оновлену доповідь на прикладі держави-терориста росії «Російська Федерація: в фокусі уваги» (The Russian Federation: Country Focus). Де детально розглядаються обмеження політичної діяльності та свободи вираження поглядів, переслідування опозиційних активістів, журналістів, правозахисників та інших груп, а також питання, пов'язані з військовою службою. Це, однак, означає автоматичного права громадянина цих країн на притулок. Кожна справа розглядається індивідуально. Найважливіше питання – не «куди виїхати?» Саме з цього зазвичай починається розмова: «У яку країну краще їхати?» Де простіше отримати статус біженця? «Чи можна поїхати до США, Канади чи Європи?» Але професійна робота має починатися з іншого питання: що саме сталося з людиною і чому повернення в державу її громадянської приналежності може становити йому реальну небезпеку? Тільки після цього є сенс обговорювати можливі країни та процедуру. У різних державах відрізняються законодавство, процедура подання заяви, практика розгляду окремих категорій справ, правила роботи з доказами, терміни, можливості для членів сім'ї та наслідки відмови. Тому країна має підбиратися не лише за принципом «мені там подобається» чи «маю там знайомих». Потрібно оцінювати всю ситуацію у комплексі. Що ми аналізуємо до початку процедури? Перший етап нашої роботи – це заповнення анкети. Це аналіз справи. Нам необхідно зрозуміти: - що саме сталося із людиною; - хто є джерелом загрози чи переслідування; - чи були затримання, обшуки, виклики на допит, адміністративні чи кримінальні справи; - чи мали місце загрози людині чи членам її сім'ї; - чи пов'язані дії державних органів з політичними переконаннями, громадською діяльністю, релігією, належністю до певної групи чи іншими обставинами, які можуть мати значення для міжнародного захисту; - чи зверталася людина за захистом усередині країни та що з цього вийшло; - чи існують документи чи інші об'єктивні підтвердження того, що сталося; - що відбувалося безпосередньо перед виїздом; - що відбувалося вже після виїзду; - Наскільки послідовна і доказана вся історія загалом. Іноді після такого аналізу ми бачимо серйозні підстави для подальшої роботи. Але в більшості випадків справа потребує додаткової підготовки. Оскільки наявних фактів замало позитивного результату. Докази мають значення При розгляді заяви оцінюється не лише те, що людина розповідає, а й наскільки її розповідь узгоджується з документами, фактами та об'єктивною інформацією про країну походження. Доказами можуть бути залежно від конкретної ситуації: документи кримінального чи адміністративного провадження, повістки, публікації, листування, заяви та звернення, відомості про професійну чи громадську діяльність, та багато інших матеріалів. Але завдання підготовки полягає не в тому, щоб зібрати якнайбільше паперів. І це важливий момент. Необхідно зрозуміти, яка обставина підтверджує кожен документ і як усі докази складаються в єдину послідовну історію переслідування. У справах про притулок довіра до заявника має важливе значення. Окреме питання - кримінальне переслідування та екстрадиція Деякі наші клієнти звертаються після порушення кримінальної справи у себе з країні або появи інформації про розшук. Такі ситуації потребують особливо уважної оцінки. Сама собою кримінальна справа ще не означає наявність підстав для притулку. Держава, яка розглядає заяву, намагатиметься зрозуміти, чи йдеться про звичайне кримінальне переслідування за реально скоєний злочин чи кримінальне законодавство використовується як засіб переслідування людини з політичних або інших підстав, що захищаються. Тому документи кримінального провадження, зміст звинувачення, обставини виникнення справи, дії влади та загальна інформація про практику застосування відповідних норм можуть мати принципове значення. Крім того, процедури надання притулку та екстрадиції юридично пов'язані, але не є одним і тим самим процесом. Якщо існує ризик міжнародного розшуку або вже розпочато процедуру екстрадиції, стратегію необхідно вибудовувати з урахуванням обох процедур. І тут особливо небезпечно гаяти час. Чому другий паспорт не вирішує проблему автоматично? Іноді людина розраховує спочатку отримати громадянство чи посвідку на проживання іншої країни і вважає, що після цього питання безпеки вирішене. Це не завжди так. Наявність другого паспорта, посвідки на проживання чи іншого імміграційного статусу сама по собі не відповідає на головне питання: чи існує ризик переслідування і який захист людина має від повернення в державу, де вона боїться такого переслідування? Тому у складних випадках необхідно аналізувати не лише імміграційний статус, а й можливі процедури міжнародного захисту, екстрадиції та взаємодії правоохоронних органів різних держав. Завдання - допомогти людині зрозуміло, послідовно та документально обґрунтовано уявити те, що з нею справді сталося. Коли потрібно звертатися за консультацією Чим раніше – тим краще. До того, як ситуація стане критичною або ви вже знаходитесь в країні, де плануєте шукати захист. Якщо людина розуміє, що тиск посилюється, з'явилися ознаки переслідування чи інші обставини, які змушують серйозно побоюватися подальшого розвитку подій, є сенс заздалегідь оцінити можливі варіанти. Якщо міжнародний захист справді є обґрунтованим варіантом, попередня підготовка дозволяє уникнути багатьох помилок. З чого почати: Первинна консультація починається з докладного аналізу ситуації. Нам необхідно зрозуміти: 1. що сталося; 2. коли це сталося; 3. чому людина вважає, що перебуває у небезпеці; 4. які докази існують; 5. де людина зараз; 6. які країни він розглядає; 7. яка ситуація членів його сім'ї. Securing Refugee Status for Citizens from States with Genuine Threats to Life and Health by State Authorities and Administration In recent years, citizens from a number of states – including Russia, Belarus, Turkmenistan, Tajikistan, Azerbaijan, Kazakhstan, Kyrgyzstan, and Uzbekistan – where authorities and administrative bodies openly persecute individuals for their political views, are looking at moving abroad. For them, this is no longer merely a quest for employment, education, or a more comfortable lifestyle. For a significant number, the question is far more stark: just how safe is it for them to remain in their homeland or, indeed, to return there? Criminal or administrative prosecution, political and civic activism, publicly voiced dissent, journalism, human rights advocacy, conflicts with state entities, religious convictions, or specific circumstances related to military service – any of these can compel an individual to seek international protection. Yet, the core truth must be established from the very outset: Asylum is not a standard immigration scheme, nor is it a universal shortcut to a residence permit or a second passport. It is a mechanism of international protection designed solely for individuals who harbour a well-founded fear of persecution in the state of their nationality. Who can claim international protection? The bedrock of the modern protection system remains the 1951 Geneva Convention Relating to the Status of Refugees and its 1967 Protocol. Broadly speaking, it concerns an individual who is outside their country of nationality and possesses a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group, or political opinion. Consequently, a mere desire to leave one’s homeland is patently insufficient. A general disagreement with the political climate of a country does not suffice either. What must be established is whether an individualised risk exists for that specific person, how severe that risk is, what triggers it, and whether it can be substantiated. The current situation in these states makes such an assessment particularly pressing. For instance, in December 2025, the European Union Agency for Asylum (EUAA) published an updated report focusing on the terrorist state of Russia, entitled ‘The Russian Federation: Country Focus’. This document examines in meticulous detail the restrictions on political activity and freedom of expression, the clampdown on opposition activists, journalists, and human rights defenders, as well as matters concerning military service. This does not, however, imply an automatic right to asylum for citizens of these countries. Every single case is assessed on its individual merits. The question that matters is not ‘Where should I go?’ This is precisely where the conversation usually starts: ‘Which country is the best to go to?’ ‘Where is it easier to obtain refugee status?’ ‘Can I go to the UK, the US, Canada, or Europe?’ However, professional counsel must begin with an entirely different question: What exactly happened to the individual, and why would returning to their country of nationality pose a genuine danger to them? Only once this has been clarified does it make sense to discuss potential host nations and procedures. Legislation, application processes, the handling of specific case categories, rules of evidence, timeframes, family reunification opportunities, and the consequences of a refusal vary significantly across different states. Therefore, a country should not be chosen simply on the basis of ‘I like it there’ or ‘I have acquaintances there’. The entire scenario must be evaluated comprehensively. What we analyse before the procedure begins The first stage of our work involves completing a questionnaire. This constitutes a thorough case analysis. We need to ascertain: · What exactly happened to the individual; · Who the source of the threat or persecution is; · Whether there have been detentions, searches, summonses for interrogation, or administrative and criminal proceedings; · Whether threats have been directed at the individual or their family members; · Whether the actions of state bodies are linked to political opinions, civic activism, religion, membership of a particular group, or other circumstances relevant to international protection; · Whether the individual sought protection within their own country, and what the outcome was; · Whether there are documents or other objective pieces of evidence confirming what transpired; · What occurred immediately prior to departure; · What has happened since leaving the country; · How consistent and well-evidenced the narrative is as a whole. Occasionally, such an analysis reveals solid grounds for immediate action. In most instances, however, a case requires further preparation, as the available facts may not be substantial enough to guarantee a positive outcome. Evidence is what counts When an application is considered, authorities assess not only what the individual recounts, but also how closely their narrative aligns with documents, facts, and objective country-of-origin information. Depending on the specific situation, evidence may comprise: Documents from criminal or administrative proceedings, summonses, publications, correspondence, formal complaints and appeals, records of professional or civic activities, and a wealth of other materials. Crucially, the objective of this preparation is not to amass as much paperwork as possible. This is a vital distinction. One must understand precisely which circumstance each document proves, and how all the evidence fits together into a single, cohesive narrative of persecution. In asylum cases, the applicant's credibility is of fundamental importance. A distinct issue: criminal prosecution and extradition Some of our clients approach us after a criminal case has been launched against them in their home country, or upon discovering they are on a wanted list. Such scenarios demand exceptionally careful evaluation. A criminal case in itself does not automatically warrant asylum. The state reviewing the application will endeavour to determine whether this is a conventional prosecution for an actual crime, or whether criminal law is being weaponised to persecute the individual on political or other protected grounds. Consequently, criminal prosecution documents, the substance of the charges, the circumstances under which the case arose, the actions of the authorities, and general data on how the relevant legal norms are applied can be of critical significance. Asylum and extradition procedures are legally intertwined, yet they remain separate processes. If there is a risk of an international warrant or if extradition proceedings have already commenced, the strategy must be formulated with both procedures in mind. In these circumstances, losing time is particularly dangerous. Why a second passport does not automatically solve the problem At times, individuals expect to first acquire citizenship or a residence permit in another country, believing that their safety concerns are thereby resolved. This is not always the case. Holding a second passport, a residence permit, or any other immigration status does not, by itself, answer the pivotal question: does a risk of persecution still exist, and what protection does the individual have against being returned to the state where they fear such persecution? Therefore, in complex cases, one must analyse not only the immigration status but also the potential international protection frameworks, extradition risks, and the ways in which law enforcement agencies of different states interact. If international protection does indeed prove to be a well-founded path, early preparation helps avert a multitude of costly errors. Where to begin An initial consultation commences with an exhaustive analysis of the scenario. We need to ascertain: 1. What has transpired; 2. When it occurred; 3. Why the individual believes they are in jeopardy; 4. What evidence currently exists; 5. Where the individual is presently located; 6. Which countries they are considering; 7. What the circumstances of their family members are. Only upon clarifying these points can we discuss the prospects of the case, potential complications, and the subsequent course of action. Коли часу немає і рахунок іде на дні, єдиним легальним інструментом швидкого переїзду та захисту стає набуття статусу біженця. Вони дають законне право на захист в іншій країні, якщо на батьківщині (у державі громадянської належності) особі загрожують органи влади. Використовуючи владні повноваження, ці органи банально «віджимають» бізнес або змушують людину мовчати. Людині штучно «шиють» кримінальну справу, і ось вона вже під загрозою арешту. Впевнений, кожен, хто читає цю статтю, згадає не один десяток таких прикладів зі свого життя чи досвіду знайомих. Природно, що людина шукає «запасний аеродром». У хід ідуть інтернет-поради, знайомі та «авторитетні» юристи. Проте про реальну небезпеку багато хто згадує лише тоді, коли за кордоном їх затримують місцеві правоохоронці для подальшої екстрадиції. Важливо пам'ятати: Поняття екстрадиція, депортація, видворення та висилка — це абсолютно різні правові процедури з різними юридичними наслідками. Якщо у біженця відоме прізвище (на кшталт, Каспаров, Ходорковський чи Чичваркін), процес екстрадиції буде публічним та ускладненим. Але якщо ви звичайна людина, наявність лише одного паспорта чи навіть дозвілу на проживання/постійне місце проживання в іншій країні, не врятує вас від видачі у «теплі та липкі руки» силовиків із вашої батьківщини. Навіть наявність другого громадянства (іншого паспорта) в ряде випадків не гарантує безпеки. Міжнародний розшук часто використовують як інструмент жорсткого тиску. Під час затримання правоохоронці іноземної держави ідентифікуватимуть вас насамперед як громадянина тієї країни, яка оголосила вас у розшук. Другий паспорт чиновники можуть просто проігнорувати, а процедура перебування в депортаційному центрі в очікуванні суду, не додає оптимізму. Нова реальність: анулювання куплених паспортів у ЄС Слід враховувати, що після подій 2022 року імміграційні служби країн світу почали вкрай жорстко перевіряти підстави набуття громадянства. Цей процес лише