  3. Заявление клиентки на основании того, что она мама британского ребенка. Тип заявления: FLR(FP). Заявление подавали по ускоренному типу (24-hour Super Priority Service). Заявление одобрили за 3.5 часа в день подачи. Клиентка сможет теперь подать на ПМЖ через 5 лет, а не через 10 лет (как обычно).
  4. Еще одна клиентка с Украины получила разрешение на въезд в Великобританию по схеме "Дома для Украины". Заявление одобрили за 7 недель. Делюсь статистикой.
  5. Часто положительные решения по заявлениям клиентов приходят несколько раз в день. Во второй половине дня получены одобрения по типам заявлений клиентов, например: рабочая виза, гражданство, спонсорская лицензия для работодателя. Делюсь статистикой ПОСЛЕОБЕДЕННЫХ одобрений заявлений клиентов.
  6. Еще одна успешная легализация украинского иммигранта без документов. Клиент прибыл в Великобританию без визы в 2015 году. В конце мая 2022 года было подано ЗАЯВЛЕНИЕ ВНЕ ПРАВИЛ по схеме Ukrainian Extension Scheme. Заявление одобрили за 8 недель. Делюсь статистикой ежедневных одобрений решений клиентов нашего Legal Centre.

  9. 26 July 2022 – Just useful and interesting UK & EEA Immigration Law news and updates from the Legal Centre – Open 7 days a week - www.legalcentre.org - +44(0)3300010342, +44(0)7791145923 (WhatsApp/Viber) >>> New law significantly expands possibilities for claiming British citizenship through a grandparent Section 4L of the British Nationality Act 1981 was brought into force on 28 June 2022, alongside the publication of an application form and guidance for applicants and separate guidance for caseworkers at the Home Office. It was inserted into the 1981 legislation by section 8 of the Nationality and Borders Act 2022. It says: "Acquisition by registration: special circumstances (1) If an application is made for a person of full age and capacity (“P”) to be registered as a British citizen, the Secretary of State may cause P to be registered as such a citizen if, in the Secretary of State’s opinion, P would have been, or would have been able to become, a British citizen but for— (a) historical legislative unfairness, (b) an act or omission of a public authority, or (c) exceptional circumstances relating to P. (2) For the purposes of subsection (1)(a), “historical legislative unfairness” includes circumstances where P would have become, or would not have ceased to be, a British subject, a citizen of the United Kingdom and Colonies or a British citizen, if an Act of Parliament or subordinate legislation (within the meaning of the Interpretation Act 1978) had, for the purposes of determining a person’s nationality status— (a) treated males and females equally, (b) treated children of unmarried couples in the same way as children of married couples, or (c) treated children of couples where the mother was married to someone other than the natural father in the same way as children of couples where the mother was married to the natural father. (3) In subsection (1)(b), “public authority” means any public authority within the meaning of section 6 of the Human Rights Act 1998, other than a court or tribunal. (4) In considering whether to grant an application under this section, the Secretary of State may take into account whether the applicant is of good character.”" Registration will make the person a British citizen “otherwise than by descent”.

The customer service standard on standard visa processing times for out of country applications is generally 3 weeks. Currently these processing times are taking longer. Visit visas are taking an average of 7 weeks - this was previously an average of 6 weeks Work visas are taking an average of 4 weeks – this was previously an average of 5 weeks Standard Student visa is currently within the normal service standard of 3 weeks Applications for family visas remains at 24 weeks These revised processing times are a global average, and we recognise that timescales may vary from region to region. Information has been updated on the Visa decision waiting times GOV.UK page and information will be provided throughout the customer visa journey.

