В частности, заявителю на момент подачи заявления только-только исполнилось 18 лет, и заявление на натурализацию подавалось как для взрослого. Home Office, тем не менее, запросил предоставить доказательство того, что у этого клиента была частная медицинская страховка (CMI). Мне пришлось работать и даже созваниваться напрямую с сотрудником Home Office, кто рассматривал дело этой клиентки из Польши.   3. 03 August 2020 – Just useful and interesting UK & EEA Immigration Law news and updates from the Legal Centre – Open 7 days a week - www.legalcentre.org - +44(0)3300010342, +44(0)7791145023 (WhatsApp/Viber) >>> Seven year rule does not apply to EU children until they’ve lived in UK for seven years: https://www.bailii.org/uk/cases/UKUT/IAC/2020/224.html In MM (section 117B(6) – EU citizen child) Iran [2020] UKUT 224 (IAC ) the Upper Tribunal holds that the seven year rule at section 117B(6) of the 2002 Act (which applies to British children and foreign national children resident for seven years) cannot be read as applying to EU children resident for less than seven years on the basis that it is contrary to the EU prohibition on discrimination between citizens of a Member State and other EU citizens. The official headnote: "The definition of “qualifying child” contained in section 117D(1) of the Nationality, Immigration and Asylum Act 2002 does not include an EU citizen child resident in the United Kingdom for less than seven years. 2. The non-inclusion of EU citizen children resident for less than seven years in the definition of “qualifying child” does not breach the EU law prohibition against discrimination on grounds of nationality." An ambitious argument, but one of which we may hear more given that an appeal seems likely. >>> Upper Tribunal ruling on discretion to reunite refugee families under Dublin III: https://www.bailii.org/uk/cases/UKUT/IAC/2020/227.html In R (BAA & Anor) v Secretary of State for the Home Department (Dublin III: judicial review; SoS’s duties) [2020] UKUT 227 (IAC), the Upper Tribunal takes the opportunity to review Article 17 of the Dublin III Regulation, which provides a general human rights-based discretion for the UK to take responsibility for an asylum claim lodged in another EU country. The Dublin III system is not long for this world so far as Brexit Britain is concerned. The headnote: "1) Article 17(2) of Regulation 604/2013 of the European Parliament and of the Council (“Dublin III”) confers a discretion on a Member State to examine an application for international protection “in order to bring together any family relations, on humanitarian grounds, based on family or cultural considerations”. Although the discretion is wide, it is not untrammelled: R (HA & others) (Dublin III; Articles 9 and 17.2) [2018] UKUT 297 (IAC). As in the case of any other discretionary power of the Secretary of State in the immigration field, Article 17(2) must be exercised in an individual’s favour, where to do otherwise would breach the individual’s human rights (or those of some other person), contrary to section 6 of the Human Rights Act 1998. (2) The Secretary of State’s Article 17(2) decisions are susceptible to “ordinary” or “conventional” judicial review principles, of the kind described by Beatson LJ in ZT (Syria) v SSHD [2016] 1 WLR 4894 as “propriety of purpose, relevancy of considerations and the longstop Wednesbury unreasonableness category” (para 85). (3) Where a judicial review challenge involves an allegation of violation of an ECHR right, such as Article 8, it is now an established principle of domestic United Kingdom law that the court or tribunal must make its own assessment of the lawfulness of the decision, in human rights terms. If, in order to make that assessment, the court or tribunal needs to make findings of fact, it must do so. (4) Nothing in paragraphs (1) to (3) above is dependent upon Article 27 (remedies) of Dublin III applying to the facts of the case. Nevertheless, what the Upper Tribunal held in R (MS) (Dublin III; duty to investigate) [2019] UKUT 9 (IAC) regarding the scope of Article 27 is correct and nothing in the Court of Appeal judgments in MS [2019] EWCA Civ 1340 suggests otherwise. The reference to a “transfer decision” in Article 27 encompasses a refusal to take charge of a Dublin III applicant. That includes a refusal to take charge under Article 17(2). (5) It would be remarkable if the Secretary of State’s investigatory responsibilities were materially narrower in an Article 17(2) case which concerns an unaccompanied minor and his or her best interests, than they would be in respect of any other take-charge request under Dublin III. Where the request under Article 17(2) raises issues that involve an asserted family life within Article 8 ECHR/Article 7 of the Charter of Fundamental Rights, then, in the normal course of events, the Secretary of State’s degree of engagement with the relevant United Kingdom local authority should be no less than in the case of any other unaccompanied minor, where the take-charge request is made under Article 8 of Dublin III on the basis that the relation in the United Kingdom is a sibling or a “family member” or “relative” as defined. (6) Even in Article 17(2) cases, the principles of procedural fairness may mean that the Secretary of State may be required to provide an indication or gist to an applicant or his alleged United Kingdom relation, of matters of concern that may lead to a refusal to take charge of the applicant: R v SSHD ex parte Fayed [1998] 1 WLR 763; R (Balajigari) v SSHD [2019] 1 WLR 4647. This is, however, an area where one cannot lay down hard and fast rules. Even where Article 8 ECHR is in play, there may be exceptions. Furthermore, the process must not become so elaborate as to defeat the aim of expeditious decision-making, particularly where the best interests of minors are concerned. (7) The references to “exceptional circumstances” in the Secretary of State’s Dublin III Guidance (18 April 2019) do not render the Guidance unlawful. Those working in the immigration field know that the use of “exceptional” in the context of Article 8 ECHR is not to be used as setting a particular (high) threshold but, rather, as predictive of the outcome of the application of the principles of proportionality to the facts of a particular case. Nothing in the Guidance suggests its author is telling caseworkers to do anything other than follow the settled law on this topic."

