Суд (UK UT) постановил, что на беженцев распостраняются "другие" понятия/правила в отношении привоза партнеров по категории unmarried partners: Fetle (Partners: two year requirement) [2014] UKUT 00267 (IAC) Concerns Refugee Family Reunion applications with unmarried partners In contrast to the requirement of para GEN 1.2(iv) of Appendix FM, a requirement (such as in paragraph 352AA of the Immigration Rules) that “parties have been living together in a relationship akin to either a marriage or a civil partnership which has subsisted for two years or more” does not require two years cohabitation, but two years subsistence of the relationship. Whether the relationship still subsists, as required by the tense of that requirement and as may be separately required, is a different issue.<>

Государство не доверяет тем, кто переключается с T1PSW на T1E Подали заявление очередного клиента. Переход с Tier 1 PSW на Tier 1 Entrepreneur. Пришло стандартное письмо из UK BA о том, что заявление рассмотрят за 8 недель. Через пару дней пришло письмо что UK BA не рассмотрит заявление за 8 недель и что причины, почему так произойдет, будут присланы письмом по почте. В понедельник мне и клиенту пришли копии письма с приглашением на интервью клиента в UK BA. Я несколько месяцев назад был несколько раз на подобных интервью с другими клиентами (в тот раз заявители тоже переходили с T1PSW на T1E). В одном случае после интервью BRP карточка пришла через 7 дней, в другом случае – через несколько месяцев. В последнем случае я подавал протест и просил аннулировать интервью или провести другое, т.е. офицеры UK BA не правильно записали большинство ответов той клиентки и, честно говоря, вообще ничего не понимали в бизнесе. Например, не знали, что такое PayPal. Я детально описывал этот случай на форуме ранее. В этот раз условия интервью, исходя из требований UK BA, другие. Что изменилось : · Раньше интервью проводили в Лондоне, теперь – в Шеффилде (UK BA Passport Office) · Раньше интервью не записывалось на аудио носитель – теперь будет записываться · Раньше просили принести дополнительные документы (если заявитель хочет что-то дополнительное предоставить) на интервью, сейчас просят прислать их заранее · UK BA говорит, что интервью продлится в этот раз 45-55 минут – в прошлый разы интервью длилось около 2-х часов Делюсь опытом. Возможно, кому-нибудь пригодится.

Аккуратно ! Особенности работы Teleperformance Вниманию тех, кто заказывает т.н. дополнительные услуги у TP при подаче визовых заявлений. В понедельник один из клиентов подавал заявление на основании EU law (Surinder Singh) в Испании. Госпошлины нет, но клиент попросил оплатить обратную доставку документов курьером (12 с чем-то Евро). Оплатили по интернету через сайт в момент подачи основного заявления. Подтверждение по E-mail не пришло и на сайте TP просто написано, что “payment received”. В понедельник сотрудники TP попросили клиента показать подтверждение оплаты. Прислали screen shot с их сайта – TP сказали, что не подходит ! Уточнили на месте, мол, как Вам конкретно доказать, что оплата была произведена (не совсем так, т.к. они сами должны знать, кто им платил, т.к. оплата привязана к номеру GWF заявителя). TP попросили распечатку из банка с подтверждением того, что оплаты была произведена. Хорошо, что я был на связи, и смог сделать распечатку с банковского счета, заретушировать ненужную информация и по E-mail прислать клиенту «доказательство оплаты». Клиент показал на своем телефону копию банковской выписки с доказательством оплаты за возврат документов TP. TP это удовлетворило. Будьте бдительны с TP !