  14. 21 July 2022 – Just useful and interesting UK & EEA Immigration Law news and updates from the Legal Centre – Open 7 days a week - www.legalcentre.org - +44(0)3300010342, +44(0)7791145923 (WhatsApp/Viber) >>> Statement of Changes to the Immigration Rules: https://questions-statements.parliament.uk/written-statements/detail/2022-07-20/hcws248 The Statement of Changes contains changes to Appendix Ukraine Scheme, as well as a corresponding change to the Introduction. It also makes changes to Appendix Private Life. All the changes will take effect on 10 August 2022. Appendix Ukraine The changes to the Homes for Ukraine Scheme are to encompass a child who is not applying with, or intending to join, their parent or legal guardian in the UK. The child applicant must have an “Approved sponsor” (with an amended definition for this in paragraph 6 of the Rules) who was approved for the child by a Local Authority before the application is made, and the applicant must provide evidence of that approval in the form of a reference number. The sponsor must have agreed to accommodate the child for at least 3 years or until the child is 18 (whichever is soonest), so long as they are sponsored for at least 6 months. The Approved sponsor must not have previously failed to meet the requirements for approval as a sponsor under the Homes for Ukraine Scheme under the guidance: “Homes for Ukraine - Applications to Homes for Ukraine for children who are not travelling or reuniting with their parent or legal guardian: Guidance for Councils”. If the child is applying to join or is accompanied by an adult relative, who qualifies under the Homes for Ukraine Sponsorship Scheme, the child and the adult relative must have the same Approved sponsor. Adult relatives include grandparents, uncles, aunts, or siblings in line with the definition in the Children Act 1989. The child must provide written parental consent to the child coming to live in the UK with the named sponsor and any adult relative who is applying with the child. The consent must be signed by at least one parent or the child’s legal guardian, and notarised or approved by: (a) the notary authorities or Guardianship service of the city/regional council in Ukraine; or (b) where the applicant is outside Ukraine, notary authorities or a Ukrainian consul. There were also technical amendments to remove the launch date of the Ukraine Extension Scheme from the Rules, and in UKR 17.1(b) clarifying that where a non-Ukrainian national is part of an immediate family group, it must include an immediate family member who is a Ukrainian national who has been granted under or is applying under and qualifies under the Homes for Ukraine Sponsorship Scheme. Appendix Private Life The amendments made to Appendix Private Life are to PL 6.1 and PL 8.1. PL 6.1 is amended to reflect the changes to the inadmissibility rules following section 16 of the Nationality and Borders Act 2022 coming into effect: Currently, PL 6.1. states ‘An applicant who has made a protection or asylum claim which has been declared inadmissible under Part 11 of these rules cannot meet the requirement at PL 5.1(b).’ From 10 August 2022 it will state, ‘An applicant who has made a protection or asylum claim which has been declared inadmissible under Part 11 of these rules before 28 June 2022, or under section 80B and 80C of the Nationality, Immigration and Asylum Act 2002, and which continues to be treated as inadmissible, cannot meet the requirement at PL 5.1(b).’ PL 8.1, which is eligibility for a private life route relying on Article 8 ECHR, is amended to fix a typographical/logical error, by including the following word “not”: ‘PL 8.1. If the applicant does not meet the suitability requirements (subject to PL 8.2), or does not meet any of the eligibility requirements in PL 3.1., PL 4.1. or PL 5.1. the decision maker must be satisfied that refusal of permission to stay would not breach Article 8 of the Human Rights Convention on the basis of private life.’ If a refusal would not breach Article 8, and a person falls for refusal under certain Appendix FM suitability grounds, the application on the private life route will be refused under PL 8.2.

"If your child applied without a parent or legal guardian, or did not apply to join them in the UK If your child has already applied under the Homes for Ukraine Scheme, they will not have received a decision because they did not apply with their parent or legal guardian or to join their parent or legal guardian. Now, their application will be assessed. To be eligible, you must have: - proof of consent by their parent or legal guardian notarised or certified by the Guardianship service of the city/regional council in Ukraine; or, where the applicant is outside Ukraine, notary authorities or a Ukrainian consul. - proof of consent from their parent or legal guardianship to the sponsorship arrangement - a commitment to sponsorship for 3 years or until the child turns 18 (so long as the sponsorship lasts at least 6 months) - approval of the sponsorship arrangement by the local authority where the child will live. If your child has already applied, you will receive a letter with instructions on what to do next. Children who have not yet applied without a parent or legal guardian will be able to do so soon. We will publish guidance about this in due course."   22. Из недавнего прошлого. "Место работы", иногда до 3-х дней в неделю, на протяжении 15 лет до 2019 года. Отделение Home Office для работы с заявлениями для личной подачи.
  23. Формально Правила 90 дней нет с 15-03-2022 == "Действительно после получения визы у вас будет 90 дней, чтобы ей воспользоваться, а по приезду ещё 6 месяцев для того, чтобы записаться на сдачу отпечатков пальцев и фото для карточки ВНЖ."

Customers who have an outstanding visa application submitted through the VAC in Rzeszow will be advised of the closure including where to collect their passports. Ukrainian nationals with a valid passport applying under the Ukraine Visa Schemes can complete their application online using the UK Immigration: ID check app without the need to attend a VAC. Home Office commercial partner, TLS, manages VAC appointment bookings.
