Если человек готовит заявление сам, нужно обычно полагаться на первоисточники. Читать Rules, Guidance. Иногда поднимать immigration archives. Иногда полагаться на судебные решения. Возможно, в других странах иммиграционные процедуры проще. Великобританхия же считается самой сложной страной по количеству существующих Правил, исключений из Правил и т.п. Сейчас меняются Правила по всем категориям. И то, "что Ира сделала сама в прошлый раз может не пройти у Тани сейчас". А сколько семей распалось из-за отказов ? Я эту печальную статистику вижу лучше, чем любой здесь, скорее всего. Хотя не все так печально. На форуме есть Игорь 'Fregat' и я 'British Lawyer'. Мы лично знаем друг-друга уже лет 20, наверное, и помогли такому количеству форумчан и их родственникам что, наверное, хватило бы заселить небольшой город.

Почитал форумы, "подумал что все, понял", и сам подал заявление. Сроки прошли, решения нет. Заволновался. Начали разбираться - записался на консультацию. Посмотрел я анкету...и началось...Забыл то-то и то-то указать (не смертельно). Забыл указать штраф (это уже плохо), и так еще список из нескольких важных пунктов. Он был не уверен, но решил рискнуть и подать без уточнения сложных вопросов. Буду помогать (С). В итоге стоимость получения статуса для него увеличивается...

Только что получил черновик по новой иммиграционной программе для студентов - Graduate Immigration Route. Одним предложением: эта программа позволяет иностранным студентам остаться на работу в Великобритании на 2 или 3 года после окончания обучения в Великобритании без спонсорства со стороны работодателя. Еще одна семья из Украины завершила их иммиграционный путь в Великобритании. Эта рабочая неделя завершается еще двумя положительными решениями по заявлениям клиентов из Украины по натурализации. Сроки рассмотрения были те же, что и по 3-м одобренным заявлениям вчера, т.е. в течение 8-и недель. Делюсь статистикой.

The guidance applies to those who left the UK before 17 March 2020 when FCO travel guidance changed and who had, or are seeking to apply for, leave on an eligible route. Visitors are not eligible under this concession. To be eligible, a person must meet the following eligibility requirements: they left the UK before 17 March 2020 their leave expired and they were unable to return to the UK before its expiry due to COVID-19 travel restrictions they intend to return to the UK once confirmation they are eligible is given by UKVI, not less than 21 calendar days’ notice of their date of travel, unless either: - they cannot travel because travel restrictions remain in place - they choose not to travel due to a COVID-19 risk to themselves or their family, for example, showing symptoms, a requirement to self-isolate or being high-risk and unable to travel Provided the eligibility criteria are met, authority for the passenger to travel without a visa will be processed by Border Force to allow travel under the concession scheme. After the Border Force Officer is satisfied the criteria are met (following the completion of identity and security checks) people will be granted leave outside of the Immigration Rules for 3 months with the same conditions as their previous grant of leave. People will not be able to leave and re-enter the UK under the same concession. UKVI will communicate with all those who have contacted the CIH regarding their leave expiring while they were outside the UK and outline the next steps for returning to the UK to make their leave to remain application. It should also be noted that there is an exceptional circumstances section of the guidance. It gives examples of exceptional circumstances that may justify consideration under the scheme even if the eligibility criteria are not met (see page 8).

Guidance for Home Office asylum caseworkers was published the day before, on 31 December, fleshing out some of the operational details. What is not in the policy document is as revealing as what is. The headline is that any person who travelled to the UK through a safe country will have their asylum case declared inadmissible and in theory face removal to any other safe country around the world willing to accept them. The likely reality of what happens in practice is very different: more delays in the asylum process and very few if any third country removals. The overall impression is that the rules are completely unworkable as they stand, even if there were removal agreements with other countries. Which there are not, and a person cannot be sent to a country of which they are not a citizen without the agreement of that country. The rules build in an automatic period of delay in the processing of new asylum claims and are replete with opportunities for legal challenge. The civil servants who drafted them expect the rules to be “workable” in the sense of removals actually taking place to safe third countries. The rules are about politics and presentation, not governance.

С 1-го января 2021 года к Вам автоматически применяются правила по "визе жены британца". То есть нужно доказать иммиграционный статус спонсора, его доход, сдать тест на туберкулез, тест по английскому языку, иметь соответствующее жилье в Великобритании, заплатить госпошлину и т.н. NHS Surcharge fee и многое другое. Обратите внимание.

Добрый день, Рад был Вам помочь тогда. Насчет документов. Можете приложить все, что есть. Приоритет за P60, wage slips, SA302, Tax return, GP и т.п. У некоторых клиентов только utility bills & bank statements были - вопросов не возникало. Правда, я вел дело и писал письмо от себя как от адвоката, объясняя ситуацию и т.п.

Порадовал Home Office под Рождество. Вот как выглядит решение о получении ПМЖ (ILR - Indefinite Leave to Remain) вне Правил (Outside of the Rules). Детали дела я сообщал раньше. Вкратце, человек подавал на ILR пробыв в Великобритании всего пару лет как выживший супруг скончавшегося главного заявителя, кто до этого приехал в Великобританию по категории Sole Representative of an Overseas Business.