Как я и предполагал, будет использована программа для мобильного телефона по типу программы для заявлений граждан EU по категории EUSS. Ожидается, что программа будет выпущена в августе 2020. В дальнейшем вся биометрика будет "сдаваться" через эту программу. В то же время есть опция не сдавать биометрику через мобильный телефон, т.е. отказаться от опции biometric re-use и пойти "старым путем", т.е. сдавать биометрику в том или ином офисе Sopra Steria. We recently wrote to tell you that UK Visas and Immigration (UKVI) is changing the way it processes applications in response to COVID-19. For some customers, this involves reusing biometrics (fingerprints and photograph) that have been recorded in a previous application as part of the process to verify your identity, consider your application and/or produce a Biometric Residence Permit (BRP). To allow biometrics to be reused for some customers, UKVI and UKVCAS (UK Visa and Citizenship Application Services) have worked together to develop a way to submit facial images using a new UKVCAS Identity Verification app (referred to below as IDV app). The IDV app lets you submit application information to UKVI without having to book or attend an appointment with UKVCAS. This new, free to use, way of submitting information to UKVI will involve you taking a photo of yourself and uploading supporting information onto your mobile device. The IDV app is quick and easy to use and works on most Android and iPhones. When will the IDV app be available? Rollout of the IDV app will take place in phases, beginning in August. We will invite eligible customers to use the new IDV app rather than require you to book an appointment at a UKVCAS service point. UKVI have identified that you are eligible to use the IDV app, as UKVI can use biometrics you have previously provided. Please be reassured that your immigration status remains unaffected whilst your application is in progress. What does this mean for me? For most customers, using the IDV app means you will not have to attend an appointment at a UKVCAS Service Point. An invitation will be sent for you to use the new IDV app within the next few weeks, with further details about how to the use IDV app and the next steps. What do I need to do next? If you are happy to use the IDV app, you don’t need to do anything. We will be in touch within the next few weeks to invite you to use the new IDV app. What if I want to book an appointment and not use the IDV app? The key advantage of the IDV app is you don’t have to attend an appointment at a UKVCAS Service Point. If you urgently need a decision about your application, (for example because you need to travel outside of the UK), the option to book an appointment is still available. See next steps below. Here are the steps to follow: Send UKVCAS an email from your UKVCAS registered email address to admin.ukvas@soprasteria.com by Friday 7 August.   11. В дополнение ко вчерашнему посту. Сегодня утром еще один клиент из Украины получил ILR по категории Tier 2(General). Похоже, Home Office работате круглосуточно. Ну или отдал решения на outsourcing куда-то: обратите внимание на время, когда был выслал Email из Home Ofice сегодня утром: 03.38 утра. Биометрика так же сдавалась на этой неделе. Решение - ILR - пришло буквально через пару дней. Делюсь нашей статистикой.
  12. Ничего. Я Вас понимаю. Кстати, на этой неделе несколько клиентов также подавали заявления в РФ. Одним сказали 4 недели, другим - 12 недель. Подавали в разных центрах. У одного взяли анкету всю на входе, у другого - просто оторвали первую страницу. Вы в РФ или на Украине подавали ? До COVID19 на Украине заявления EEa Family Permit у клиентов рассматривали за 10-14 дней обычно. Снйчас уже никакие стандарты не работают. Хотя иногда бывают сюрпризы. Вот как сегодня у других клиентов с Украины, например:

Все может быть. Например, у меня клиентка на Филиппинах подала еще в марте 2020. В начале июня 2020 решение было принято, и до сих пор ждем, пока решение "приедет" из UK в Манилу. Я понимаю, что Вы подавали заявление сами, что Вы волнуетесь и пробуете поделиться с форумом Вашим волнением. Дождитесь результата. Там может быть только 2 варианта. Надеюсь, у Вас будет положительное решение.

We may write to you to request original or certified documents. Your application will be refused if you do not send us the evidence or documents we ask for and do not contact us to agree an extension within the given time limit. On-site visits have been suspended due to coronavirus. If we need to visit, we will not decide the application until we are in receipt of the compliance visit report. These arrangements will apply until 30 September, when they will be reviewed."
