Въезд в UK с просроченной визой из-за COVID19 >>> COVID19 and Immigration update Have you got a 30 days vignette to enter the UK which has already expired ? In some cases the clients were able to enter the UK after their 30 days vignette expired. At the border the clients were provided with the lawyer's letter explaining the circumstances and the UK Immigration Services never had an issue with that and always accepted their delay. That said, these steps must be taken with acceptable of the potentially high risk that the airline may not allow the client to board the plane or even a different UK Immigration Office may not exercise discretion next time and admit the person into the UK.

Тема: COVID 19 и иммиграция В принципе, практически те же вопросы/новости, что я публиковал раньше, за исключением этого: - Биометрические центры и/или центры по сдаче английского языка могут не открыться до июня 2020 - В ближайшее время Home Office должен опубликовать детальные инструкции в отношение тех заявителей, кто должны подать/подали заявление без тестов по английскому языку и т.п. важным документам, т.к. тестовые центры закрыты из-за COVID19

Несмотря на COVID19 Home Office продолжает принимать иммиграционные заявления. Вот копия Email из Home Office после подачи заявления клиентки на натурализацию (заявление AN). Это так называемый Certificate of Applicaion (CoA): То есть на данном этапе Home Office принимает заявления (= растет очередь; кто первый подал, того первым и рассмотрят), но записаться на сдачу биометрики и загрузить документы на сайт Home Office пока нельзя т.к. закрыты центры коммерческого партнера Home Office - Sopra Steria. Хотя у одних из коллег произошел интересный случай - они подали заявление клиента по категории Tier 2(General), и его рассмотрели сразу же даже без биометрики и загрузки документов их клиента.

On 28 October 2016, the appellant was convicted of dishonestly making false representations. He tricked an elderly vulnerable woman into allowing him access to her bank account and emptied it of £20,000 to £30,000 for his own use. He was sentenced to 2 years imprisonment. The Court of Appeal upheld the decision to remove the Appellant.

Приветствую, Тест сдавать нужно если Вы хотите остаться на категория "виза жены британца - ПМЖ через 5 лет" а не "спуститься" на категория "виза мамы британских детей - ПМЖ через 10 лет". Уровни тестов отличаются для въезда, продления и ПМЖ. Какой точно тест/уровень Вы показывали для получения первой визы жены ? Когда точно был сдан тест ? Остался ли тестовый центр в списках Home Office ?

Около 1 миллиона просмотров за 10 лет на русскоговорящих форумах Обратил внимание на количество просмотров моих постов только в основных темах "Иммиграционные новости" на разных форумах, которые я модерирую/курирую. А если добавить отдельные темы на этих форумах и FaceBook - то еще больше. Вышеуказанная статистика исключает участие на англоговорящих форумах FreeMovement и Immigration Boards.

