  2. Приветствую, До 180 дней в году. А если хотите получить гражданство UK без задержек, то не более 90 дней в году.
  3. Получил утром E-mail из UK BA о том, что они одобрили заявление моего клиента на ПМЖ (ILR) по категории Tier 1 (Entrepreneur). И буквально через час курьер DX принес ILR BRP карточку этого клиента. Пару других интересных случаев. Обратился клиент (как он сказал, до этого обращался к юристам из Сити, платил за консультации по 300-1300 фунтов (!)); в итоге ему все отказвались помочь. Он прибыл в Великобританию как член семьи гражданки Евросоза. После 5 лет проживания в Векликобритании по ошибке подал не ту форму, и вместо ПМЖ получил продление визы на 2.5 года по т.н. 10 year route to settlement. То есть формально клиент перешел с EU law на UK immigration law в отношении своего иммиграционного статуса. Я согласился помочь клиенту и подал заявление от его имени в UK BA и попросил выдать клиенту ПМЖ ретроспективно несмотря на то, что он уже изменил свою визовую категорию. Вчера пришла его Permanent Residence BRP на основании EEA law. Так же на этой неделе получил визу ПМЖ ребенок клиентки из Украины, кто до этого обращалась в какое-то агенство на Украине и кто дал клиентке обсолютно неправильный совет на основании которого ребенок тогда получил отказ. Я подключился, оформил документы буквально за пару недель по категории Sole Responsibility. Подавали по ускореенному варианту, т.е. Priority Consideration. Ребенку выдали визу для приезда к маме.
  4. Интересная тенденция в последнее время. Образалась женщина в свое время на консультацию. Хотела подавать на ILR на основании 10 лет, но было БОЛЬШЕ отсутствий чем можно по правилам. Не рекомендовал подавать на ILR - не послушалась - у нее еще был ребенок из EU от другого брака. Решила все сделать сама... Вместо ILR получила вместо ILR продление на 2.5 года (Если бы не ребенок - отказали, скорее всего). Вчера звонила - просит помочь с апелляцией...
  5. По EEA Family Permit в контексте вопроса только супруг может и быть спонсором обычно (EEA Law, Direct Family Member, EEE Regulations 2016).
  6. Заполнять нужно как можно раньше если хотите получить слот в личном визите. Например, по Tier 2 и Tier 4 - они ввели on-line полностью уже года 3 как тому назад. Заполняете и подаете анкету, потом выбираете опцию подать в личном визите или отослать по почте. Оплачиваете.
  7. Приветствую, По Швецкому ПМЖ лучще узнать у месных юристов. По EEA Law для UK. Если Ваш муж - гражданин EU -можете переехать. Если никто из Вас не имеет паспорт EU - не можете переехать.
  8. Подготовить детальное письмо от спонсора и родителей.
  9. Действительно, буквально пару дней назад появились on-line формы для SETM, SETO и др. Как я понимаю, on-line форму можно использовать до 45 дней в случае подачи заявления в личном визите. Если буде испольщовать on-line форму для подачи на ILR - дайте знать, как проходил Ваш процесс. Вы своего рода (будете) первопроходцем. Я пока использую бумажные формы, тем не менее планирую переход на on-line формы со временем.

  13. Работать нужно обоим на протяжении всего периода развода для получения "визы" на основании Reg 10(5)(a).
  14. В очередной раз доказано, что <noindex>лучше и безопаснее подавать заявления в личном визите</noindex> чтобы за один день (обычно 2-3 часа) получить положительный <noindex>результат</noindex> и <noindex>новую BRP</noindex> через пару дней. Год назад обратился клиент на консультацию. Планировал подавать на ILR по правилу 10 лет (студент + рабочая виза). Я рекомендовал подать в личном визите и <noindex>получить ILR за 1 день</noindex>. Человек не послушался моей рекомендации и подал по почте. Дело рассматривали 1 год, и за это время его работодатель потерял лицензию. Человек получил отказ. Ситуация сложная, потеряно время и деньги. Я смогу ему помочь. Мораль: Очень многие иммиграционные проблемы возможно избежать, подав заявление в личном визите. Я в этом регулярно убеждаюсь, подавая заявления форумчан и не только в личном визите уже более 15 лет.

The new guidance says that a bail hearing will be listed “as soon as possible, normally within three working days”. That does seem a bit ambitious. Only time will tell how readily the tribunal’s already stretched resources can cope with the bout of new cases which the expedited bail system and the automatic referral provisions will trigger. The guidance also requires (in accordance with the Tribunal Procedure Rules) that the Secretary of State produce a bail summary in advance of the hearing and a copy of any removal directions. It will be useful to see how strict judges are in implementing this part of the Procedure Rules. In my experience, the Home Office routinely fails to provide any such summaries or copies of removal directions with little or no consequences.

As the UK intends to introduce the new technology during 2016 the date restriction affects only BRPs issued to adults with settled status (ILR/NTL). Any BRP rightfully held on 01 July 2024 that is restricted will be replaced free of charge, with the balance of the 10 year period initially expected being issued on a new BRP. This means that anyone who has paid a fee in expectation of receiving ten year evidence of settled status will still do so, but it will be spread over two BRPs. The date restriction does not change the entitlements of the rightful holder to work, access services/benefits or travel. The rightful holder still has settled status.”"

The UK BA has not yet updated their Guidance. At the same time the UK BA is aware of this the UK BA intends to shortly update their rules and guidance to reflect the change. The job adverts posted on either Universal Jobmatch (before it closed and which are still within the normal timescales) or the new Find a Job service can be used for the purpose of satisfying the Resident Labour Market Test. From the UK BA: “Transitional arrangement won’t be needed. We plan to update the Rules and guidance in the next scheduled update abut in the meantime, references to Universal Jobmatch should be interpreted as including its successor ‘Find a job’. We’ve been advised that ‘Find a job’ will be available to employers from 14 May. No new jobs can be posted on Universal Jobmatch after 17 May, however as Universal Jobmatch won’t close until 18 June, the resident workforce will still be able to view advertisements placed on it for 28 days. After 18 June the adverts will disappear as they aren’t being migrated to the new platform. As always, sponsors will be required to retain evidence: Where the vacancy has been advertised online through Jobcentre Plus or Jobcentre Online, you must keep a screen shot from the relevant government website on the day the vacancy is first advertised which clearly shows all of the following: • logo of the relevant government website hosting the job advertisement • contents of the advert • vacancy reference number for Universal Jobmatch vacancies this is the ‘Job ID number’ and for Jobcentre Online this is the Job Reference number • date • URLfor Universal Jobmatch vacancies this also contains the Job ID number • closing date for applications Note: the GOV.UK website will, over time become the main portal for government services and information in the UK.
