Хорошие новости. На прошлой неделе подал заявлениe клиента на ILR по категории Tier 2(General). Тогда смогли только подать и оплатить заявление. Ни биометрику, ни загрузку документов не смогли сделать. Сегодня получили Email из Home Office выслать им документы напрямую по Email. То есть в обход биометрики и загрузки документов через Sopra Steria. Я выслал документы в Home Offie по Email в течение 30 минут :-) Сейчас ждем решения.

Сегодня порадовал Home Office. На прошлой неделе Legal Centre подал заявление клиента - Tier 2(General) - ILR (ПМЖ). В своем письме я попросил Home Office рассмотреть заявление клиента быстрее, не смотря на COVID19. Сегодня, 19 мая 2020 года, я получил Email из Home Office, где они попросили выслать документы клиента им по Email напрямую, без сдачи (по крайней мере пока) биометрики. Сканы были высланы в Home Office в течение получаса. Теперь ждем решения.

Пожалуйста. Рад был помочь Вам. Вот собственно и ответ - см. выше выделенное. Если будете просто сидеть на документах - потом можете просто оказаться в конце очереди. Ведь дата подачи заявления считается дата оплаты заявления online, а не дата сдачи биометрики.

18 May 2020 – Just useful and interesting UK & EEA Immigration Law news and updates from the Legal Centre – Open 7 days a week - www.legalcentre.org - +44(0)3300010342, +44(0)7791145023 (WhatsApp/Viber) >>> It just got more difficult for Europeans to become British citizens: https://www.gov.uk/government/publications/naturalisation-as-a-british-citizen-by-discretion-nationality-policy-guidance The Home Office has decided to make it more difficult for European residents to become British citizens. EU citizens with settled status who apply for naturalisation now have to provide evidence that they have been living in the UK legally, according an update to government nationality policy released on 15 May. One of the requirements for naturalisation as a British citizen is to have lived in the UK for five years (or three years if married to a British citizen). Time living here in breach of UK immigration law doesn’t count. The Home Office has long taken the view that EU citizens physically present in the UK but who do not have a right of residence under EU law are in breach of UK immigration law. Unknowingly lacking a right to reside is surprisingly common — many people without comprehensive sickness insurance were caught out by this in the past. Because of Brexit, European residents and their family members have been offered immigration status under UK law (instead of EU law). Getting the new “settled status” does not require proof of a previous right to reside — it is mostly based on simple presence in the UK. But when people with settled status come to apply for citizenship, the Home Office is now saying that the right to reside issue must be dealt with in their application. Simply having settled status is not enough, in this context. Settled status will serve as proof of being free of immigration time restrictions (another of the naturalisation requirements) but will not do in terms of showing that the person’s period of residence in the UK was in accordance with immigration law. The updated guidance says: "An EEA or Swiss citizen or their family members who have a 5 years’ continuous qualifying period of residence in the UK and Islands when they apply to the EU Settlement Scheme will be eligible for settled status… However, this grant of settled status (also know as indefinite leave to enter or remain) will not confirm that they were here lawfully under the EEA Regulations during that time, as defined by the British Nationality Act 1981 as this is not a requirement of the EU Settlement Scheme. You may therefore need to request further information from the applicant to demonstrate this." The EEA Regulations contain the detailed rules on how EU free movement law operates in the UK. The guidance goes on to tell officials: "You must assess whether the individual has been here lawfully during their 3 or 5 year residential period prior to pre-settled status or settled status, by considering on the balance of probabilities whether they were here: as a qualified person (such as a worker, student, self-employed, selfsufficient, retired or incapacitated person) as the family member of such a person. Evidence of this can include API data or documents previously submitted to satisfy their lawful residence. Where appropriate, you must also be satisfied that the person was lawfully in the UK, with comprehensive sickness insurance (CSI)." Later on, the document does suggest that there is discretion to overlook some technical breaches of the EEA Regulations: "Following the introduction of the EU Settlement Scheme you may increasingly see applications from EEA or Swiss nationals who have not fully complied with additional requirements under the EEA regulations, such as having comprehensive sickness insurance where they needed it, and who may therefore have been in breach of immigration law. When considering such applications you should take into account all the facts surrounding such a breach and make a full assess[m]ent about whether discretion should be exercised in their favour." On exercising discretion, the policy suggests that being in breach of the EEA Regulations is not as bad as entering the UK illegally or overstaying on a visa. But Europeans — assuming they are aware of their precise legal status in the first place — will have to “provide sufficient evidence to justify discretion being exercised in their favour”. The effect will be to make it more difficult for EU citizens to become British than if settled status were simply accepted as evidence of lawful residence. By contrast, if the person has previously secured a permanent residence card, that will — unlike settled status — serve as proof of five years’ lawful residence. Приветствую, Я всегда подаю online. Как нам сказал Home Office во время майской online конференции с ними, в этом отделе остался Skeleton staff, поэтому рассматривать могут. Например, 14 мая 2020 года нам пришло уведомление о том, что заявление клиентки было положительно рассмотрено (см. другой тред). Но это - скорее всего исключение, т.к. Legal Centre является Highly Tursted Representative + мы подали буквально за день до закрытия отделений Sopra Steria. В то же время есть возможность подать заявление на гражданство по почте через бумажную форму AN, хотя Home Office сейчас НЕ рекомендует подавать оригиналы по почте из-за COVI19 (могут легко потеряться в тоннах получаемой почты которую, скорее всего, некому рассматривать/разбирать) по бумажным заявлениями по EU Law. Это можно обойти, заверив документы у нас, например. Хотя мне лично эта цепочка не нравится. Я - сторонник наиболее эффективного способа подачи. Пока он был - online. На этой неделе Home Office, возможно, даст знать, что делать. Например, если разрешать re-use biometric, значит, возможно можно будет загружать документы без биометрики. Все мы ждем новости из первоисточника. Так или иначе они - будут.