Да, Home Office иногда "радует" - Отмена возможности продлить визу Tier 1(General). Были даже самоубийства - на WorkPermit писали от этом. Потом судебным путем программу восстановили: https://www.bailii.org/ew/cases/EWHC.../2008/664.html Я тогда почти каждый день в Home Offie с клиентами ездил - статус восстанавливали. Некоторые даже из-за рубежа приезжали восстанавливаться - Когда лет 6 тому назад TOEFIL "закрыли", несмотря на то, что я на форуме это объявил, народ продолжал "сыпаться" на этом и получать отказы: https://dailybruin.com/2019/05/13/th...nt-hear-about/ Последний раз - аж в 2018 году - "кара" TOEFIL настигла человека. При продлении визы жены Home Office вытащил копию сданного давным-давно TOEFIL... - В 2012 году - когда отменяли правило легализации через 14 лет и вместо этого вводили правило 20 лет. Успел предупредить, кажется, всех, кого смог - "Закрытие" программы Инвесторов. Home Office перепутал сроки и программу (!). Вот тут Вы бы видели панику. Обошлось. Но телефон раскалился от звонков секретарей инвесторов. - Сейчас Home Office ждет не дождется, когда закроется "лазейка" Surinder Singh route. Т.е. привоз родителей и супругов по EU Law. Бесплатно, т.к. нет госпошлины. Все пока возможно до 31-12-2020...Если из-за COVID19 не продлят действие переходного периода BREXIT. - "Планирование" Home Office(ом) лет 10 тому назад ввести "отработку" перед получением гражданства - типа community service. Упоминалось 50 часов. Объявленный план не нашел поддержки в Правительстве и был спущен на тормозах. Были и супер полезные новости - Опять же, лет 10-11 тому назад я случайно нашел не задокументированную Policy о том, граждане Украины, Молдовы, Армении и Азербайджана и члены их семьи могли получить ПМЖ (ILR) бесплатно по рабочим категориям (Work Permit, Tier 2, Tier 1). Сколько сотен клиентов тогда смогло сэкономить тысячи фунтов на госпошлине в личном визите в Home Office ! Кстати, в то время клиенту не нужно было приезжать со лично в Home Office. Помню, что я мог тогда получить ILR клиенту за 45 минут (визы тогда клеили еще) с момента захода в здание Home Office. И тогда же был получен "хит сезона", когда одному и тому же клиенту визу c ILR смогли правильно вклеить в текущий паспорт только с третьего раза. То есть до этого 2 раза вклеили визу с ILR раз за разом в...старый просроченный паспорт. Вы бы видели лица caseworkers в тот момент. - Лет 12 тому назад при тщательно анализе Правил я нашел возможность продления т.н. SBS визы ("сбор грибов/работа на мясо заводах"). Даже удалось это сделать в личном визите в наше местное отделение Home Office. Помог большому количеству заявителей, пока Home Office не сообразил, что происходит что-то не то, и они закрыли эту возможность. - Лет 15 тому назад при тщательном анализе Правил я нашел возможность перехода с гостевой визы на визу Unmarried Partner. Помог нескольким заявителям, пока Home Office не сообразил, что происходит что-то не то, и они закрыли эту возможность. В общем, есть что вспомнить.