Important Upper Tribunal judgment in Shen (Paper appeals; proving dishonesty) [2014] UKUT 00236 (IAC). The Tribunal gives guidance as to the correct approach to be applied when the Secretary of State alleges dishonesty (reaffirming that the burden in on her to establish the assertion). It emphasises that such a finding is not to be made lightly, given the consequences for the applicant concerned. Shen (Paper appeals; proving dishonesty) [2014] UKUT 00236 (IAC) Headnote: (1) In terms of the approach that a tribunal should adopt towards decisions of the Secretary of State in which dishonesty or deception is alleged against an applicant for leave to remain, the starting point should be, as the Court of Appeal in Adedoyin (formerly AA (Nigeria) v SSHD) [2010] EWCA Civ 773 have made clear, that pursuant to paragraph 322 of the Immigration Rules, the reference to "false" means "dishonestly" false. (2) Where an application form etc is false in a material way, this may be relied on by the Secretary of State as prima facie evidence establishing dishonesty. The inference of deliberate deception can be strengthened by other facts: eg if a criminal conviction (not disclosed in an application) occurred shortly before completion of the application form. Here, the conviction must have been high in the applicant’s mind and any explanation based on oversight would carry little weight. But it is always open to an appellant to proffer an innocent explanation and if that explanation meets a basic level of plausibility, the burden switches back to the Secretary of State to answer that evidence. At the end of the day the Secretary of State bears the burden of proving dishonesty. (3) The internal organisational decision by the Secretary of State not to engage with paper appeals means that the appellant's evidence goes unchallenged. In that regard, it must be remembered, that in the absence of evidence from the Secretary of State putting the appellant's prima facie plausible explanation into doubt, it would be wrong to find dishonesty. Thus, in view of the possible evidential difficulties confronting a judge when deciding a paper application, where the appellant's evidence is not met (see para (2) above), a tribunal should be slow to find dishonesty, particularly without hearing evidence and submissions on the point from the appellant and/or the Secretary of State. (4) A finding of dishonesty can have catastrophic consequences for the appellant in social and economic terms and is not to be made lightly. Thus, in a paper case, if a judge entertains doubts as to the appellant's account, he or she should be mindful of the powers of rule 45 of the Asylum and Immigration Tribunal (Procedure) Rules 2005 to give directions regarding supporting documentary evidence, or for the Secretary of State to respond to the appellant's evidence as she considers appropriate.

This initiative will take place for up to six months subject to any internal evaluations. The aim is to ensure that customers are aware of how their case is progressing and has been developed in response to customer feedback who indicated they would welcome this communication. Customers will be able to provide their email address to us on newly amended application forms. Please note that updates will only be sent to those specified addresses and validated application forms. Please note that all current forms of postal communications will continue".

Обновленное PEO Solihull – отзыв Сегодня подавал с клиентом срочное заявление в PEO Solihull (продление визы мужа – клиент не успел сдать английский язык для ILR), брали слот буквально вчера-на-сегодня. Подавали в уже заново открытом PEO Solihull, которое теперь, кстати, зазывается Premium Service Centre Solihull (PSC Solihull). Внешне кроме вывески (пока на бумаге) не поменялось ничего см. фото. А вот внутри…Такое впечатление, что попадаешь в лобби маленького уютного 5 звездочного отеля. Все новое, подвесные потолки, приглушенный свет с каких-то дизайнерских приплюснутых люстр. Больше всего удивила мебель для посетителей. Всего 17 сидячих мест (поэтому нас предупредили, что пускают не всех, т.е. с заявителем может пройти только супруг и дети, (представитель не в счет)). «Группу поддержки» - мама, брат, сват, сосед, знакомый – не пустят. Вместо жестких металлических стульев как в PEO Liverpool, Croydon и т.п. – настоящие большие мягкие кресла со спинками и подлокотниками. Была проведена полная перепланировка помещения. Все выглядит очень уютно и, в какой-то мере, роскошно. Еще бы кофе разносили…шучу… За 2 часа, что я провел там сегодня, максимум видел 7 человек. К 13.30 в зале была всего одна пара. Сотрудники те же, за исключением 2-х новых sifting officers и 1 одного нового охранника. Зал подачи теперь более уютный и во время подачи четко видны столы case-workers, буквально метрах в 5. Т.е. все просматривается насквозь.

