The European Temporary Leave to Remain (visa) for EU citizens from 2021 29 January 2019 – Just useful and interesting UK & EEA Immigration Law news and updates from the Legal Centre – Open 7 days a week - www.legalcentre.org – Mob : +44(0)7791145923 >>> The European Temporary Leave to Remain (visa) for EU citizens from 2021 From the UK BA: "Leaving the EU with a deal remains the government’s top priority. This has not changed. However, a responsible government must plan for every eventuality, including a no deal scenario. The arrangements described here will also apply to citizens of Switzerland arriving after exit in a no deal scenario. After the UK leaves the EU, if there is no Brexit deal, EEA citizens will be able to enter the UK as they do now (for an interim period). However, following the end of free movement and before the UK’s new skills-based immigration system begins in 2021, you will need to apply for European Temporary Leave to Remain to stay longer than 3 months. You do not need to apply for any immigration status or visa if you do not intend to stay in the UK for more than 3 months. EEA citizens who arrive before the UK leaves the EU will still be able to apply for the EU Settlement Scheme. Rights and status European Temporary Leave to Remain will allow EEA citizens arriving in the UK after 29 March 2019 to live, work and study in the UK if there’s no Brexit deal. EEA citizens who are granted European Temporary Leave to Remain will be able to stay in the UK for 36 months from the date of their application. European Temporary Leave to Remain will be a temporary, non-extendable immigration status. It will not give indefinite leave to remain (ILR), lead to status under the EU Settlement Scheme or make EEA citizens eligible to stay in the UK indefinitely. If EEA citizens want to stay in the UK for more than 36 months, they will need to apply for an immigration status under the new immigration system, which will come into effect from 1 January 2021. Those who do not qualify will need to leave the UK when their European Temporary Leave to Remain expires. Who will need to apply? You’ll need to apply if you: are an EEA citizen and arrive in the UK after the UK leaves the EU and want to stay in the UK for more than 3 months You’ll not be eligible if you are a serious or persistent criminal or a threat to national security. Irish citizens will not need to apply for European Temporary Leave to Remain. They’ll continue to have the right to enter and live in the UK under Common Travel Area arrangements. Family members of EEA citizens Non-EEA citizen close family members of EEA citizens living in the UK will need to apply for a family permit before accompanying or joining them in the UK. How to apply for European Temporary Leave to Remain You’ll need to apply within 3 months of arriving in the UK. The application will be online. You’ll need to prove your identity and declare any criminal convictions during your application. If you are living in the UK before the UK leaves the EU If you’re an EEA citizen who enters the UK before the UK leaves the EU, you’re eligible to apply to the EU Settlement Scheme to continue living in the UK. EEA citizens and their families will be able to remain in the UK indefinitely if they are granted settled status under the EU Settlement Scheme. If you’re an EEA citizen who arrives in the UK after 29 March 2019 but were previously living in the UK before 29 March 2019, you can also apply to the EU Settlement Scheme."

For example, an applicant was refused visas under the Tier 1 and Tier 4 immigration categories 4 because of fraudulent documents with the 10 years ban in 2012. The decision letter says that any future applications under spouse route etc. would not be affected. So, in 2015 the applicant was granted entry clearance as a spouse of a British citizen. In 2020 the applicant is planning to apply for ILR. Can this applicant expect a grant of ILR ? The answer is "Probably", if the applicant satisfies the Para D-ILRP.1.1., including satisfying the Paras S-ILR. If the applicant previously satisfied the Paras S-LTR, despite the previous fraudulent documents, then the applicant should be able to satisfy the analogous paragraphs in Para S-ILR. Нет. По текущим правилам жены британцев могут подать на гражданство сразу после получения ILR. До 2003 года был 1 год до ILR, с 2003 по 2012 - 2 года до ILR. Теперь - 5 лет.

Гражданам EU/членам их семей нужно прожить в UK 5 лет, чтобы иметь право на Settled Status. Если меньше 5 лет прожили - могут претендовать на Pre-settled status.

Приветствую. После подачи заявления НЕЛЬЗЯ выезжать за пределы UK до того момента, пока не получите новую BRP, иначе поданное заявление АННУЛИРУЕТСЯ = ОТКАЗ !

Приветствую, Что Вы имеете в виду под "обычной" подачей ? Если не 24 часа сервис - так же можно загружать копии документов электронно. На прошлой неделе подавал клиентское заявление - NTL. По стандартному типу, т.е. "решение в течение 6-и месяцев" (у моего клиента сказали в Центре, что рассмотрят за 6 недель).

Заявление было нестандартное, и мне перезвонил знакомый case worker из PSC Solihull, где я подавал заявления клиентов на протяжении последних пары десятков лет, и кому на стол попало заявление этой клиентки на ILR. Было немного чуднО общаться со знакомым офицером (один из лучших в этом PSC) по телефону, а не лично, как это было раньше. However, your new employer will probably first have to have run a resident labour market test (RLMT) before assigning the CoS, unless an RLMT exception applies. Launching a consultation on Simplifying the Immigration Rules today, the influential law reform body proposes major revisions to “provide a more logical structure, remove unnecessary repetitions and improve the drafting”. The regulations that underpin the UK’s immigration system have grown from 40 pages in 1973 to around 1,100 today, the commission points out. The sheer length, unwieldy drafting and confusing structure of the Rules make it difficult for migrants — as well as Home Office decision-makers — to understand and follow them. The Law Commission gives the example of the rules on applying to extend an entrepreneur visa. These include a requirement that the applicant has created two new full-time jobs by setting up their business. Paragraph 50 of Appendix A now devotes 750 words to the evidence required to prove this; the equivalent a decade ago took just 76 words. On structure, the Law Commission says that having the requirements for a particular visa scattered around different sections of the Rules is the worst possible approach. Instead, it recommends that the redrafted Rules follow either a “common provisions” approach, where applicants can check the requirements common to all visas before turning to their particular route a “booklet” approach, where all the requirements for a particular route are gathered together under one heading. Either way, the commission provisionally recommends that the Rules be divided into 15 categories: Visitors Students Work Short-term work and work experience Business and investment Family members of workers, businesspersons, investors and students Family members of British citizens, settled persons and persons with refugee/humanitarian protection status Long residence and private life Armed forces Other categories ECAA nationals and settlement EU citizens and family members Asylum Temporary protection Stateless persons There are 54 consultation questions in total. The deadline for responses is 26 April 2019.