14 April 2020 – Just useful and interesting UK & EEA Immigration Law news and updates from the Legal Centre – Open 7 days a week - www.legalcentre.org - +44(0)3300010342, +44(0)7791145023 (WhatsApp/Viber) >>> Reasonableness, removals and children back in Court of Appeal spotlight: https://www.bailii.org/ew/cases/EWCA/Civ/2020/514.html The vexed issue of reasonableness, removals and children is back in the judicial spotlight once more in a new Court of Appeal ruling, Runa v Secretary of State for the Home Department [2020] EWCA Civ 514. The case involved an appeal against a refusal to grant Ms Runa, an overstayer, leave to remain in the UK, even though she was married to a British citizen and had two British children under the age of four. The Court of Appeal stressed the critical importance of addressing the question of whether it is reasonable to expect children to leave the UK in such circumstances, building on a stream of recent cases tackling the same issue. Ms Runa’s case The background to the latest Court of Appeal case is that Ms Runa had been brought to the UK in 2006 from Bangladesh at the age of 14 on a visitor visa. She had lived here without leave ever since. An application to remain in the UK based on her marriage was refused in 2015. By the time her appeal came before the First-Tier Tribunal in 2016, the couple’s first child had been born. Ms Runa won her appeal at this first stage but the Home Office took the matter to the Upper Tribunal. By this time, Ms Runa had given birth to a second child. The Upper Tribunal agreed with the Home Office. It said the First-Tier Tribunal had failed to give proper reasons for its decision and dismissed Ms Runa’s appeal. She took her case to the Court of Appeal. The Court of Appeal’s decision Firstly, the Court of Appeal rejected the suggestion that section 117B(6) would always mean that wherever one parent has the right to live in the UK and the other parent does not, it will be unreasonable to expect the child to leave the UK: "If Parliament had intended to enact such a rule of law, it could easily have said so. Section 117B(6) does not enact a rule of law but rather calls for a question to be asked and answered on the facts of each particular case." It also laid to rest a question raised in other cases: whether section 117B(6) is a standalone provision or whether it should be read as part of a broader human rights assessment. The Court of Appeal was clear that section 117B(6) must be read as a self-contained provision. This is because a parent’s conduct would inevitably play a role in any broader human rights analysis of the public interest – thereby conflicting with KO Nigeria’s direction that parental conduct is irrelevant to the section 117B(6) question. The judgment clearly stated that the “the only question is focussed on the child: would it be reasonable to expect the child to leave the UK?” It said that if the answer to that question is “no”, then that is the end of the matter. But if the answer is “yes”, then there is still scope for a further exploration of human rights law set out in Article 8 of the European Convention on Human Rights. This would be a separate analysis, however. Turning to the facts of Runa, the Court of Appeal found the Upper Tribunal had gone astray in its approach, by asking the wrong questions. Instead of asking whether it would be reasonable for the children to leave the UK, as required by section 117B(6)(b), it had instead asked: "whether it would be reasonable for the children to remain in the UK without their mother, and whether there would be “insurmountable obstacles” to maintenance of the family unit outside the UK, which was irrelevant. Having failed to ask the right question, the Court of Appeal said, the Upper Tribunal had naturally failed to make the appropriate findings of fact in its decision. Unfortunately for Ms Runa, this meant that despite succeeding in her challenge, the Court of Appeal decided to send her case all the way back down to the First-Tier Tribunal to make those findings of fact again. Meanwhile, the decision is to be welcomed in the broader legal context. It clears up any lingering uncertainty over the interplay between human rights law and sections 117B and 117C, and shores up the Supreme Court’s direction that children should not be blamed for a parent’s actions.