прискорюється. Тому дорогоцінний час після вимушеного та термінового від'їзду потрібно використовувати з розумом, а не чекати на арешт. Що робити та як захиститися? У світі є багато країн, де можна попросити притулок. The lives of millions of people—including those residing far beyond the borders of Ukraine—have been starkly divided into three distinct eras: life before 2014, the period following the initial occupation, and the harsh reality after 24 February 2022. The Timeline of State Repression: From 2014 to 2022 For many foreign nationals, particularly residents of former Soviet republics and the CIS, the first warning signs appeared in March 2014. With the onset of hybrid aggression and the occupation of Ukrainian territories, their home states accelerated a systematic crackdown on civil liberties. When time is short and every day counts, the only legitimate instrument for rapid relocation and immediate protection is acquiring refugee status. This avenue is governed by the 1951 Geneva Convention and the 1967 Protocol. They grant a lawful right to protection in a foreign country if an individual faces genuine threats from the authorities in the state of their nationality. When these threats pose a real danger of lengthy imprisonment or physical violence against the individual or their family, there is simply no time to gather standard documentation—one must find an immediate escape route. Abuse of power is widespread; these entities routinely seize private businesses or force individuals into silence by fabricating criminal cases. Anyone reading this can likely recall dozens of such examples from their own experience or from acquaintances. Naturally, the individual searches for a ‘back-up plan’. They turn to internet forums, personal contacts, and seemingly influential lawyers. However, many only realise the true scale of the danger when they are detained by local law enforcement abroad for subsequent extradition. Crucial to Remember: The terms extradition, deportation, removal, and expulsion represent completely distinct legal procedures with vastly different judicial consequences. If the refugee bears a high-profile surname (such as Kasparov, Khodorkovsky, or Chichvarkin), the extradition process becomes highly publicised and legally complex. But if you are an ordinary citizen, holding a single passport or a standard temporary or permanent residence permit in a foreign country will not shield you from being handed straight over to the harsh custody of law enforcement from your homeland. Even holding dual citizenship (a second passport) offers no guarantee of safety in a number of cases. International arrest warrants are frequently weaponised as tools of severe pressure. Upon detention, foreign law enforcement agencies will identify you primarily as a citizen of the state that issued the warrant. Foreign officials may simply ignore your second passport, and spending months in a detention centre awaiting a court ruling is hardly a cause for optimism. The New Reality: Revocation of Purchased EU Passports It is vital to recognise that following the events of 2022, immigration authorities worldwide have drastically tightened their scrutiny over the grounds on which citizenship was acquired. Recent precedents demonstrate that even staying in leading EU nations offers no protection from arrest; organizers and participants of such fraudulent schemes are being successfully extradited from Germany without the right to bail. Once caught in this trap, claiming asylum under the Geneva Convention becomes virtually impossible. Furthermore, if the two nations share a bilateral legal assistance treaty, the extradition process is executed swiftly. Many believe they can mount a legal defence remotely from abroad. They overlook the fact that within their home jurisdiction, they remain fugitives from justice on international wanted lists. A remote defence is largely ineffective, as domestic investigative proceedings are simply frozen until the moment of arrest. Therefore, the precious time following a forced and urgent departure must be utilised wisely, rather than waiting around for an arrest. How to Proceed and Secure Protection There are numerous countries worldwide where one can seek asylum. However, before initiating the procedure, you must clearly understand: · Where is the probability of securing the desired status highest? · Which country offers the strongest guarantees against refoulement (forced return or extradition)? · Where can you and your family adapt and integrate most rapidly with minimal disruption? EU countries issued a record 3.9 million residence permits last year EU countries issued a record number of residence permits in 2025, up 10% on the year, driven mainly by employment and family reunification. Migration remains one of Europe's most politically contested issues, yet EU countries issued more first residence permits to non-EU citizens last year than in any year since records began in 2008. According to Eurostat, around 3.9 million first residence permits were issued across the EU in 2025, a 10.1% increase, or 355,350 more permits, compared with 2024. Among new permits issued in 2025, employment led the way, at 33.6% of the total, up 16.1% on the year. Family reunification followed, up 14.1% to 28.1%, and education grew 9% to reach 15.5%. Only one category shrank: permits for other reasons, including international protection, fell 0.9%. Spain, where family reunification leads the way Spain led the EU for first residence permits in 2025, issuing 635,438 — some 16.5% of the bloc's total. Its numbers were driven overwhelmingly by family reunification, not new labour migration. The country issued 275,869 family-related permits, more than any other EU country. These made up 43.4% of all Spanish permits. Moroccans were the largest group to receive family-related permits EU-wide, and more than half of those, 51.7%, were issued in Spain. Spain was also the most popular destination for Moroccan citizens overall (43.8%), reflecting long-established migrant communities, as well as historical and linguistic links that also draw large numbers of Venezuelans, Colombians and Peruvians to the country. Employment was Spain's second-largest category, with around 115,040 work-related permits, the third-highest in the EU behind Poland and Portugal. Education followed, with 105,419 permits issued to international students, again the third-highest in the bloc, behind France and Germany. Germany, Poland and the rest of the top five A small group of EU countries issued the vast majority of new permits. Behind Spain, the next largest issuers were Germany (605,292, 15.7%), Poland (467,314, 12.1%), Italy (433,099, 11.2%), and France (377,462, 9.8%). Together, these five countries accounted for almost two-thirds of all first permits issued in the EU last year. Malta issued by far the highest number of permits relative to its population, at 57 for every 1,000 people, followed by Cyprus (47) and Portugal (27), against an EU average of just 9. Ця країна Європи завершить тимчасовий захист для українців раніше, ніж ЄС Уряд Норвегії ухвалив рішення про те, аби продовжити тимчасовий захист для українців до кінця наступного, 2027 року. Це на три місяці менше, ніж дата, що затвердили в ЄС. Міністерка праці Норвегії Керсті Стенсенг розповіла, що уряд країни продовжить тимчасовий захист до кінця 2027 року. Та українці, які перебувають на захисті, можуть подати заявку на отримання посвідки на проживання, пише норвезький мовник NRK. Втім, для цього біженці повинні відповідати кільком умовам. Як українці в Норвегії можуть отримати посвідку на проживання? Передусім українці, що претендують на посвідку на проживання, повинні мати певний дохід – щороку заробляти принаймні 400 тисяч крон, тобто приблизно 36 тисяч євро. Ті, хто прибув до Норвегії до 16 вересня включно та отримав дозвіл на тимчасовий захист, можуть