  2. Очередное продление визы родителя британских детей. Гражданин Украины, очередное продление его статуса на 2.5 года на основании родительских отношений с британскими детьми. Заявление рассмотрели быстро. BRP пришла на 5-й день после получения решения по Email. Делюсь статистикой.

The claimant is from Belfast and regards herself as 100% Irish, from passport to first language. Section 1(1) of the British Nationality Act 1981 says that she is also a British citizen. Ms Ní Chuinneagain objects, and refuses to renounce her unwanted second nationality, saying that “doing so would represent an acceptance that she was born a British citizen, in addition to having to pay the administrative cost involved”. Mr Justice Scoffield found that being legally British “takes nothing away” from Ms Ní Chuinneagain’s rights as an Irish (and EU) citizen: “she is effectively free to ignore it”. Unlike in De Souza [2019] UKUT 355 (IAC), there was no “concrete detriment” to dual nationality. It could not “seriously be suggested” that filling in the renunciation paperwork would be a breach of her human rights. Nor was the Good Friday Agreement any help: "it is a matter of well-established law that the Belfast Agreement (or the British-Irish Agreement), as an international agreement, is not enforceable as a matter of domestic law, unless and until (and only insofar as) it is incorporated into domestic law." The Northern Ireland Protocol didn’t change this, as it “does not seek to give independent legal effect” to the Agreement. Scoffield J added that, even if the Good Friday Agreement were enforceable in court, it’s not clear that it actually forbids automatic British citizenship for Irish people.

По-русски: Публикую уточнение требований в отношении ускоренного получения ПМЖ (ILR) нелегалами до 25 лет. >>> ЛЕГАЛИЗАЦИЯ НЕЛАГАЛОВ ВОЗРАСТОМ ДО 25 ЛЕТ - УСКОРЕННОЕ ПОЛУЧЕНИЕ ПМЖ (ILR) В октябре 2021 года правительство Великобритании объявило о так называемой концессии легализации и ускоренного получения ПМЖ (ILR) для лиц возрастом до 25 лет, кто находится в Великобритании нелегально. Новая концессия дает шанс молодым людям до 25 лет включительно легализоваться в Великобритании и сразу получить желаемый статус постоянного резидента Великобритании. Обратите внимание, что правительство Великобритании не будет "раздавать" ПМЖ всем подряд. Как всегда, существует определенный список правил и условий, которые необходимо соблюсти: - Возраст от 18 до 25 лет включительно и провести в Великобритании не менее половины своей жизни (исключая срок нахождения в тюрьме) - Быть рожденным в Великобритании или быть привезенным в Великобританию в детском возрасте - Иметь ВНЖ (визу) на протяжение 5 лет - Выполнить все условия параграфа Правил 276ADE(1) и подать заявление на основании этого Правила Так же при рассмотрении заявления будут учитываться различные факторы из прошлого пребывания заявителя в Великобритании (отсутствие криминала, сотрудничество с властями с целью легализации и т.п.).   7. Периодически обращаются соотечественники со сложными делами, отказами и т.п. Хотят, чтобы я сразу сказал шансы на успех и т.п. Это возможно сделать, но нужен детальный анализ ситуации, ознакомление с документами, диалог. Для этого нужна предварительная консультация. И тут начинаются вопросы: "А зачем ? У меня уже было 3 юриста/отказа/высылки". Говорите/делайте/все сразу и сейчас и здесь !". Приходится использовать наглядный пример из жизни. Помогает практически всегда и не оспаривается звонящим :
  8. Home Office объявил о легализации (получение досрочного ПМЖ - ILR - Indefinite Leave to Remain) лицам до 25 лет. Более детально о легализации: >>> Early Settlement (ILR) concession for young people living half their lives in the UK:https://www.gov.uk/government/publications/family-life-as-a-partner-or-parent-private-life-and-exceptional-circumstance Some young people born or brought up in the UK without immigration status can now apply for settlement after five years rather than ten. The change in policy comes in a new and very welcome Home Office concession, published yesterday. Paragraph 276ADE(1)(v) of the Immigration Rules allows people aged 18-24 inclusive, who have spent half of their life living continuously in the UK, to apply for permission to stay. The catch is that they remain on the immigration system treadmill for a long time. The concession allows those with permission under the half of life rule, and who were born in the UK or entered as a child, to apply for indefinite leave to remain (ILR) after five years rather than ten. The full eligibility requirements are that the applicant: - Be aged 18 years or above and under 25 years of age and has spent least half of his/her life living continuously in the UK (discounting any period of imprisonment) - Have either been born in or entered the UK as a child; - Have held five years limited leave; and - Be eligible for further leave to remain under paragraph 276ADE(1) of the Immigration Rules and have made an application under those rules. That is not all requirements, though. Caseworkers must then decide whether or not to grant “early” indefinite leave to remain: "Where an applicant meets the above criteria and requests an early grant of ILR the following factors should be considered. These include (but are not limited to) the following: - the person’s age when they arrived in the UK - the length of their residence in the UK (including unlawful residence) - the strength of their connections and integration to the UK - whether unlawful residence in the past was the result of non compliance on the part of the applicant or their parent/guardian whilst the applicant was under the age of 18 - efforts made to engage with the Home Office and regularise status - any leave currently held and length of continuous lawful leave - any period of any continuous leave held in the past - whether (and the extent to which) limited leave to remain will have a detrimental impact on the person’s health or welfare These must be weighed against public interest factors. An example of where the balance may be in favour of granting early settlement is where "previous non-compliance with immigration requirements was not of their own choice or responsibility, because their overstaying was as a child or young adult under the age of 25." This is an important change in policy with the potential to transform the lives of young people brought up as British but denied settlement and citizenship as punishment for choices that were not their own.