Обязательный карантин на 2 недели по возвращению в Великобританию COVID19 and the UK Immigration update >>> Compulsary quarantine The government’s “COVID-19 recovery strategy”, last updated on 12 May, says that people travelling to the UK will soon be asked to go into quarantine for two weeks after they arrive. The document states: " … the Government will require all international arrivals not on a short list of exemptions to self-isolate in their accommodation for fourteen days on arrival into the UK. Where international travellers are unable to demonstrate where they would self-isolate, they will be required to do so in accommodation arranged by the Government.". There will be some exceptions, including for journeys within the Common Travel Area (covering the UK, Crown Dependencies and Ireland) and from France. There is no official date for this policy to begin: the government only says that it will come in “as soon as possible”. But the BBC has reported that “the new restriction is expected to take effect at the end of this month [May 2020]”.

Part 3 Appendix FM Two final welcome amendments to the rules on family migration. The first is on criminal convictions. Where an applicant was sentenced to a period of imprisonment of between 12 months and four years, their application for limited leave to remain should only be refused for ten years after the end of the sentence. It was always bizarre, and probably an oversight, that Appendix FM allowed decision-makers to refuse an application forever in those circumstances. By contrast, the general grounds for refusal, which are traditionally stricter than the suitability requirements of Appendix FM, limited the refusal to a period of ten years. When relying on self-employment to meet the financial requirements, applicants must submit accounts signed by accountants from specified accounting organisations. The rules relating to which organisations were acceptable were stricter under Appendix FM-SE compared to the rules for economic migrants. They have now been expanded to be consistent. I emailed the Family Policy department on at least three occasions about this, and I like to think they made the change because they were tired of me! Finally, the rules relating to fiancé(e) visas confirm that the purpose of the route is to allow couples to get married in the UK.

Что-то подсказывает мне, кто совсем не "дополнительная анкета" имелась в виду а, например, дополнительное письмо от заявителя с изложением причин почему "должны дать, а не отказать". Интуиция мне подсказывает (у Вас же нет нарушений закона и т.п.?), что Вы начинаете что-то не то делать.