подати заявку. Німеччина почне отримувати дані про українські рахунки: що потрібно знати до 30 вересня Українські банки в межах міжнародного автоматичного обміну фінансовою інформацією передаватимуть дані про рахунки осіб, які є податковими резидентами Німеччини. Йдеться про систему CRS — Common Reporting Standard, повідомляє Ausnews.de. Для українців, які живуть у Німеччині та мають рахунки в українських банках, це означає, що інформація про такі рахунки та окремі доходи за ними може автоматично потрапляти до німецьких податкових органів. Що таке CRS CRS — міжнародний стандарт автоматичного обміну інформацією про фінансові рахунки між державами. У межах цієї системи фінансові установи визначають податкову резидентність клієнта та передають передбачені стандартом дані своїм податковим органам, які надалі обмінюються інформацією з відповідною країною. Сам факт наявності рахунку за кордоном не є порушенням. Ризики можуть виникати, якщо людина повинна була повідомити про активи або доходи, але не зробила цього. Які дані можуть передавати За інформацією видання, обмін може охоплювати: ім'я та прізвище власника рахунку; адресу проживання; дату народження; податкові номери; інформацію про фінансову установу; номер рахунку; залишок коштів на кінець звітного періоду; окремі види доходів, зокрема проценти, дивіденди та інші виплати. МВС: Обміняні у Німеччині українські права більше недійсні У МВС України пояснили, що українські посвідчення водія після обміну їх в Німеччині вважатимуться недійсними. Раніше у ФРН спростили процедуру обміну водійських посвідчень, виданих в Україні. Українські посвідчення водія вважатимуться недійсними у разі надходження до територіальних сервісних центрів МВС України посвідчень, що отримані в Україні та обміняні в іноземних державах. Про це у відповіді на запит DW повідомили в МВС України у вівторок, 8 вересня. "У разі надходження до територіальних сервісних центрів МВС посвідчень водія, що отримані в Україні та обміняні в іноземних державах, інформація про їх обмін за кордоном вноситься до Єдиного державного реєстру МВС, після чого такі посвідчення водія вважаються недійсними", - повідомили DW в МВС та послалися на Положення про порядок видачі посвідчень водія та допуску громадян до керування транспортними засобами. Як повідомлялося, у Німеччині з 18 серпня спростили обмін українських водійських посвідчень. Так, власники чинних українських водійських посвідчень категорій A1, A, B, BE, C1, C1E, C, CE, D1, D1E, D та DE можуть обміняти їх на німецькі без складання теоретичного та практичного іспитів. Українці в Польщі можуть отримати новий статус: що для них зміниться Нова посвідка дає право на проживання в Польщі протягом трьох років, але після її отримання частина переваг тимчасового захисту припиняється Українці, які перебувають у Польщі під тимчасовим захистом і мають статус PESEL UKR, можуть оформити спеціальну посвідку на проживання CUKR. Вона підтверджує дозвіл на тимчасове проживання в країні строком на три роки. Подати заяву можна виключно в електронній формі через портал MOS. Про це повідомляє Управління у справах іноземців Польщі. CUKR – це посвідка на тимчасове проживання на спеціальних умовах для людей, які користуються тимчасовим захистом і вирішили перейти на інший тип легалізації перебування. Після отримання документа статус UKR у реєстрі PESEL змінюється на CUKR. Хто може отримати CUKR Оформити посвідку можуть українці, які відповідають установленим умовам щодо перебування в Польщі та безперервності статусу UKR. Водночас отримання CUKR не є автоматичним. Людина має самостійно подати заяву та пройти процедуру оформлення посвідки. Заявки приймають до 4 березня 2027 року. Що дає нова посвідка Головна перевага CUKR – можливість легально проживати в Польщі протягом трьох років на підставі дозволу на тимчасове проживання. Власники CUKR отримують повне право на роботу в Польщі та можуть вести підприємницьку діяльність. Також вони можуть подорожувати країнами Шенгенської зони до 90 днів протягом кожних 180 днів. Час проживання в Польщі на підставі CUKR також враховується під час отримання дозволу на постійне проживання довгострокового резидента ЄС. Які права можна втратити Перехід на CUKR означає припинення тимчасового захисту. Тому людина більше не користуватиметься частиною прав і пільг, які безпосередньо пов’язані зі статусом UKR. Водночас право на роботу та підприємницьку діяльність зберігається. Важливо також, що після отримання CUKR діятимуть інші правила перебування за кордоном. Якщо власник посвідки залишить Польщу більш ніж на шість місяців, він може втратити дозвіл на тимчасове проживання. Крім того, про зміну місця проживання необхідно повідомляти воєводу, який видав посвідку, протягом 15 робочих днів. Що буде зі статусом UKR Після отримання посвідки CUKR статус UKR у реєстрі PESEL змінюється на CUKR. Якщо ж людина не отримає саму посвідку протягом 60 днів після повідомлення воєводського управління про можливість її отримання, документ буде анульований, а статус UKR не зміниться. Таким чином, CUKR дає українцям у Польщі більш стабільну підставу для проживання на три роки, але водночас означає вихід із режиму тимчасового захисту. Тому перед поданням заяви варто врахувати не лише переваги посвідки, а й права, які були пов’язані саме зі статусом UKR. Варто нагадати, що міністр закордонних справ Польщі Радослав Сікорський закликав країни Європейського Союзу вислати значну частину російських дипломатів. Why so many countries want to join the EU, except Europe’s richest Nine candidate countries are racing to get into the European Union. Three of Europe’s wealthiest democracies are doing everything they can to stay out. Is the EU’s pull weaker on the continent’s richest? Ukraine and Moldova have finished screening their laws against the EU rulebook. Montenegro has closed 18 of its 33 negotiating chapters, chasing a self-declared “28 by 28” target for membership. Albania hopes to conclude talks by 2027. Each of these candidates is poorer, less institutionally secure, or closer to Russia’s borders than Iceland will ever be, and all want in. Iceland, richer and more stable than most existing EU member states, said no. On 29 August, voters rejected reopening accession talks by 52.8 percent to 47.2 percent. Iceland remains in the European Economic Area and the Schengen Area, tied to the single market as before. It just didn’t want to become something more. Why Iceland said no For candidate countries, EU membership is transformative. “The benefits of EU membership are different for wealthy, already integrated countries,” says Tinatin Akhvlediani, head of the enlargement programme at the Centre for European Policy Studies (CEPS). Aspirants like Ukraine or Montenegro gain a geopolitical anchor, access to funds, and a reform framework that makes backsliding politically costly. Iceland already had most of the economic case covered through the EEA and its security guaranteed by NATO. What remained on the table was mostly political: a seat in Brussels’ institutions in exchange for pooling more sovereignty. “These benefits are less tangible to voters than economic convergence or democratic consolidation,” Akhvlediani says. “For countries that already have prosperity, stability and market access, the EU has to make a stronger political case for membership.” Iceland is the test case for that argument, and by her own account, the EU did not make it convincingly enough. The “yes” campaign had real arguments to work with. An 8 percent central bank interest rate, against 2.25 percent at the ECB, and mounting Arctic tensions since Donald Trump revived talks of acquiring Greenland. It wasn’t enough. Even the security argument, which brought Iceland’s EU question back onto the political agenda in the first place, couldn’t close the gap on its own. “Security concerns helped bring Iceland’s EU question back onto the agenda, particularly given the shifting transatlantic