Еще один БОЛЬШОЙ плюс подачи заявлений через PEO Как обычно вчера (четверг) подавал несколько заявлений клиентов в PEO Liverpool. Одно из заявлений было по категории Tier 2 General – переход с одного работодателя на другого. После подачи этого заявления меня вызвала к себе caseworker и показала их внутреннюю запись из файла клиента, где в ИХ внутренней версии было сказано, что т.н. реклама была дали на 2 дня и ждали ответов от других потенциальных кандидатов всего 2 дня вместо 28 дней. Caseworker попробовала дозвониться до работодателя клиента по ИХ данным и там ей ответили что такого работника не знают. Если бы такое случилось бы в почтовом заявления, то это был бы практически гарантированный отказ. Я попросил у caseworker минут 10 для того, чтобы решить эту проблему, и мы с клиентом нашли дополнительные контактные данные работодателя, переговорили с ним, инструктировали его о том, что ему сейчас перезвонит caseworker и сказали, какие вопросы будут ему заданы. Как потом оказалось, документ UK BA при распечатке почему-то не показал всех данных, в частности, данных о том, что т.н. advertisement campaign было проведена не менее 28 дней. Caseworker при нас позвонила работодателю и через минут 7 сказала, что все в порядке. Через 30 минут нам выдали письмо о том, что заявление было одобрено. Еще один БОЛЬШОЙ плюс для подачи заявлений в личном визите. Делюсь опытом.

Отмена апелляций (за исключение по убежищу) и т.п. – Новый Immigration Bill Одним абзацем про то, что меняется в новом Immigration Bill (via Ilpa): "The Immigration Bill has not yet received Royal assent, but the final version of the text of the Bill has now been agreed by both Houses. The last vote was on deprivation of citizenship resulting in statelessness; it was lost in the House of Lords by 286 votes to 193, with the majority of peers satisfied that the Government had moved far enough by its introduction of both an obligation to review and, more significantly, a limitation of the power to cases where the Secretary of State “reasonably” believes that a person can become a national of another country. The other outstanding matter, guardians or “person advocates” as they look set to be called was not pressed after the Government promised something (although I am not entirely clear what) in the Modern Slavery Bill. The big changes we all need to gear up for include changes to removal (clause 1) and to rights of appeal – only appeals against asylum and human rights decisions will be left and then only on asylum and human rights grounds. Limitations to bail rights, the dreaded “residential tenancies provisions (if only in a pilot at first), new restrictions on health care, driving licences, bank accounts marriage, new powers to take biometrics, changes to the Office of the immigration Services Commissioner’s regime, new powers with respect to fees, and then the good news of amendments to British nationality law on illegitimacy – this is a wide-ranging bill. We have not walked away empty-handed from the debates on this highly politicised bill but there is still much to dread.".

Разъяснение UK BA по поводу студентов Tier4, кто являются директорами компаний. Был задан вопрос: “Tier 4 students are of course prohibited from being employed on a self-employed basis. Please can you confirm UKVI's position in relation to students who are classed as employed directors of UK companies who take salaries (NI/PAYE) as well as dividend payments. Are they entitled to work under the conditions of their stay?” Ответ UK BA (важное выделено): “The Immigration Rules gives the following definition of “Self-Employed” as follows: Under Part 6A of these Rules, "Self-Employed" means an applicant is registered as self-employed with HM Revenue & Customs, or is employed by a company of which the applicant is a controlling shareholder. Therefore, although he may not be registered as self-employed with HMRC, if he is a Director, you will need to check if he is a controlling shareholder. Anyone who owns 10% or more of the company’s shares would be a controlling shareholder.”

Разъяснение UK BA по поводу анкет FLR(FP) и FLR(O) В догонку о теме (не смог найти) насчет какую анкету подавать при продлении Discretionary Leave (DL), полученную до 09-07-2012. Оказывается, сам UK BA не знал. Из ответа UK BA: Unfortunately, some Validation Officers incorrectly requested customers to complete an FLR FP application form for an Active Review of Discretionary Leave (for those granted DL before 09-07-2012 having never claimed Asylum). The FLRO application form is the correct form to use when applying for an Active Review of Discretionary Leave. To address this issue we have invested in more training and provided Validation Officers with further application form guidance. Хоть честно сказали.