Иммиграционная "ловушка" - анкета FLR(M) - "виза жены" Очередной раз удалось предотвратить иммиграционную катастрофу. Наверное уже в сотый или более раз. Обратилась очередная клиентка за проверкой ее заявления по нашей услуге https://legalcentre.org/proverka-zayavleniy.html Клиентка попробовала подготовить сама свое заявление на продление визы жены британца и строго все делала по информации, например, из online анкеты. В частности, клиентка увидела, что в анкете спрашивается, сдала ли она тест на уровне A1 ? Клиентка ответила что, сдала и хотела использовать свой ранее сданный тест A1 для продления ее визы жены. См. графику ниже. На самом же деле, online анкета содержит ошибки, одна из которых фактически гарантирует отказ - анкета "не понимает", в первый раз заявитель подает заявление на (переход) на визу жены или подает на продление визы жены. Проблема в том, что для перехода на визу жены нужен уровень A1 по английскому языку, а для продления - уже уровень A2. Теперь клиентка работает над получением нужного сертификата по английскому языку, благо у нее есть еще несколько месяцев по ее текущему BRP. Я помог ей и могу помочь Вам. 10 April 2020 – Just useful and interesting UK & EEA Immigration Law news and updates from the Legal Centre – Open 7 days a week - www.legalcentre.org - +44(0)3300010342, +44(0)7791145023 (WhatsApp/Viber) >>> Employers urged to apply now for licence to sponsor overseas workers once free movement ends: https://www.gov.uk/government/publications/uk-points-based-immigration-system-employer-information/the-uks-points-based-immigration-system-an-introduction-for-employers Under the new immigration system planned to kick in from January 2021, the minimum skill level needed to be sponsored for a general work visa will be reduced from RQF level 6 to RQF level 3. This means that jobs which are considered to be A-level standard can be sponsored, instead of the Bachelor’s degree qualifications which are required now. The proposals are solely to do with economic migration: family migration, asylum and students are unaffected. They are — very optimistically — supposed to come into effect from January 2021. Skilled workers The system would introduce a limited element of flexibility in sponsored work visas (currently branded Tier 2, although the language of “tiers” is virtually absent from the policy paper). Sponsored workers would still need a job offer, English language skills and to be working at a certain skill level. That skill level would be reduced from level 6 (degree) to level 3 (A-level), as was also the case under the December 2018 white paper proposals. There will still be a minimum salary required for a work visa. The headline salary threshold has been reduced to £25,600, in line with the Migration Advisory Committee’s recent recommendation. But it will no longer be the absolute minimum: some workers earning between £20,480 and £25,600 would still be able to get a visa, but only if they are highly qualified or working in shortage jobs. So in effect, the minimum salary for a UK work visa will be £20,480 for people working in jobs on the Shortage Occupation List or who have PhDs in science, technology, engineering or mathematics. It will be £23,040 for people with a PhD outside these subjects but nevertheless “relevant to the job”. For people with none of these characteristics, the minimum will be the headline £25,600. What about the proposal to scrap the annual cap on these work visas? That does reappear, although the word used is “suspend” rather than “abolish”. The Resident Labour Market Test will also go. The paper adds: "There will continue to be different arrangements for a small number of occupations where the salary threshold will be based on published pay scales. We will set the requirements for new entrants 30% lower than the rate for experienced workers in any occupation and only use the base salary (and not the allowances or pension contributions) to determine whether the salary threshold is met." Lower-skilled workers There will be no visa route for “lower-skilled” workers. This is a change from the 2018 white paper, which had grudgingly proposed a system of 12-month work visas for people who do not meet the skills threshold outlined above. This would have been “for a transitional period after the UK’s exit from the EU”. The paper also says that “we have committed to expanding the pilot scheme for seasonal workers in agriculture which will be quadrupled in size to 10,000 places”. So there will be visas for strawberry pickers, but not for care home workers. Highly skilled workers The Government proposes adding a new “unsponsored route” for the highly skilled alongside Tier 1 (Global Talent), with eligibility determined by personal characteristics: "Example characteristics for which points could be awarded include academic qualifications, age and relevant work experience." But in light of bitter experience — the MAC pointed out that the Home Office itself had come to loathe truly points-based visas like Tier 1 (General) — the paper says that “this route will take longer to implement”. It adds that “we want to learn from previous experience of similar schemes in the UK that have highlighted certain challenges. The scheme will need to be designed to make sure it adds value and does not undermine the skilled worker route or create opportunities for abuse”. It may be doubted whether it will ever come to pass. What now? The most telling line of this paper is that “The Home Office will publish further detail on the points-based system in due course”. Further detail is practically overdue already: these broad brush strokes must now be translated into detailed Immigration Rules and procedures in time for January 2021. The Rules themselves are due for a general rewrite in line with Law Commission recommendations; the policy paper says that the government will be responding to these recommendations “shortly”. >>> Government: we don’t want “low-skilled” workers after the pandemic: https://www.gov.uk/guidance/new-immigration-system-what-you-need-to-know?utm_source=76048cea-190a-4cfd-9041-422016fbfe97&utm_medium=email&utm_campaign=govuk-notifications&utm_content=immediate#lower-skilled-workers What a moment for the Home Office to update its guidance on the new immigration system to reiterate: "There will not be an immigration route specifically for those who do not meet the skills or salary threshold for the skilled worker route." Basically, in the midst of the COVID-19 crisis, the Home Office felt it necessary to state that care workers, nurses, hospital porters, cleaners, logistics personnel, postal workers etc will not be able to apply for a UK work visa from January. The only “low-skilled” workers that the government envisages letting in are agricultural labourers. На данном этапе Home Office не рекомендует подавать оригиналы документов и можно будет послать копии т.е. Valuable documents (passports, BRP, Birth certificates). “Guidance re: paper applications The Euro, Settlement and the EU Settled Status Customer Resolution Centre currently informs that: "We are still accepting paper applications although we are asking applicants not to send valuable documents - we will ask for anything if needed, and this won’t have a detrimental impact on the application. We do have a skeleton staff in the office to deal with paper applications ( following all the guidance on social distancing)" The Home Office are looking at other which are yet to be announced."

