  10. Заявления на продления супружеских виз, Украина vs Россия. Похоже, Home Office приоритезирует заявления граждан Украины. Подали 3 одинаковых заявления, 2 от граждан Украины, 1 - от гражданки РФ. Тип заявления FLR(M). У украинских клиентов заявления были более сложными, у гражданки РФ - стандартное заявление. Все заявления подавались через ускоренное рассмотрение за 1 день. Home Office заявления граждан Украины рассмотрел и одобрил за 1 день. Заявление же гражданки РФ Home Office не смог рассмотреть за 1 день и просто прислал Email с объяснением что не успевают рассмотреть за 1 день. Делюсь статистикой.

UKVI will work with your Immigration Sponsor to progress your visa extension. You’ll receive a notification from the Home Office that this concession applies to you." И "Visitors If you are a visitor The Home Office has introduced a temporary concession to allow Ukrainian nationals in the UK on a visitor visa to switch into a points-based route or a family visa route. If you are in the UK on a visitor visa and cannot return to Ukraine you can apply to switch to another visa. You will need to meet the requirements of that visa route and pay the associated visa fee(s)."

They are fitted on a person’s leg and must be charged daily. A bail condition requiring a person to wear a GPS tag can be combined with restrictions on their movements, including curfews and conditions on where they can go (called inclusion or exclusion zones).

It is decidedly negative, stressing the need to get consent — via the Foreign Office, in a prescribed manner — from the government of the country in question. Even if there is consent, the judge can simply refuse to allow it. Witnesses are strongly encouraged to give evidence in writing instead.

  18. Вчера вечером без предварительного объявления закрыли программу Tier 1(Investor) Собственно говоря: "A Statement of Changes to the Immigration Rules was published yesterday at 16:04 . The changes took effect at 16:00 yesterday (17 February 2022). The Statement introduced changes to Part 6A and Appendix A, closing the Tier 1 (Investor) route to new applicants. The Explanatory Statement provides the following: 7.1 The effect of this Statement of Changes in Immigration Rules is to close the Tier 1 (Investor) Migrant route, as set out in Part 6A of the Immigration Rules, to new applications. These changes preserve the ability of those who already have leave to enter or remain as a Tier 1 (Investor) Migrant to extend their stay in the route, including an applicant’s ability to make an application for entry clearance outside the UK if they have held leave as a Tier 1 (Investor) Migrant in the 12 month period preceding the date of application, and to apply for settlement. The Statement of Changes in Immigration Rules also makes consequential changes to Appendix A of the Immigration Rules, which concerns the awarding of points for the purposes of applications under this route. [...] 7.6 The Government intends to make future alternative provision for investment-related migration through reforms to the existing Innovator immigration route. This will make more targeted provision for investment-related migration, offering a route for entry and stay for overseas nationals with a track record of investment activity overseas and credible plans to engage in such activity. It is expected that these new arrangements will be delivered through further changes to the Immigration Rules in Autumn 2022.

Обратился клиент, у кого на границе Home Office изъял документ беженца после того, как клиент посетил страну, которую он не должен был посещать. Клиенту хватило только лишь одной online консультации (https://www.legalcentre.org/Konsultacija-s-Advokatom.html) со мной чтобы он смог добиться возврата своего документа из Home Office.

  23. Сегодня. Заявление клиентки на визу жены (Appendix FM Partner) гражданина Евросоюза с EU Pre-Settled Status (заключили брак после 01-01-2021). Подавали по ускоренному принципу рассмотрения. Заявление одобрили за 29 дней. Делюсь статистикой.

FE v HMRC (CHB) [2022] UKUT 4 (AAC) is about the right of Chen parents — the primary carers of self-sufficient EU citizen children — to claim benefits, in this case child benefit. The appellant FE is Nigerian. His daughter F is an Irish citizen with spina bifida. FE had the right to reside as a Zambrano carer, but this didn’t entitle him to child benefit: for that, he needed to be a Chen carer. To qualify under the Chen case, he would normally need to have “sufficient resources and comprehensive sickness insurance cover”, which the First-tier Tribunal determined that he did not. But F had, in December 2009, acquired the right of permanent residence under EU law. That complicated the picture: "The issue for me is whether, F having obtained a right of permanent residence by virtue of having previously been a Chen child, the appellant as her primary carer is required to have sufficient resources and comprehensive sickness insurance cover." The judge’s conclusion, as set out in the headnote, is that the appellant did qualify as a Chen parent until F turned 18, on 16 January 2020: "He had such a right until the latter date as the primary carer of his daughter F when a minor, in order to give useful effect to the right of permanent residence she enjoyed under art.16 of Directive 2004/38." As such, he was entitled to claim backdated child benefit up to that date, although not after F turned 18. >>> Anonymous appellants and secret hearings: https://www.judiciary.uk/publications/upper-tribunals-immigration-and-asylum-chamber-anonymity-guidance/ The Upper Tribunal (Immigration and Asylum Chamber) has updated its guidance on exceptions to open justice. Guidance Note 2022 No 2: Anonymity Orders and Hearings in Private runs to 53 paragraphs, twice the length of its 2013 predecessor, issued under President Blake. The note reminds judges: "Given the importance of open justice, the general principle is that an anonymity order should only be made by UTIAC to the extent that the law requires it or it is found necessary to do so." Situations where “the law requires it” include to protect alleged victims of sexual offences or human trafficking, or children involved in Family or Youth Court cases. Situations where it is “necessary” relate to human rights or the best interests of children. Such situations “may require the weighing of the competing interests of an individual and their rights (for example, under Articles 3 or 8 of the ECHR or their ability to present their case in full without hindrance) against the need for open justice”. Anonymity should not be granted merely because an appellant or witness has done something “social embarrassing” or committed a crime. The guidance note also covers applications to hold all or part of a hearing in private.