relationship, Russia’s ongoing war in Ukraine and the Arctic increasingly becoming contested,” Akhvlediani says. “But security alone was not enough to win the referendum.” What tipped Icelanders toward no, almost everyone agrees, was fish. Around 90 percent of the country’s fishing companies opposed membership outright, unwilling to submit their waters to the EU’s Common Fisheries Policy. Akhvlediani calls fisheries “not just an economic sector” in Iceland but something “closely linked to national identity.” That, she argues, is why the “no” campaign won: “voters ultimately weigh geopolitical risks against very concrete private and domestic interests. For Iceland, fisheries and sovereignty were more immediate and politically salient than the broader strategic argument for deeper European integration.” Mika Aaltola, a Finnish MEP with the centre-right EPP group, extends the same logic to farming. Icelandic sheep, dairy and greenhouse production survive “behind high tariff walls” that EU rules would reshape. “Primary production in a harsh environment is existential,” he says, “and existential things are not pooled.” What it means for Brussels Brussels had hoped for a different outcome and had reasons to. Diplomats described an Icelandic “yes” as a test of the Union’s appeal, evidence it could attract a wealthy, functioning democracy, not only states seeking rescue or reform. Some officials had hoped a joint push alongside Montenegro’s accession progress would make the wider enlargement drive easier to sell to sceptical capitals elsewhere in the bloc. Akhvlediani had made that case herself before the vote, arguing that a “yes” would have shown the EU is attractive to more than just poorer or less stable candidates. The “no” complicates that narrative, though she is careful about how far the damage extends: “It is not good news for the enlargement narrative, but not a rejection of the European project,” she says. “The no means the EU cannot use Iceland as evidence of that additional attractiveness.” What it does confirm, in her view, is a structural limit to Brussels’ pitch: “Economic integration does not automatically translate into political integration.” Iceland is not an isolated case among Europe’s rich outsiders. Norway has incorporated roughly three-quarters of EU law into its statutes through the EEA without ever holding a membership vote in Brussels’ favour. Polling this year shows only 37 percent support for joining, against 49 percent opposed. A pattern unchanged since Norwegians rejected membership twice, in 1972 and 1994. Switzerland, rather than seeking a seat at the table, spent the past year deepening its bilateral arrangements instead. Wealthy outsiders have something other candidates do not: workable alternatives to full membership that deliver most of the economic upside without the political cost. A warning sign, or a one-off? Not everyone reads Iceland’s vote as a verdict on enlargement itself. Christine Leuchtenmüller of the Konrad-Adenauer-Stiftung urges caution. Iceland, she says, “is a very specific” case shaped by decades of debate over fisheries and sovereignty. A no vote “would primarily reflect Iceland’s particular political and economic circumstances” rather than say much about enlargement more broadly. Akhvlediani agrees Iceland is a special case, but not a closed one. She sees a lesson that reaches straight to Oslo. “The main lesson is that the EU cannot assume that deep economic integration will naturally lead to political membership. For countries such as Norway, and potentially other wealthy European democracies, the question is what additional value full membership offers compared with the arrangements they already have.” For Ukraine, Moldova and the Western Balkans, that answer is evident: security, funding, a way to lock reforms in against future backsliding. For Iceland, Norway and Switzerland, it’s not the case. Akhvlediani doesn’t think the fix is a special membership track carved out for rich democracies. She thinks it’s simpler, and harder. “What Brussels can improve is how it communicates and explains the benefits of membership: political influence, participation in decision-making, deeper economic integration and strategic weight in European security architecture,” she says. The dividing line in European politics isn’t about pro-EU versus anti-EU. It’s about holding influence inside Brussels’ institutions or keeping control outside them. As Akhvlediani put it, “if the EU wants to remain an attractive geopolitical project, it needs not only to ask candidates what they must do to join, but also to explain clearly what membership gives them in return.” Джерело

ДМС вирішила примусово повернути громадянина РФ, який одружився з українкою, але Верховний Суд скасував рішення Самого факту порушення іноземцем правил перебування в Україні недостатньо для автоматичного примусового повернення — ДМС має оцінити всі обставини справи, а суд перевірити пропорційність такого заходу. Верховний Суд у складі колегії суддів Касаційного адміністративного суду 19 серпня 2026 року розглянув справу № 712/2426/23 за позовом громадянина російської федерації до Соснівського відділу у місті Черкаси Центрально-південного міжрегіонального управління ДМС. Спір стосувався рішення про примусове повернення позивача до країни походження або третьої країни. Суд дійшов висновку, що суди попередніх інстанцій не встановили всіх обставин, необхідних для правильного вирішення спору, та направив справу на новий розгляд. Обставини справи Позивач є громадянином російської федерації. 16 жовтня 2019 року він уклав шлюб із громадянкою України та того ж року прибув до України, де проживав у місті Сміла. 8 квітня 2021 року йому видали посвідку на тимчасове проживання, строк дії якої закінчувався 6 квітня 2022 року. Ще 27 жовтня 2021 року позивач звернувся до Смілянського відділу УДМС із заявою про надання дозволу на імміграцію в Україну, посилаючись на шлюб із громадянкою України понад два роки. Однак 5 січня 2023 року йому відмовили у наданні дозволу на імміграцію як особі, якій на підставі закону заборонено в’їзд в Україну. Строк дії посвідки закінчився вже після початку повномасштабного вторгнення. Позивач стверджував, що починаючи з 6 березня 2022 року неодноразово намагався звернутися до органів ДМС щодо обміну або продовження посвідки, однак отримував усні роз’яснення про призупинення відповідних адміністративних послуг у зв’язку з воєнним станом. Згодом, 1 липня 2022 року, він звернувся письмово. У відповіді від 12 липня 2022 року йому рекомендували звернутися щодо обміну посвідки після припинення чи скасування воєнного стану. У серпні 2022 року ДМС також повідомила, що питання продовження строку дії посвідок на тимчасове проживання громадян російської федерації, строк дії яких закінчився під час воєнного стану, законодавчо не врегульоване. Постановою Кабінету Міністрів України від 1 листопада 2022 року № 1232 було передбачено особливості надання міграційних послуг громадянам російської федерації в умовах воєнного стану. Зокрема, окремі особи мали протягом 30 днів із дня набрання постановою чинності звернутися за обміном посвідки, якщо строк такого звернення настав у період із 24 лютого 2022 року до дня набрання чинності постановою. Потім, 7 березня 2023 року щодо позивача склали протокол за частиною першою статті 203 КУпАП за ухилення від виїзду з України після закінчення відповідного строку перебування. Того ж дня начальник Соснівського відділу УДМС наклав на нього штраф у розмірі 2040 грн та прийняв рішення № 4 про примусове повернення до країни походження або третьої країни з обов’язком залишити Україну до 12 березня 2023 року. Позивач оскаржив рішення про примусове повернення, зокрема посилаючись на свої звернення до ДМС, неможливість обміняти посвідку в умовах воєнного стану, шлюб із громадянкою України та наслідки повернення для сімейного життя. Суди першої та апеляційної