Most important updates in more details, below. <> Sole Representative route changes: - An amendment is being made to prevent an overseas business sending a representative to facilitate their entry to the UK when there is no genuine intention for them to establish a branch or subsidiary in the UK; - Clarification is being added to reflect that overseas businesses must be active and trading and intend to maintain their principal place of business outside the UK; - An amendment is being made to reflect that applicants must have the skills, experience, knowledge and authority to represent the overseas business in the UK; - Clarification is being added to reflect that applicants must be senior employees and cannot engage in their own business or represent any other business in the UK; - An amendment is being made to reflect that the ownership of overseas businesses is not limited to businesses that issue shares. Where the Rules used to say that a sole representative should not be “a majority shareholder in the overseas business”, they now say the sole representative should not “have a majority stake in, or otherwise own or control, that overseas business, whether that ownership control is by means of shareholding, partnership agreement, sole proprietorship or any other arrangement”. - An amendment is being made to prevent majority owners from entering as the dependent spouse, civil partner, unmarried or same-sex partner of a representative of their own business. This will prevent owners circumventing the rules intended to prevent them relocating their business to the UK under this route. - An amendment is being made to the extension criteria to clarify that the branch or subsidiary must have been established in the UK, and not overseas. <> Changes to the Start-up and Innovator categories - Changes are being made to make it clearer that, to be endorsed, applicants must be founders of their businesses and be relying on their own business plans. These changes also clarify that an Innovator applicant’s business may be already trading, providing they were one of its founders. - A provision is being added for decision makers to request further information or evidence from applicants or their endorsing bodies, if they have concerns that an endorsement has been issued inappropriately, and to refuse applications if they are not satisfied the endorsement criteria have been met. - The “viability” criteria are being amended to also require that a business plan must be realistic and achievable based on the applicant’s available resources. - The policy around applicants who wish to change their business venture, previously only set out in guidance for endorsing bodies, is being added to the Immigration Rules. This sets out that applicants may change business venture, providing their endorsing body is satisfied the new venture meets all of the criteria for endorsement. The applicant does not need to obtain a fresh endorsement or make a fresh application. - A provision is being added so that if an applicant has changed business venture in this way, it will not prevent them applying under the “same business” criteria in their next Innovator application. This is particularly important for applicants switching from Start-up to Innovator, as they would otherwise need to meet the £50,000 funding threshold for “new business” applications. - Changes are being made to the criteria for becoming endorsing bodies in both categories. The criteria for Start-up and Innovator endorsing bodies are being made consistent, the main effect of which is to enable Higher Education Providers to become Innovator endorsing bodies. A further change is being made to enable Government Departments to become endorsing bodies. <> Global Taent route changes - Applicants who already hold leave under Tier 1 (Exceptional Talent) who want to extend their stay must apply under the extension requirements for the Global Talent category, rather than obtaining a new endorsement from an Endorsing Body. Changes have been made to the Immigration Rules to clarify this. - The criteria for consideration by the Producers Alliance for Cinema and Television (PACT) allows some applicants to provide evidence of awards from the 10 years before the date of application. An erroneous requirement limiting evidence to being from the last five years has therefore been removed. - At the request of the endorsing bodies, letters of recommendation have been restricted to three sides of A4, excluding the credentials of the author. This prevents applicants providing lengthy letters of recommendation to circumvent other restrictions on the amount of evidence which can be provided and ensures that evidence focuses on the key skills and contributions of applicants to aid consideration of applications. The requirement is being applied to all endorsing bodies for consistency. - A small number of technical changes applying to digital technology applicants have been made at the request of Tech Nation, including increasing the length of documents allowed to demonstrate key and qualifying criteria from two A4 sides to three A4 sides. This ensures consistency with the maximum length of a curriculum vitae. - Two amendments have been made at the request of UK Research and Innovation (UKRI), adding a further acceptable host organisation under its endorsed funder route, and clarifying that the confirmation of the award must come from the endorsed funder rather than the host organisation. - An amendment has been made at the request of the Royal Society, British Academy and Royal Academy of Engineering, to clarify that research experience equivalent to a PhD, includes industrial and clinical research for both exceptionally talented and exceptionally promising applicants. - A number of technical changes applying to arts and culture applicants, including fashion design, have been made at the request of Arts Council England and their sub-endorser, the British Fashion Council. This includes clarification that the British Fashion Council consider applications specifically for those involved in fashion design rather than the wider industry, and minor amendments to the evidential criteria for letters of support. Part 2 <> EU Settlement Scheme changes: - In line with ‘New Decade, New Approach’ published by the UK and Ireland on 9 January 2020 ahead of the restoration of devolved government in Northern Ireland,1 to bring family members of the people of Northern Ireland within the scope of the EUSS (and of the EUSS family permit and travel permit). This will mean that eligible family members of the people of Northern Ireland will be able to apply for UK immigration status, under the EUSS, on the same terms as the family members of Irish citizens in the UK. This immigration status will be available to the family members of all the people of Northern Ireland, no matter whether the person of Northern Ireland holds British or Irish citizenship or both, and no matter how they identify; - To extend the scope for victims of domestic violence or abuse to apply for status under the EUSS. In line with the Withdrawal Agreement and the Free Movement Directive, this is currently limited to a former spouse or civil partner whose marriage or civil partnership has been legally terminated and who was a victim of domestic violence or abuse while the marriage or civil partnership was subsisting. Consistent with the Government’s wider commitment to tackling domestic violence or abuse and protecting victims of it, the changes will mean that any family member within the scope of the EUSS (a spouse, civil partner, durable partner, child, dependent parent or dependent relative) whose family relationship with a relevant EEA citizen (or with a qualifying British citizen) has broken down permanently as a result of domestic violence or abuse will have a continued right of residence where this is warranted by domestic violence or abuse against them or another family member. They will be able to rely on this, together with their own continuous residence in the UK, in applying for status under the EUSS; - To provide scope, consistent with the Free Movement Directive, for their children and other family members, as well as their spouse or civil partner, to have a continued right of residence in particular circumstances following the legal termination of the marriage or civil partnership of a relevant EEA citizen (or of a qualifying British citizen). Those circumstances will include where the marriage or civil partnership had lasted for at least three years prior to the initiation of proceedings for its termination and the couple had lived together in the UK for at least a year during its duration. The family member will be able to rely on this continued right of residence, together with their own continuous residence in the UK, in applying for status under the EUSS; - To provide scope for a family member applying under the EUSS or for an EUSS family permit, where this is necessary for the purposes of deciding whether they meet the eligibility requirements, to be required to provide a certified English translation of (or a Multilingual Standard Form to accompany) a document submitted as required evidence of the family relationship (or as certain required evidence of qualification for an EUSS family permit) on which their application relies; - To refer to scope for an EUSS application made on a paper application form to be submitted by e-mail rather than by post, where a Home Office e-mail address is specified on the form; and - To clarify the circumstances in which a continuous qualifying period of residence on which an applicant relies for their eligibility for status under the EUSS does not have to be continuing at the date of application -