08 April 2020 – Just useful and interesting UK & EEA Immigration Law news and updates from the Legal Centre – Open 7 days a week - www.legalcentre.org - +44(0)3300010342, +44(0)7791145023 (WhatsApp/Viber) >>> Ten-minute asylum interview enough to meet ECHR obligations before removal: https://hudoc.echr.coe.int/eng#{"itemid":["001-201870"]} In Asady and Others v Slovakia (application no. 24917/15) the European Court of Human Rights has delivered another judgment that will gratify governments seeking to use summary removal to get rid of asylum seekers. The decision continues the court’s retreat over the interpretation of Article 4 of the Fourth Protocol to the European Convention on Human Rights (ECHR), which is meant to prohibit mass expulsions. The issue in Asady was a factual dispute between a group of Afghans and the Slovak government. The Afghan men complained that when encountered by Slovak police near the Ukraine/Slovakia border, the police had ignored their requests to claim asylum. After a perfunctory series of interviews they claimed to have been removed to Ukraine within 24 hours of entering Slovakia. The Slovaks asserted that in fact each individual had been provided a full opportunity to claim asylum at an interview with an interpreter but had chosen not to. Therefore the immediate group removal was acceptable because each person had been considered as an individual. In an appeal at domestic level, the Slovak border police directorate found in favour of the police. At the European Court of Human Rights, the Slovak police were once again vindicated. The majority, in a court split 4-3, were happy to accept that a ten-minute interview would be sufficient for the police to explain the asylum system to each person and to check whether there were any reasons not to proceed with removal to Ukraine. Experienced practitioners might doubt whether they would be able to achieve this in ten minutes through an interpreter, but the Strasbourg court clearly has greater faith in the Slovak police. The majority also noted that the applicants had not provided any details about their asylum claims at any later stage. Judge Lemmens (who also recently dissented in defence of Afghan asylum seekers in another recent case) joined Judges Keller and Schembri Orland in a dissenting opinion. They identified problems with the evidence provided by the Slovak police: most importantly, the recorded interview times frequently overlapped, but there was only one interpreter present. They also observed that many of the men had subsequently been granted asylum in other countries, casting doubt on Slovakia’s claim that they were not asylum seekers. Significantly, the dissenting opinion also tries to confine the applicability of the Grand Chamber decision in N.D. and N.T. v Spain by noting its very extreme facts. In a plea to future constitutions of the court, the judges state: "It is vital that the limited scope of the Grand Chamber’s judgment in N.D. and N.T. v. Spain be respecte0d. An overly broad interpretation of the judgment would damage the “broad consensus within the international community” concerning compliance with “the Convention guarantees, and in particular … the obligation of non-refoulement” (see N.D. and N.T. v. Spain, cited above, § 232)." This case is another depressing footnote in the story of how Europe has sought to make itself inhospitable to irregular migrants. But the level and strength of dissent illustrates that these issues remain open for argument before the Strasbourg court.

Информации нет и не может быть пока идет рост заболеваний в UK. Мы стандартно подаем заявления клиентов, чтобы выполнить требования Правил и защитить клиентов секцией S3, т.е. чтобы они не стали overstayers. Далее - уже технические детали - когда откроются центры для сдачи биометрики и т.п. Home Offiсe подтвердил, что правило "сдать биометрику в течение 45 дней с даты подачи заявления online" не применимо к такой ситуации. См. пост выше о то, что сейчас происходит подача. Вчера вообще был личный рекорд - за 3 часа подали 3 заявления. Сейчас многие, кто взял у нас сервис сопровождения их заявлений переходят (upgrade) до уровня полного ведения дела. Если раньше было не просто подавать заявления теперь стало еще запутаннее. Я ожидал спад активности клиентов, а получилось наоборот. Вот, только что девушка записалась на консультацию на июнь 2020 года.