The appeal, as Lord Reed states in his opening sentence, raised a “question of constitutional importance”. That question was whether the government (or anyone else) can lawfully act in a manner inconsistent with a defective order of a court or tribunal without first having that order set aside or varied. The answer, the Supreme Court has concluded unanimously, is "no". >>> The Home Office can ignore human rights claims: https://www.bailii.org/ew/cases/EWCA/Civ/2021/1500.html The Court of Appeal has given its long-awaited decision in the case of MY (Pakistan) v Secretary of State for the Home Department [2021] EWCA Civ 1500. Unfortunately, it confirms that the Home Office can refuse to engage with a human rights claim for permission to stay in the UK which is not made using the specified form or process. That leaves the applicant with no right of appeal.

  21. Из недавнего. Продление пребывания в Великобритании как отца детей из EU Заявление FLR(FP), так называемый 10-Year route to Settlement. Сложный случай, т.к. пришлось дополнительно работать с судом, полицией и "подстегивать" Home Office по причине того, что у клиента были нарушения закона. Заявление положительно рассмотрели за чуть менее чем 1 года. Делюсь статистикой.

The answer is "No" under para ST 26.5.: - ST 26.5. A Student is not allowed to do any of the following: (a) be self-employed or engage in business activity unless ST 26.8 applies; or (b) work as a professional sportsperson (including as a sports coach); or (c) work as an entertainer; or (d) work in a position which would fill a permanent full-time vacancy unless ST 26.6. applies. - ST 26.6. If a Student has permission and makes an application for permission to stay under the Skilled Worker route, supported by a Certificate of Sponsorship assigned by a licensed sponsor, the Student can start the employment for which the Certificate of Sponsorship was assigned, for up to 3 months prior to the course completion date, provided: (a) the Student is studying a full-time course of study at degree level or above with a higher education provider with a track record of compliance; and (b) the application as a Skilled Worker was made when the applicant had permission as a Student; and (c) a decision has not been made on the Skilled Worker application, or where a decision has been made, any Administrative Review against a refusal has not been finally determined.

  24. Очередная статистика положительных решений - натурализация (британское гражданство). Гражданин Белоруссии, заявление AN (Naturalization). Рассмотрели за 4 месяца. Делюсь практическими сроками и статистикой.