The individual will still need to pass the test before the application can be granted. However, the formal Home Office policy is yet to be published. Salary reductions The Home Office has confirmed that a sponsor is not required to submit a change of employment application where they are reducing the salary of a high earner to below £159,600 if the reduction is due to Covid-19 and is in line with the concession provided in the Home Office guidance i.e. it is temporary and no less than 80%/£2,500 per month (whichever is lower).

Приветствую, Программа Tier 1 (Предприниматель) менялась несколько раз. До 2014 года были другие Правила наема рабочих. Сейчас программа закрыта. Помогите тем, кто приехал до закрытия программы, продлите их Уровень 1 (Entre [reneur) статус , получите ILR и, разумеется, в конце концов - гражданство . Вот текущее обновление по этой программе в отношении COVID19: https://www.gov.uk/guidance/coronavirus-covid-19-advice-for-uk-visa-applicants-and-tevent-uk-residents Если вы находитесь на предпринимательской визе 1-го уровня, и ваш бизнес был разрушен Вам больше не нужно нанимать как минимум 2 человека на 12 месяцев подряд каждый. 12-месячный период, на который вы должны нанять кого-либо, может состоять из нескольких рабочих мест в разные месяцы. Время, когда ваши сотрудники были уволены, не будет учитываться в течение 12 месяцев. Если к моменту истечения срока действия визы вы не смогли нанять персонал в течение 12 месяцев, вам будет разрешено временно продлить срок пребывания, чтобы у вас было время для выполнения требования. Эти договоренности будут действовать в отношении заявлений, поданных после 31 мая 2020 года, когда рабочие места, на которые вы полагаетесь, были нарушены из-за COVID-19.

Заметил существенный рост записи форумчан, и не только, на консультации по домашнему насилию (Domestic Violence) . Обращаются по несколько человек в день. Похоже, COVID19 (резко) обострил то, что, возможно скрывалось, замалчивалось или просто ждало своего момента. Практически всем обратившимся можно помочь. В некоторых случаях есть возможность подать заявления бесплатно, т.е. без оплаты госпошлины Home Office. При работе с жертвами домашнего насилия мне очень помогает дополнительное образование по психологии, нейро-лингвистическому программированию (НЛП) и клиническому гипнозу. Иногда приходится даже применять эти же навыки и на себе, чтобы после всего услышанного в тот же день вернуться в нормальное состояние для работы с другими клиентами. Надеюсь, что COVID19 скоро закончится и все образуется. А пока желаю всем нам быстрейшего возвращения к обычной жизни. Кстати, больше всего мне нравится гипнотерапия, т.к. в ней можно использовать и сам гипноз, и психотерапию, и НЛП. В мой библиотеке имеется 51 книга по гипнозу. В свое время я довольно детально и серьезно изучал его. Включая stage hypnosis.

Важная информация для искателей убежища в Великобритании во время COVID19 Asylum - Intake and interviews The Home Office has decided to “pause face to face substantive asylum interviews for now”, according to correspondence from the Asylum Operations team. All interviews scheduled from 19 March onward are cancelled. Some initial screening interviews are also being cancelled. Registering an initial asylum claim must still be done in person, but no longer has to be at Lunar House in Croydon. The Home Office announced on 22 April that “the AIU in Croydon will continue to function as normal but will additionally be supported by limited operations in Glasgow, Belfast, Liverpool, Leeds, Solihull and Cardiff”. Asylum seekers in Great Britain can make an appointment to register their asylum claim by calling 0300 123 4193. (In Northern Ireland, they are advised to turn up at Stockman House between 9am and 5pm.) Walking in with first making an appointment is discouraged but possible if the person “has nowhere to live” and needs to get into the asylum system to get accommodation. However, those making further submissions with a view to have their case considered as a fresh claim have since 18 March been able to lodge them by email or post instead of turning up in Liverpool in person.