O&B v Mimister voor Immigratie, Integratie en Asiel C-456/12, Court of Justice of the European Union Европейский Суд Справедливости постановил, что на основании т.н. European law граждане из EU имеют право жить с/привозить членов своих семей, кто не сами не являются гражданами EU. Данное решение суда важно тем, что оно подтверждает что не только рабочие или самозанятые (employed and self-employed) граждане EU могут использовать прецедент Surinder Singh в интересах своих семей. Это решение суда так же бросает тень сомнения на принятые в январе 2014 года изменения в Immigration (EEA) Regulations в отношении версии трактовки UK BA заявлений по сценарию Surinder Singh (перенос центра жизни в другею страну и т.п.).

The government is making a package of changes to Points-Based System work routes to improve flexibility for applicants and help to boost economic growth. This includes expanding the Tier 1 (Exceptional Talent) category to include leading talent in the digital technology sector, who are endorsed by Tech City UK, as well as making it easier for applicants in this category to apply from overseas, and to count time spent in other immigration categories towards qualifying for settlement. I am responding to feedback from Higher Education Insti***ions (HEIs) participating in the Tier 1 (Graduate Entrepreneur) scheme by removing the ring-fencing of places for MBA graduates and the current restrictions on participants’ graduation dates. This will make the scheme more flexible and simpler to operate. In Tier 2, the main work route for those with a skilled job offer, I am improving flexibility for employers and migrants by allowing applications to be granted for up to five years at a time, rather than a maximum of three years at a time as at present. I am also today laying amending regulations which will ensure that changes to Tier 2 requirements are also applied to Croatian nationals. I am adding Oman, Qatar and United Arab Emirates to the list of countries whose nationals benefit from different documentary requirements and ending the exemption from the genuineness test that applies to nationals on this list when applying for a Tier 4 visa. I am also making scheduled updates to salary and maintenance fund requirements, as well as a number of other minor changes to Points-Based System categories. The maintenance fund changes will take effect for applications made from 1 July. I am creating a new category for overseas government sponsored language teachers under the Tier 5 Government Authorised Exchange route. This will enable government sponsored teachers to share knowledge and awareness of foreign languages and cultures in the UK. The first of these schemes will support a Mandarin teaching scheme designed to foster good cultural relations between the UK and China. I am making changes to the curtailment provisions in Part 9 of the Immigration Rules (General Grounds for Refusal) to support the Home Office in its work to take robust action against those who attempt to abuse the immigration system and ensure that migrants do not retain leave to which they are no longer entitled. In particular, I will: *incorporate the grounds in section 10(1)( and © of the Immigration and Asylum Act 1999 in preparation for the changes made by the Immigration Bill *enable leave to be curtailed where a Points-Based System sponsor notifies the Home Office that a migrant’s period of study or work is due to end earlier than had been originally planned when leave to enter or remain was granted *make further minor changes to ensure that the wording and the intentions of the rules are clear and consistent. I am making changes to the visit visa requirement for Bahraini nationals. Bahraini nationals who hold diplomatic and special passports issued by Bahrain when travelling to the UK for the purpose of a general visit will no longer have to obtain a visit visa to travel to the UK. The government keeps visa regimes under constant review to ensure that the UK has the right visa requirements set in the right places, aligned to risk. Today I am laying changes to the Immigration Rules to require all Venezuelan nationals to obtain a visa before visiting the UK. UK Visas and Immigration continues to be focussed on delivering an excellent customer service and ensuring that the UK maintains a competitive visa system that can innovate in order to ensure that Britain succeeds in the global race. In order to comply with the Supreme Court’s judgment in Munir, we are incorporating into the Immigration Rules discretionary policies for civilian employees of NATO and the Australian Department of Defence, and employees of firms under contract to NATO. I am making minor changes and clarifications to the Immigration Rules relating to family life. These mainly reflect feedback from caseworkers and legal practitioners on the operation of the rules. I am also clarifying the knowledge of language and life provisions which apply for settlement applications by partners and children of members of HM Forces.