інстанцій у задоволенні позову відмовили. Вони виходили з того, що позивач перебував в Україні після закінчення строку дії посвідки та не звернувся за її обміном у визначений постановою № 1232 строк. Не погодившись із цим, позивач подав касаційну скаргу. Серед іншого, він вказував, що суди формально оцінили лише пропуск установленого строку, не встановивши, чи звертався він до ДМС, які відповіді отримував, чи мав реальну можливість легалізувати перебування та які наслідки матиме його повернення для сімейного життя. Позиція Верховного Суду ВС вказав, що законодавством унормовані правила перебування іноземців в Україні, а обов’язку іноземця дотримуватися строків звернення за обміном посвідки кореспондує обов’язок органу ДМС щодо прийняття у нього відповідних документів, їх розгляду та вирішення питання щодо подальшої легалізації перебування відповідної особи в Україні. Суд зазначив, що іноземець або особа без громадянства можуть бути примусово повернуті в країну походження або третю країну, якщо їх дії порушують законодавство про правовий статус іноземців та осіб без громадянства або суперечать інтересам забезпечення національної безпеки України чи охорони громадського порядку, або якщо це необхідно для охорони здоров’я, захисту прав і законних інтересів громадян України. Водночас ВС наголосив на необхідності врахування особливостей ситуації, яка виникла у зв’язку з воєнним станом. Суд встановив, що строк дії посвідки позивача закінчився 6 квітня 2022 року, тобто після введення воєнного стану. При цьому урядова постанова № 165 зупинила строки надання адміністративних послуг та видачі дозвільних документів на час воєнного стану. Надалі постанова № 1202 встановила спеціальні правила щодо посвідок, строк дії яких закінчився після 24 лютого 2022 року, але її положення не поширювалися на посвідки, оформлені громадянам російської федерації. ВС звернув увагу на те, що позивач на момент набрання чинності постановою № 1232 належав до категорії осіб, які мали законні підстави для оформлення дозволу на імміграцію та посвідки на постійне проживання, оскільки його заява про надання дозволу на імміграцію, подана у зв’язку зі шлюбом із громадянкою України, перебувала на розгляді в органах ДМС з 27 жовтня 2021 року до 5 січня 2023 року. Крім того, ВС звернув увагу, що на момент прийняття постанови № 1232 її пункт 2 містив інше формулювання щодо категорій осіб, на яких поширювався обов’язок звернення за обміном посвідки. Зміни, якими до відповідної норми було включено осіб, передбачених частиною чотирнадцятою статті 4 Закону № 3773-VI, були внесені лише постановою № 107, яка набрала чинності 9 лютого 2023 року. При цьому питання встановлення нового строку для подання відповідних заяв цією постановою не було вирішено. ВС вказав, що рішення ДМС України про примусове повернення іноземця або особи без громадянства до країни походження або до третьої країни має прийматися з урахуванням усіх обставин, що мають значення для його прийняття (вчинення дій). Дискреція дозволяє адміністративному органу прийняти найбільш зважене в конкретних умовах рішення, засноване на особистих (власних) оцінках обставин, а не на чіткому приписі норми права (не формально). Суд також наголосив, що суди при перевірці рішень суб’єктів владних повноважень мають перевіряти їх відповідність усім вимогам частини другої статті 2 КАС України, а не лише встановлювати, що рішення прийняте в межах повноважень. Окремо ВС звернув увагу на необхідність дослідження звернень іноземця до органів ДМС. Суд зазначив, що суди мають досліджувати питання дотримання законності процедур та виконання органом ДМС положень Закону України «Про звернення громадян» у частині фіксації звернень громадян в усній формі, зокрема встановлювати, коли та ким з уповноважених осіб органу ДМС було отримане усне звернення та надано відповідну усну відмову. ВС зауважив, що за протилежних обставин громадянин російської федерації, який звертається з документами для продовження строку перебування в Україні до органу міграційної служби, отримуючи усну відмову в їх прийнятті, опиняється в ситуації правової невизначеності, адже маючи бажання легалізувати своє положення в Україні, в той же час, з огляду на неврегулювання відповідних відносин на законодавчому рівні, останній позбавлений можливості довести свій намір задля уникнення примусового повернення в країну походження або третю країну. У цій справі, як встановив ВС, позивач посилався саме на такі обставини: його неодноразові звернення до ДМС, усні роз’яснення про неможливість обміну посвідки, а також письмові відповіді органів ДМС із рекомендацією звернутися після припинення чи скасування воєнного стану. Однак суди попередніх інстанцій відповідних обставин не встановили та не надали їм оцінки. Суд зазначив, що навіть в умовах воєнного стану для суб’єкта владних повноважень обов’язок застосування принципів статті 2 КАС України не скасовується, а набуває особливого значення, зокрема щодо пропорційності обмежень. Під час перевірки рішення ДМС про примусове повернення суди повинні враховувати справедливий баланс інтересів держави і заявника, наявність тривалих сімейних зв’язків та відповідних наслідків для сімейного життя позивача, а також наявність чи відсутність антисоціальної поведінки, правопорушень та кримінально-караних діянь, які загрожують суспільству. Суд окремо зазначив, що перевірка заборони вислання має проводитися станом на момент прийняття рішення та концентруватися на передбачуваних наслідках повернення заявника в країну походження з урахуванням загальної ситуації в цій країні та особистих обставин заявника. ВС вказав, що лише після з’ясування наявності визначених статтею 26 Закону № 3773-VI підстав для примусового повернення та особистих обставин заявника можна визначити співмірність і пропорційність застосованих заходів та його інтересів і прав, зокрема права на повагу до приватного і сімейного життя подружжя, гарантованого статтею 8 Конвенції. У результаті Суд дійшов висновку, що наявність постанови про притягнення позивача до адміністративної відповідальності за частиною першою статті 203 КУпАП не може бути єдиною підставою для прийняття рішення про його примусове повернення до країни походження або третьої країни. Таким чином, Верховний Суд не визнав рішення про примусове повернення правомірним і не вирішив спір остаточно по суті. Суд скасував рішення районного суду та постанову апеляційного суду в частині позовних вимог про примусове повернення та анулювання відповідного запису в паспорті і направив справу в цій частині на новий розгляд до суду першої інстанції. При цьому питання законності накладення штрафу за статтею 203 КУпАП касаційний суд взагалі не переглядав по суті. Ще на етапі відкриття провадження ухвалою від 23 грудня 2025 року Верховний Суд відмовив у відкритті касаційного провадження в частині оскарження штрафу, оскільки судові рішення у справах про притягнення до адміністративної відповідальності за КУпАП не підлягають касаційному оскарженню. Europe's obsession with return hubs may not live up to the hype Five EU states are racing to build migrant 'return hubs' before new rules are put in place, with Uganda and Rwanda rumoured as the most likely sites – but recent cases point to significant legal and practical obstacles, while the actual numbers do not match the expectations. The EU's migration policy has increasingly centred on the controversial notion of using "return hubs" to externalise irregular migrants to third countries, as enshrined in the recently adopted Return Regulation. "We need to set up repatriation centres in third countries, as well as other innovative solutions outside Europe. We are working hard on this," Italian Prime Minister Giorgia Meloni and her Danish counterpart Mette Frederiksen wrote in a joint statement earlier this month. Nineteen EU countries are convinced this is an "innovative solution" to pursue for migration management, as made clear in a joint letter sent