И важное напоминание подавать вовремя заявления на переход с категории на категорию, продление статуса, получение ПМЖ и гражданства стандартным путем: If you already have leave in the UK and planned to extend your leave when it expires, you do not need to complete this form. Please continue to apply using the appropriate online application form. Из практического опыта. Сегодня (06-04-2020) до обеда подал следующие заявления клиентов: - Супружеская виза (из Белоруссии) - Продление визы жены - Натурализация Заявления принимаются стандартно online. Нет возможности выбрать ускоренное рассмотрение, т.е. есть только Standard Route (рассмотрение в течение 6-и месяцев). На биометрику нельзя записаться и, соответственно, нельзя загрузить документы. Остается ждать до тех пор, пока коммерческий партнер Home Office - Sopra Steria - снова начнет свою работу. Из разговора с коллегой из Home Office стало ясно, что со временем будет расти очередь из таких заявлений. И, соответственно, такие иммиграционные заявления будут рассматривать в порядке очередности, т.е first come, first served.

Соответственно, эта клиентка не могла начать учебу в британском университете расценкам для граждан Великобритании/лиц с ПМЖ. - Уточнение по визовым категориями Tier 2 (General) и Tier 1 (Entrepreneur). - Уточнение по волонтерсакой работе >>> COVID19 and the Home Office clarification for the following immigration issues: - Tier 2 If you cannot pay the salaries of sponsored employees because you’ve temporarily reduced or ceased trading You can temporarily reduce the pay of your sponsored employees to 80% of their salary or £2,500 per month, whichever is the lower. Any reductions must be part of a company-wide policy to avoid redundancies and in which all workers are treated the same. These reductions must be temporary, and the employee’s pay must return to at least previous levels once these arrangements have ended - Tier 1 Entrepreneur If you are on a Tier 1 Entrepreneur visa and your business has been disrupted You no longer need to employ at least 2 people for 12 consecutive months each. The 12 month period you are required to employ someone for can be made up of multiple employees across different months. Time when your employees were furloughed will not count towards the 12 month period. If have not been able to employ staff for 12 months in total by the time your visa expires, you will be allowed to temporarily extend your stay to give you time to meet the requirement. - Changes to the current restrictions on the number of hours you can work or volunteer There is no longer a limit on the number of hours you can work or volunteer each week if you work for the NHS as a doctor, nurse of paramedic and you are a: tier 4 student tier 2 worker and your NHS job is a second job visiting academic researcher holder of a short-term visa and are permitted to volunteer

For those who have a limited validity BRP they are revising the notification of grant of leave and the BRP carrier letter to explain the difference in the date of expiry of leave and date of validity of the BRP card. They will update right to work and right to rent guidance to ensure that employers and landlords are also aware of this issue. They will provide advice on GOV.UK to reassure anyone with a short-dated BRP that it does not affect their immigration status and they do not need to do anything now. Any delays caused by COVID-19 will not affect decisions around your application. >>> Migrant and self-employed workers and the COVID19 - the Home Office response From the Home Office Migrant workers The Government has made provisions to allow employers to retain employees during interruption to commercial activity because of the pandemic. Employers can apply for support from the Government that can assist with these current difficulties. Employees whose leave in the UK is subject to conditions that they have no recourse to public funds may be able to secure assistance (subject to meeting all requirements) through- 1) Statutory Sick Pay 2) Contributory-based Employment and Support Allowance 3) Support provided to employers through the Coronavirus Job Retention Scheme 4) Some other work related benefits. Это не повлияет на поданное заявление Другими словами, иммиграционные заявления подаются как обычно, но с учетом особенностей ситуации во время COVID19