Отказ-апелляция-досрочная победа v причины отказа. В прошлом году обратилась семейная пара (гражданка UK+ гражданин UA). UA раньше был женат на гражданке EU, развелся в UK, уехал домой уже после окончания визы. Встретил гражданку UK, через определенное время они расписались и подали на визу мужа. Пара ожидала ребенка. Получили отказ. UA обвинили в том, что он не был честен с UK BA и когда развелся, не сообщил UK BA о разводе, вернулся на Украину после окончания визы и поэтому UK BA посчитали, что у UA...фиктивный брак. Подали апелляцию со всеми имеющимися документами тогда (около 200+ страниц) в августе 2013. В конце прошлой недели пришло уведомление из суда о том, что Ответчик (Entry Clearance Officer - ECO) отозвал отказ. Делюсь опытом.

Sabir (Appendix FM – EX.1 not free standing) [2014] UKUT 00063 (IAC) It is plain from the architecture of the Rules as regards partners that EX.1 is “parasitic” on the relevant Rule within Appendix FM that otherwise grants leave to remain. If EX.1 was intended to be a free- standing element some mechanism of identification would have been used. The structure of the Rules as presently drafted requires it to be a component part of the leave granting Rule. This is now made plain by the respondent’s guidance dated October 2013. Kareem (Proxy marriages – EU law) [2014] UKUT 00024(IAC) a. A person who is the spouse of an EEA national who is a qualified person in the United Kingdom can derive rights of free movement and residence if proof of the marital relationship is provided. b. The production of a marriage certificate issued by a competent authority (that is, issued according to the registration laws of the country where the marriage took place) will usually be sufficient. If not in English (or Welsh in relation to proceedings in Wales), a certified translation of the marriage certificate will be required. c. A document which calls itself a marriage certificate will not raise a presumption of the marriage it purports to record unless it has been issued by an authority with legal power to create or confirm the facts it attests. d. In appeals where there is no such marriage certificate or where there is doubt that a marriage certificate has been issued by a competent authority, then the marital relationship may be proved by other evidence. This will require the Tribunal to determine whether a marriage was contracted. e. In such an appeal, the starting point will be to decide whether a marriage was contracted between the appellant and the qualified person according to the national law of the EEA country of the qualified person’s nationality. f. In all such situations, when resolving issues that arise because of conflicts of law, proper respect must be given to the qualified person’s rights as provided by the European Treaties, including the right to marry and the rights of free movement and residence. g. It should be assumed that, without independent and reliable evidence about the recognition of the marriage under the laws of the EEA country and/or the country where the marriage took place, the Tribunal is likely to be unable to find that sufficient evidence has been provided to discharge the burden of proof. Mere production of legal materials from the EEA country or country where the marriage took place will be insufficient evidence because they will rarely show how such law is understood or applied in those countries. Mere assertions as to the effect of such laws will, for similar reasons, carry no weight. h. These remarks apply solely to the question of whether a person is a spouse for the purposes of EU law. It does not relate to other relationships that might be regarded as similar to marriage, such as civil partnerships or durable relationships. Amends the Immigration (Employment of Adults Subject to Immigration Control)(Maximum Penalty) Order 2008 to increase the maximum penalty which may be imposed by the Secretary of State under section 15(2) of the Immigration, Asylum and Nationality Act 2006 on an employer who acts contrary to that section in the employment of an adult subject to immigration control to £20,000. Applying for extension of stay or indefinite leave to remain Forms FLR(M), SET(M) and SET(F) fiancé(e) of a British citizen or settled person; civil partner or proposed civil partner of a British citizen or settled person; spouse of a British citizen or settled person; unmarried partner of a British citizen or settled person; same sex partner of a British citizen or settled person; or child or other dependant relative of a British citizen or settled person. Applying for British citizenship Forms AN and MN1 spouse of a British citizen; civil partner of a British citizen; child of a British citizen parent. The photocopy must include all pages of the passport, including any blank pages, and we will verify it with other government departments in accordance with the Data Protection Act 1998. We may request the original document at any time during the application process, and the application will be refused if you do not comply. You must still submit your own original passport or travel document as part of your application.