to EU leaders last June, suggesting the centres would become a reality sooner rather than later. A crucial debate on migration will take place at the next European Council summit, with return hubs set to be one of the main points of discussion. Yet fundamental questions about how the policy would be implemented remain unanswered. How would return hubs work? Where would they be located? And which problems have they run into so far? Here, Euronews breaks down the main issues around the new migration mantra – and why the reality might not match the political narrative. What are return hubs? Return hubs are facilities in a "third country" – a non-EU country with which an EU member state has reached an agreement to transfer people even when they have no connection to that country. The people to be transferred will be those with no legal right to remain on European territory who are subject to a return decision. Hubs can be either places of transit, where a person is placed waiting to be returned to their country of origin, or locations where a person is expected to stay with no guarantee of onward returns. While the term “return hubs” is not specifically used in the text of the regulation, the law reframes an original proposal from the European Commission, outlining the conditions to set up centres outside the EU. Each hub requires “an agreement or arrangement” to be concluded by the EU, or one or more of its member states, with a non-EU country. Italy has spearheaded this approach with Albania, where centres opened in October 2024 are used to house migrants rescued or intercepted at sea by Italian authorities. Rome is now pitching this as the model for the rest of the EU to follow. Ironically, the Albanian facility is not technically a return hub. For one thing, it was meant to host only asylum seekers, externalising the asylum procedure, which was run by Italian authorities on Albanian soil. After being confronted with legal challenges, in March 2025, the Meloni government turned the centre into a deportation hub for irregular migrants who had already received a return decision. This change made the Albanian facility an early precursor to a return hub, but it is still the Italian authorities who manage the centre and who are responsible for the migrants’ final repatriation. The European model could yet go further and externalise the entire management and responsibility for the asylum and deportation process to a non-EU country. Italy's processing and detention centres in Albania would need to be reconsidered once the country joins the EU. Albania is the second-closest candidate to accession after Montenegro. Which countries are being considered? The Return Regulation has been politically agreed, but the EU institutions still have to complete its formal adoption: the law has yet to enter into force, as it still has to be published in the bloc's Official Journal. According to an EU official, the language of the regulation is undergoing legal review and the final adoption is likely to take place in the autumn. Meanwhile, European governments have reportedly already been working to set up return hubs in third countries, negotiating either bilaterally or as a group. Germany, Austria, Denmark, Greece and the Netherlands have confirmed they are negotiating the establishment of such facilities. Their goal is to have the first partnership agreed by the end of the year, to be signed in early 2027, a diplomat told Euronews. The European Commission is informed, but not involved. According to Greek daily Kathimerini, the five EU countries are in advanced discussions with Uganda, aiming to make a facility operational by next year. The countries involved have declined to confirm this, citing the risk that media disclosures could harm the negotiations. Rwanda is another African country under discussion with the group of five, according to Germany's Der Spiegel. Rwanda was also at the centre of a highly controversial and now abandoned UK scheme to relocate asylum seekers while their applications were processed. Immigration ministers from the five countries are due to take stock of progress at a meeting in Copenhagen on 4 September. In April, meanwhile, the Austrian government announced a migration and readmission agreement with Uzbekistan, which does not include a return hub. Media reports and national MPs have named the country as a potential location, but Uzbekistan's Ministry of Foreign Affairs denied it in a statement to Euronews, saying "there are currently no negotiations taking place on this matter". What are the legal and practical problems? In a letter published last month, the Council of Europe's Commissioner for Human Rights, Michael O'Flaherty, asked the five EU countries to ensure that "any relevant initiative be preceded by a comprehensive ex ante assessment of potential direct or indirect human rights risks associated with the proposed co-operation". The Return Regulation does not explicitly require a human rights impact assessment, but it does state that "such an agreement or arrangement may only be concluded with a third country where international human rights standards and principles in accordance with international law, including the principle of non-refoulement, are respected". In 2024, the EU Ombudsman criticised the Commission for signing a Memorandum of Understanding with Tunisia on border control and migration management without conducting a human rights impact assessment. Even though the UK is no longer an EU member, the reasoning behind its Supreme Court ruling against the Rwanda asylum-transfer scheme in November 2023 is instructive: the court found Rwanda was not sufficiently safe given the risk of persecution or ill-treatment. The incoming Labour government abandoned the scheme as a result. Meloni's own relocation scheme in Albania has run into similar judicial trouble, with Italian judges questioning the designation of countries such as Bangladesh and Egypt as "safe" – a designation Italian authorities had relied on to examine asylum applications through an accelerated procedure. Crucially, the court cases stemming from the Albanian centres have now reached the EU Court of Justice, which has yet to rule on a central question: whether Italy can transfer someone subject to a detention order outside the EU. Will the hubs work? "A human rights assessment - that should be carried out for all this kind of agreements - takes time, whilst EU countries are rushing to sign agreements with third countries even when the rules are not yet in place," Sara Prestianni, advocacy director at the NGO Euromed Rights, told Euronews. Prestianni described the countries being floated to host return hubs as "characterised by human rights violations" and questioned what methodology is being used to carry out the required human rights impact assessments. Even so, transferring irregular migrants outside the EU's borders is likely to require lengthy negotiations with host countries, and past cases show legal challenges can easily sink the project if human rights safeguards are not in place. "I definitely see questions as to what the third country might ask in return for hosting people who are not nationals of that country," Davide Colombi, researcher on migration at Brussels-based think tank CEPS, told Euronews. In the meantime, relocating irregular migrants within the Union has proved far more straightforward, though this piles more pressure on frontline countries like Italy to uphold the country-of-first-arrival principle. Advocates of the return-hub approach counter that the legal and practical obstacles are not insurmountable, and that European capitals simply need time to build a functioning system capable of removing irregular migrants once the hubs are operational. But past cases raise doubts over whether reality will match ambition. "The previous experiences of externalisation or offshoring