  16. >>> COVI19 Updates The Home Office updated its Covid-19 guidance page on "visa applicants and temporary UK residents" to provide information on the situation post-31 July 2020: https://www.gov.uk/guidance/coronavirus-covid-19-advice-for-uk-visa-applicants-and-temporary-uk-residents#outside-uk Otherwise, the insider news are as follows: - The switching concession is still in place and applies to those whose leave expires in August i.e. after 31 July 2020. The position is not finalized for leave expiring after 31 August - There will be an update for those whose leave expired overseas who were unable to return to the UK because of the pandemic. Probably in the next month or so - The Home Office is still finalising the process to allow people to submit a picture where they have been told their biometrics can be re-used. It is hoped this will be in place within the month - UKVI will be putting these policies into the Immigration Rules, with retrospective effect, later this year. It is not clear yet as to which policies exactly will be in the Rules. - Free appointments - difficult to fine/book. The UKVI informs that the proportion of free appointments is roughly the same as before the pandemic but because overall capacity is reduced in absolute numbers there are fewer free appointments. - UKVI are aware the end-date in relation to the concession for the minimum income rule under Appendix FM needs to be amended and they will be doing so in light of today's other policy announcements - There are still no immediate plans to resume in-country priority services. The Home Office also wrote to ILPA and provided the following information: "We are writing to update you on the latest advice for those who have been in the UK and who have benefited from the automatic visa extensions in response to travel disruption because of the Coronavirus (Covid-19) outbreak. Since the outbreak of Coronavirus (COVID-19), the government has implemented a number of concessions to assist visa holders in the UK who have been impacted by global travel and health restrictions. This has included offering extensions of visas for those who leave expired between 24 January 2020 and 31 July 2020 and relaxing the rules on switching in the UK. This pragmatic approach has ensured that nobody is penalized for reasons beyond their control, however as global travel restrictions have started to lift, it is right that this generous, but temporary concession, be brought to a close. We recognize that people will need time to make arrangements to leave the UK and are taking a number of steps to continue to offer support for those who need it beyond 31 July. We will allow individuals a further month’s grace period, until the end of August 2020, to leave the UK, seek further leave, or apply for an indemnity to allow them to leave on a later date. During this grace period we will keep in place the relaxation of the switching rules to enable those who wish to stay in the UK to submit an application to enable them to do so. Additionally, during the grace period the conditions of stay in the UK will be the same as the conditions of leave. So, if an individual’s conditions allowed them to work, study or rent accommodation, they may continue to do so during August 2020 ahead of their departure. If an individual decides to remain long-term, and has not already done so, then they should apply for the necessary leave to remain in the UK. We recognize that during this period individual’s may have overstayed their leave due to the impact of the Coronavirus pandemic. Therefore, for individual’s whose visa or leave expired between 24 January 2020 and 31 July 2020 there will be no future adverse immigration consequences solely on the basis of any periods of overstaying leave that took place between 24 January 2020 and 31 August 2020. We will formalize this specific commitment within the Immigration Rules. We recognize that there will be some who, due to exceptional circumstances, will still be unable to return home before the 31 August 2020 and anyone who fits this exception should contact the CIT helpline. A compassionate and pragmatic approach will be taken to requests for an indemnity to allow someone to leave the UK on a later date. We hope that this update is useful for you and your members, clients and stakeholders.   21. Приятно удивил Home Office, быстро и положительно рассмотрев заявления клиентов из Украины по продление их виз по категории Tier 1(Entrepreneur). Заявление было подано 12 июня 2020 года. 28 июня 2020 года клиент и его семья сдали биометрику. Через 2 дня, 30 июня 2020 года заявления клиентов на продление их виз по категории Tier 1(Entrepreneur) были одобрены.

People who have previously had their visas extended under the coronavirus concession have until 31 August to leave. The UK BA guidance says that “You do not need to contact the Home Office to tell us you are able to leave the UK during the grace period up until the 31 August”. It is still possible to request additional time to stay, beyond 31 August, but rather than an automatic extension of leave the person can only request “exceptional indemnity”: "The indemnity does not grant you leave but will act as a short-term protection against any adverse action or consequences after your leave has expired." On the face of it, exceptional indemnity seems only to be available to those whose visas expired between 24 January and 31 July — not anyone with a visa expiring from 1 August onward. People requesting exceptional indemnity will need to have a good reason, supported by evidence, of why they can’t leave by 31 August. The guidance also allows people to apply for further leave to remain in the UK even “where you would usually need to apply for a visa from your home country”. This switching concession seems to apply to those who are in the “grace period” described above: it “includes those whose leave has already been extended to 31 July 2020 and the grace period until 31 August 2020”. It may not be available to those whose visas expire naturally on or after 1 August.