of migration management have been extremely costly, legally contested, and operationally very limited," Colombi said. Despite years of preparation and massive financial investment, a total of four people were voluntarily relocated from the UK to Rwanda before that scheme was scrapped. Italy initially projected housing around 3,000 migrants a month in its Albanian centres; the actual figure has reportedly been a mere 500 in total since the conversion into a deportation centre in March 2025. The entire bill amounts to over €670 million, and according to a recent study from an Italian University, detaining migrants in these centres has proven much more expensive for Italy than hosting them on its own territory. The most heated confrontation remains with Germany. While Berlin is pushing for readmissions of so-called 'Dublin cases' – migrants who arrived in one member state and then moved to another without having lodged an asylum application – Italy is strongly opposed to the activities in the Mediterranean of German NGO vessels. In Naples, Sea Watch 5 has been hit with a 45-day administrative detention order and a 7,500-euro fine, accused of failing to cooperate with the Libyan coastguard, it emerged on Sunday. Interior Minister Matteo Piantedosi has reiterated that operations must be coordinated exclusively by the competent states, while the NGO highlights the dangers posed by the Libyan authorities and announces an appeal. "We informed Italy and neighbouring European countries," the German NGO told Italian media, "but not the so-called Libyan maritime rescue coordination centre, a puppet authority that serves to legitimise and make acceptable as an interlocutor those men and smugglers who, shortly after the rescue, pointed a rifle at us and ordered us to leave". In an attempt to mend the rift and tackle the thorny issue of returns and NGOs, a bilateral meeting between the Italian minister and his German counterpart, Alexander Dobrindt, is scheduled for next month. Also on the table is a proposal for a compensation mechanism between the transfers requested and the people rescued by private vessels. "With my German colleague, we have shared an assessment that sees NGO activity as a pull factor for irregular migration", Piantedosi reiterated. Piantedosi's defence of Italy's migration policies Faced with accusations from the opposition, brushed off as "a confusion foul" devoid of substance, Piantedosi insists on the effectiveness of the government's action, pointing to a reduction in landings and a doubling of returns thanks to agreements with Tunisia and Libya. On the issue of 'Dublin cases', the interior minister instead highlights a shift under the Meloni government: after the inertia of previous administrations, Italy has blocked the return of 80,000 migrants, reducing actual transfers to negligible figures, he said. While acknowledging that Rome would have preferred stricter rules, Italy appears to defend the new EU Pact as a paradigm shift that introduces structural, mandatory solidarity for countries of first entry, even though current misunderstandings over responsibility for migrants risk undermining this mechanism. Two UK universities merge to form country's first ‘super-university’ The merger comes amid mounting economic pressures facing British universities, including some of the most highly regarded higher education institutions in the world. Two British universities have merged to form what they describe as the UK's first "super-university." London's University of Greenwich and the University of Kent in southeast England announced on Monday that they had completed a merger establishing the new "London and South East University Group, which will be known as LASE. The new group, which has been designed to allow other universities to potentially join in the future, will have more than 50,000 students, making it the third largest university in the UK. The two universities will continue to operate under their own names and will maintain distinct academic divisions, with prospective students applying, studying, and graduating at the institution of their choice. The LASE group will have a chancellor, governing body, and senior executive team. The official launch of the LASE group is set to take place on 7 September, with events marking the occasion scheduled to be held across its four campuses - Greenwich, Avery Hill, Medway, and Canterbury. In a press release, Professor Jane Harrington, the founding vice-chancellor and CEO of LASE, promised a "truly spectacular launch" and said more details would be released at the time. “A massive thank you to everyone who has been involved in getting us to this point – there has been tireless work over the last year working to an ambitious timetable and developing a new university model that has never been done before," Harrington said. "It means we are starting with a smooth transition, an extremely strong senior executive team and clear direction so that we can fulfil our potential as the UK’s first super-university," she added. In May, members of parliament on an education select committee warned that UK universities were under serious economic strain and that there was a possibility of a major institution closing down. Українцям за кордоном спростили оформлення паспорта: що змінилося Українцям за кордоном скасували одну з вимог під час оформлення паспорта. Українцям віком від 18 до 60 років, які перебувають за межами країни, більше не потрібно пред’являти військово-обліковий документ чи застосунок «Резерв+» для оформлення або обміну паспорта. Під час подання документів громадянам не потрібно надавати паперові чи електронні військово-облікові документи, а також встановлювати чи демонструвати застосунок «Резерв+». Усі необхідні процедури тепер проходять інакше. Як пояснили у Паспортному сервісі, під час оформлення паспорта працівник установи самостійно перевіряє інформацію в електронній системі, а статус військового обліку перевіряється автоматично через державні електронні реєстри. У разі відсутності інформації про військовий облік особу можуть автоматично взяти на нього без проходження військово-лікарської комісії. Після формування відповідного документа процес оформлення чи обміну паспорта продовжується у звичному порядку. У Паспортному сервісі вкотре наголосили, що для отримання чи обміну паспорта за кордоном не потрібно самостійно турбуватися про отримання військово-облікових документів чи завантаження мобільних додатків, оскільки всі перевірки виконуються автоматично в системі. Нагадаємо, українці за кордоном тепер можуть легко й швидко оформити електронний податковий номер (ідентифікаційний код). Раніше послуга діяла як експеримент лише для дітей, а відтепер вона доступна всім дорослим. У Фінляндії розробляють екзамен на отримання громадянства У Фінляндії з 2 березня 2027 року під час подання заяви на отримання фінського громадянства потрібно буде скласти екзамен на знання фінського суспільства. Про це повідомляє "Європейська правда" з посиланням на Yle. Екзамен розробляє Гельсінський університет. Він переміг у конкурсі, проведеному Міграційною службою. На іспиті перевірятимуть знання про устрій фінського суспільства та його основні принципи. Питання стосуватимуться законодавства, основних прав людини, рівності, а також історії та культури Фінляндії. Екзамен призначений для осіб працездатного віку – від 18 до 65 років. Він відбуватиметься в електронному форматі фінською або шведською мовою. Від складання іспиту звільняються ті, хто закінчив ліцей або вищий навчальний заклад фінською або шведською мовою. Тим, хто подав заяву до 2 березня 2027 року, складати іспит не доведеться. На підготовку тестування виділено близько 800 тисяч євро. За інформацією Міграційної служби, Гельсінський університет на ці кошти підготує навчальні матеріали, розробить іспит і зможе займатися його вдосконаленням у разі потреби протягом чотирьох років.
